You mention Maria de Castro. Is she the solicitor based at Costaluz Lawyers and is she acting for you?

If so we may cantact her for guidance.

At present we are looking into sending a burofax requesting our second payment bank guarantee as just receiving this would give us a little more faith in the system. Our post office has never heard of a Burofax but thats not unusual in our small Town.

Hi Andy It is the same Maria and you can contact her via this site. We have not officially inststructed her but I have a feeling we will be doing so after our visit to Polaris HQ next week.

As for the Burofax, we wrote up a letter with the heading Imperative Request for Fulfillment, wrote out what we were expecting PW to fulfill and also within what timescale and then sent it from the post office's fax machine. I am not too sure why this is the accepted correspondence but I think it is something to do with that being seen as legal as oppossed to emails.

Had some correspondence from PW today stating they will assist me to fill out the complaints form so it does not look like they are about to hand the money over any time soon.

Also telephoned them the other day to be informed that they are not in any way denying me access to my money so when I asked (very nicely) can I have it then?  the customer service person said well you will get it but I just dont know when!!!

Tried to explain that if that was the case I was being denied access but she could not see it like that. It would actually be quite funny if there was not so much of our hard earned cash at stake.

I just read your message regarding phase 3, were u advised that phase 3 was cancelled  or how did you find out. We bought in block 166 of phase 3 but dispite our efforts to find out what the delay in building ,we have never got a straight answer! Our spanish solicitor is  looking into it but they are so slow.

Saundria, do you mean you have purchased property on the islands because block 166 is on the islands phase 4, these have not been cancelled but are due to be built, when is anyones guess in the current economic climate.

We purchased one of the apts in the u shaped block , 2nd block on the right of the roadway to club house as you look on plans. Any idea what this is called now as we have not got any notice of change at all, not surprising though having read all the threads!!!

Saundria, The block you mention is also block 166 in phase 3, can't understand why there are 2 block 166s !! but yes, phase 3 was cancelled around November 2007 when everyone should have been contacted by Polaris with options of transferring to phase 1 or 4, moving to another key ready resort or having your money refunded, we opted to transfer to block 172 on the island. I suggest you contact customerservice@polarisworld.com  to get them to sort this out for you

Hi Andy/Linda

Just been catching up and interested to see that we are not alone on trying to get our money back.  We were purchasing on Phase 2 (old phase 5) and despite repeatedly asking PW when was the build going to start got nowhere.  Offered to move to a key ready but they still refused.  As PW have had our money since 2006 and we have nothing to show for it decided that we had no alternative other than to take action against them.  Have now retained the services of Maria to represent us in taking legal action to try and recover our monies.  We have already issued the Cancellation Notice but PW have ignored it, so Maria and her team are currently preparing litigation papers to go to Court.  Maria is confident that PW are in breach of their contract and that we should be able to recover our costs.  Maria has been extremely helpful and would recommend her and her team to anyone else considering legal action.  We were originally represented by Danil Services, but they refused to take any action and we totally lost confidence in them.

Hi there

Forgive my ignorance but can anyone advise where I obtain a pro forma cancellation notice or do I just send a Burofax requesting cancellation on the grounds that PW have had my 1st payment since Oct 06 and 2nd since April 07 and I still have neither Bank guarantee despite repeated requests. I have also just been given a 6 th different(extended) completion date.

We have now visited Terrazas (phase 1 ) on several occassions initially with snagging and then with deliveries and the quality of the build and finishing has improved again. ( We didint expect this due to the economic climate). The layout of the properties and their quality should make this resort very nice when its finished. Good luck to all.
