WE are one of many  who have purchased an apartment on the  phase 1 B of the Nueva Ribera Beach . WE have made a definate decision that due to it now being 2 years late for completion we wish to withdraw from the purchase  The  news that the developer has built the penthouses different to the plan   and also the arch at the entrance to the site only adds to our lack of confidence that this will be the luxury beach front development  that was 
promoised on purchase . What other changes could they have made that we do not know about . I cannot see the club house ,spa and pier ever being built !
We would be very grateful of any positive news regarding  withdrwawal from the contract . We have a spanish solicitor who tells us we have a very good case against the developer but any progress in getting a final decision  from the court seems to be taking forever

Hi Phil, We originally purchased a property in phase one. We tried to break the contract but were told by our spanish lawyers that it was not possible. We also received a joint letter from the promotor and One Properties underlining that fact. Therefore we reluctantly took up an offer to transfer to a property in phase one. To my knowedge there are a number of owners who have employed the services of a lawyer on phase one and two. Some of the owners have been advised by an independant  promotor to form an action group via the community to put maximum pressure on the community administrators to liaise with the town hall, promotors and community members to get some answers to everyones woes. The community is currently been managed by Admiburgos who do not seem to be acting in the best interets of UK based property owners. The problems and concerns go way beyond the arches to the entrance of the resort, for instance we now know that the public have accecss to the 'private' beach club, the barriers to the resort are not permissable, the pool on phase one is smaller than  the plans, the lifts do not work due to no telephone connection. The list is endless.
