Hi all,
My husband and I put a deposit down on an apartment in May 2005. We were told that in March 2006 that the builders would get their building license but from what I've heard on the forum this is still not the case. Our property was supposed to have been ready for completion Jan 2007 but this will not happen. We have been told by our solicitor that we cannot get our deposit back until they don't fulfill the contract i.e. not complete by June 2007 (6months grace). We now want out and if possible would like to get our money back sooner, does anyone know if this is possible??? Appreciate any advice.

It may be possible to get your money back given that there are no licenses issued therefore the contract is not valid and the sale probably illegal. Go to a lawyer if you get no joy.

We visted ACC with our Parador rep in July. He said that building would recommence after the Spanish holiday, in theory, beginning of September...........Hmmmm, Spain, builders & Holiday. More chance winning the lottery, which sums up ACC, It's amazing how much they've built without a licence.

I received an e-mail from my solicitors on 29-Sep and have included an extract below. I wonder if this 'meeting' is the one Huma refer to on their correspondence to Lynn/Dave? (see posting dated 15-Sep) Or am I just being paid 'lip service'?
Is anyone aware of a meeting between all parties on 25 Sep?
In reply to your letter on 25th of September 2006, we inform you that We are still waiting for the approval of the General Plan into the Regional Goverment, there was a meeting last monday between all the parties and there was an agreement to approve so as soon as they will do it I will let you know.

Hello all
I bought a villa February 2004. The contract expired (with the 6 months) March 06. My solicitor tells me to be patient as the arbitrator has managed to get 2 ??? lots of money returned. I have difficulty getting answers from my solicitor much less the builder.
I think the only answer from those like myself who have legally cancelled is a group law suit.
I have told my solicitor that I want interest on the money €90,000 from the cancellation date. He has not answered me. Interested to hear from others.

I think it would be useful if people named solicitors now - so we can draw up a list of who not to deal with.Who did you use?
If you have a Bank Guarantee, then it now seems that does not mean you will get your money back easily or at all!!!! I think it would be interesting to know what has happened to you since you cancelled.
I have posted a new thread (near the top of the list) and a reply from Huma (as I do not have a Bank Guarantee) on the site - you may be interested in their comments.
I am looking into legal action for purchasers who have not come to the end of the completion date + 6 months.
I am of the same mind as you - since we have no definite date to even restart building, like mind people need to start looking at some group action - as we have been missold - it does not matter who's fault it is - we should be able to get our money back if we so wish, whether we are overdue or not.
I look forward to others comments.

I have received an email from Huma regarding timescales.

There is more information and replies from Huma - especially regarding Bank Guarantees not received.

As at Thursday last week there was nothing going on at all. Not even security. This despite promises from our Parador rep that it was all sorted and that work would start at the beginning of September. However, Huma obviously think that they'll be back on site. There are 5 cranes still on site there, must be costing a fortune to keep them on hire.

They're the guys sitting in the white car parked in the shell of one of the villas. They don't actually get out and challange you anymore - they used to, but I think the novelty's worn off. lol

Saw them in June, but there was no-one on site at all last week.
Waiting for a response from Parador (not much chance there) as their man told us everything had been sorted. According to him, building should have recommenced at beginning of September. But he's a rep working in the area, what would he know.
Initially got a bog standard letter from them, which told us everything that we had told them.
When it every opens there'll be loads of opportunities for Parador employees as stewards in the bar

Many of these are buyers at Almanzora Country Club, in Costa Almeria, where the Mayor of Cuevas del Almanzora is being "exhaustively examined" by the Diputación de Almería after the regional planners discovered he had given unauthorised planning permission for a large-scale development in which hundreds of buyers had paid over up to half the value of the promised homes – without the vital building licence. The mayor now accepts there never was a proper building licence and is pleading with the regional planners to allow the development to go through "because so many people have already bought here already". The regional chiefs have threatened to have the development bulldozed down and their final decision is expected within months

That posting is no longer relevant and putting up stuff like that on this thread serves no purchase other than to antagonise & upset people who already have enough of those emotions.
ACC WILL go ahead albeit much later than many of us origonally expected.
On 31st March 2006 the planning authorities confirmed this development could go ahead on a reduced basis subject to the necessary infrastructure being put in place.That is where it is at at the moment and we all just have to have patiencewhile this is planned ,agreed and eventually put in place.
You can bet your house on it that once HUMA get the go ahead they will do everything in their power to build all our housing units as quickly as they possibly can.It makes sense.You can also bet your house that the value of these units ,fully legal etc etc will be worth a lot more that we paid or agreed to pay for them.
But please all you mischief makers stop posting unnecessary/irrelevant posting.
Get your kicks somewhere else.

oops, have realised that this article I read on the internet does go back to July 2005 and as you rightly say alot has happened since then (although we were expecting more to happen)
As I believe after speaking to Parador today as I was genuinely concerned regarding this article, the provisional licence was agreed in March'06 and now they are waiting for the formal licence to be agreed, which should be within next few weeks as soon as Parador hear anymore news they will let us know

I wrote to Parador this week, and this is a section from the response that I received.
As things stand we are now in the final processes of getting the builders back on site. What we are waiting for is the regional council to formally approve the town plan, the same plan that was agreed in principle between the councils back in March of this year.
I have spoken to the builders in the last few days and they have informed me that just last week the town council met with the Junta and passed across the town plans for study and approval. Once the approval is given the new building license will be granted giving permission for Huma to recommence construction.
We do not yet know how long this take, but as soon as we know we will advise you.
I don't know if this differs from anyone else's reply, but this is what they're saying this week!!!! Blanchy
