having recently dicovered "Eye on Spain" and in the process of buying a "Donana" at Alm.C.C.I thought I would share the following which is part of E mail to my daughter from her Spainish friend in Almeria:
"as promised I phoned the mayors house in Cuevas Del Almanzoraand they now say that PLAN GENERAL DE URBANIZACION is not authorised yet. Even if they get authorisation in the next month and the plan is approved it then needs the O.K. of the regional government...."JUNTA DE ANDALUCIA"...which can take 6 months to answer. So I asked for an honest answer to "how long wil everthing take" and she replied "about 12 months before they start building!"
This was received by my daughter on 19 Jan. 07. PLEASE DON`T LET IT BE TRUE!

the plan will be approved provisionally in the next few days, then sent to almeria junta for final approval, restart will be approx. may of this year.

I hope you are right Jethro but I think Fredees post is more realistic. This is all a political game and we are innocently caught up in the middle. The ruling party are going to play this right up to and through the elections , trying to make opposing mayors look as bad as possible in hope that they can get their own people in. If they dont succeed , they will probably look for other ongoing mud slinging. I doubt if it can go on indefinately as there must be some form of time limit requirement for the approval process ( providing there is nothing to "pick at" in the propsed plan that is!). I know info comes out from Huma and also the Town Hall ,but it is their wish list and unfortunately they are not in the driving seat.

It seems buyers are getting different dates for the building re-start. If you speak to Parador they will say "building will recommence any time now"... the same old nonsense they've been rattling out parrot fashion for the past 2 years!
My independent solicitor (no not Aldea) tells me much the same as Fredee's post. If Huma get approval in Feb then the Junta de Andalucia could sit on the final decision until Oct 07.
So don't hold your breath ! This time 2008 seems a realistic estimate for the workforce to "legally" regroup and resume construction !

The short answer to your E.mail, Les ,is NOTHING.I visited the site in May last year and although some building had taken place it was deserted and has been ever since as far as I know! I`m sure it will all eventualy be built....if you have time to wait....but at my age(early seventies)I don`t want to wait any longer. I reckon no-one will be living on that site for,at the very least, another 18 MONTHS!

Things suddenly appear somewhat gloomy again after the flurry of excitement that followed the glossy brochure being sent to us. However I hope Jethro is right with his predictions. Are you basing this on anything you know Jethro or is it just a hunch?

Just returned from a visit to spain - nothing has changed from my last visit in Sept 06. My independent solicitor (not Aldea) also backs up what other have stated below - the final approval is still awaited and is most likely to take some time and not to expect any building works to commence this year.
All opinions seams to suggest that it will happen but not in the time frame of what Aldea or Parador are suggesting.
If you can wait then it is a gamble worth taking as property is increasing in value without a doubt, but it depends if time is on your side or not.

I am very sorry to hear about all the ongoing Trauma at Almanzora ountry Club and truly sorry about all the people who still have their money tied up with no real sign of any development.
We purchased at Almanzora years ago and immediately felt distrust towards HUMA. Yet the location for the resort was perfect among the best I've seen - even today. We allowed our judgement to go unguarded for a longtime before we pulled the plug. luckily we only paid our deposit and had refused to hand over any further money until the licences were released - we left it with our own independent solicitor. When we pulled the lawyer sent our money back
We got our deposit back directly from the agent - not against the contract but as a 'goodwill gesture' as they had missold us the property having told us that all licences were granted. Rather than try and take action through the legal courts in Spain, I threatened action against the English branch of the agents - This would be on my own turf and I would have the power to get really involved and not leave it in trust to solicitors in a different country. I also had the threat of bad publicity in England where the majority of their clients were
I have now moved on and bought on another development. i will not kid you - the same issues are still about and the frustrations about delays e.t.c.- this is Spain and in the near future this will not change but there is such a difference between the developers. they are poles apart and it has really made me appreciate just how poor HUMA were. The relationship with developer continues well after build is complete and I am pleased to know that by chance ( and it is by chance) that my developer now has integrity and customer service at heart.
Anyway, There is very little I can say to help your situation only that it pays to fight your own corner and be in charge of your own destiny and that sometimes you need to change your focus away from the developer (guarded by Spanish bureaucracy and shift youor attention towards the english agents via the English courts) Your contracts state that any issue relating to the CONTRACT has to be sorted in the Spanish courts but if you were missold before the contract took place then you could fight it in the ENGLISH courts.
I do hope that ACC gets built one day and I hope that it turns out to live up to its potential. For those who are waiting it out I really hope that you get everything you hope for!

I just got a letter in the post today from Parador, dated 7/2/2007. The ususal mish mash of how things were going, or not going, back and forth. Page 2 paragraph 3 expresses how sorry they are and they say how "We do understand that this delay may have proved to be difficult in your personal circumstances nad we are sorry if you are inconvenienced in any way".......Well I have been and I am... For those of you in Parador and PUMA who may be listening, I have handed over 60,000 Euro over and I have been paying interest on that for the last two years. I visited the lawyers, Aleda which were recommended by Parador in Vera last year, and they couldn't give me any answere as to when or if, it would ever go ahead. The Parador people were slightly more optimistic, relying on the word of the HUMA people. The HUMA people on site told me that the building would begin again in full swing and without any problems, for last September 2006. That was on site. Still no building.
Our hopes have been risen with the documentation and the new web site plans, and dashed again with this kind of news. The parador letter more or less confirms that they don't know when things are going to start.... This is the best bit.... In they letter they say "Any legal matters should ideally be adressed to your legal advisors in Spain who will be pleased to assist you". OK! My question is this.?
If I pull out at this stage, will I get all my money back.
Will I not only get my 60,000 Euro but interest on it for over 2 years of having it in their accounts?
Will I have to pay any legal fees, since I have been left in this limbo, of everyone making promises of tomorrow but nothing going on.

Recent experiences (not personal) have shown that: Yes, you will get you money back (eventually). No, you won't receive any interest, Yes, you are responsible for any legal fees due to date, plus any fees due for getting your money returned.

I pulled out last year and it took about five months to get my money back. My lawyer at the time Fuster recommended by Parador told me that it wasnt worth going after the interest . I didnt agree and it works out that the interest is in the region of 8000€ for two properties. I now have a new lawyer and we are suing HUMA. I am claiming for the interest on my payments, storage of furniture and rent paid because we couldnt move into our house they promised. Given your situation if you decide to pull out best thing is to get an independent solicitor. So far HUMA have refused to speak by phone to my solicitor and have ignored his emails and letters. He is now preparing to get a court date that will force them to talk to us.
I dont beleive that anyone should let HUMA away with anything they obviously dont care about their customers so why should we care about their business.
