Hi everyone just joined this site.My wife and i put down a deposit and later a 2nd stage payment on an aroma basic in july 2004 we pulled out september last year and got all our money back minus the interest in january this year we now have purchased inland and very happy.Anybody worried or confused about what  they should do legaly or otherwise contact me regards Graham.

My Solicitor in Vera had said there could be a further complication - basically in their words - Andalucia approves an urban law (the POTA) which regularise the growth of the municipalities in a fixed rate of the existing population. This means that a municipality cannot build more than a fixed number of properties per year. ACC overruns this fixed rate so there are doubts this will be approved.

I have no idea what the consequences of this are but if anybody can throw any light on this I would be grateful.

It isn't a law yet, it hasn't been approved by the Andalusian Parliament.  Your solicitor should know that.

Hi All,

Recently joined this site. I signed up for a property in April 2004. I have minimal information from Huma about where this development is heading , and I have had nothing at all from Aldea Advisors. Can anybody enlighten me as to what is happening, and should I just quit and run or stick with it?

I would be grateful for any feedback

MY ADVICE WOULD BE TO STICK WITH THE PROJECT UNLESS YOUR FINANCES WOULD NOT ALLOW THIIS OR YOU HAVE OTHER REASONS FOR PULLING OUT.

I KNOW THIS HAS BEEN A LONG HAUL AND WE ARE NOT THERE YET, BUT I FEEL THE GOAL POSTS ARE WITHIN SITE!!

IT WILL HAPPEN, SOON , THOSE THAT HAVE PULLED OUT TO BUY ON ANOTHER DEVELOPMENT WILL IF THEY ARE HONEST REGRET THERE MOVE AND WISHED THEY HAD HUNG ON AS THE COUNTRY CLUB DEVELOPMENT IS THE PLACE TO BE AND THIS IS REFLECTED IN THE DEMAND FOR THE PROPERTIES AND THE INCREASED PRICES! { THATS MY OWN OPINION }

thanks for your response, I can stick with it as long as it takes, I have no real financial issue at the moment whcih would mean me having to pull out. I was just worried that I was flogging a dead horse!  Has anybody had any real indication as to when this project will be full steam ahead?

Sorry but dont agree halegate.  I know of several people who have pulled out and are perfectly happy.  My only regret is buying there in the first place.  HUMA have been obstructive and dishonest from the start.  Just read the info on this and other sites.  It took me six months to get my payments back and then they refused to give me my deposits and interest which were legally due.  Only when I got a solicitor involved and we forced them to court did they give me my deposit but still no interest.  We now have to go to the next level of court before I get any interest.  A really reputable company with loads of integrity???? 

But everyone has to make their own choice.  I certainly dont regret mine.

what a sham,i think you should get out now,huma is sinking fast ,i have lived in spain two and a half years,there are builds that have come to a stand still years ago,and are stilll there,i am going for moneyback before huma vanish,which they will(my personal thoughts)

aldea no help at all,just sacked them,

I WOULD BE VERY SUPRISED AND DISSAPOINTED IF THIS PROJECT DOES NOT GET THE GO AHEAD  AND RESTART THIS YEAR, IN THE NEXT COUPLE OF MONTHS IS MY OPINION, THEN THOSE THAT HAVE PULLED OUT WILL BE PROVEN WRONG! ( I HOPE , BUT NO OFFENCE TO THOSE THAT HAVE)

Wrong about what?

Sorry but HUMA have no idea when they will start rebuilding.  Even when they do how long will it take to release houses and then get ecrituras cert of first habitation etc.  Also what is to stop them asking you for more money?  If you refuse thye simply break the contract and give you your money back and sell it on for the higher price.

Sorry no matter what happens will not be proven wrong about pulling out.  Suspect most that have pulled out will feel the same way.

sorry i dont agree! if in contract then huma can not ask for more money.If they do, they are in breach of contract in which case  you can in turn sue for damages! But, the question i keep asking myself, is when huma knew they couldn't build, they did not reply to any correspondance , but, now there is a glimmer of hope, they now have started to talk! I myself develop in the uk so i can see what they are up to! NO permission....! money in BANK! plans about to be passed! 20 to 30% increase in land value they dont want you to stay with it.....! also of a local interest the company that is huma was set up in the early 90's as a sister company of a developer know as Robert Hitchens, quite a large local operation (Gloucestershire area) no fools i think! But what ever the start date to rebuild, if given,i still think it will be many months if not years for any real chance of full development of this site.

PROVEN WRONG IN THERE DECISION TO PULL OUT THINKING THAT THIS PROJECT WONT HAPPEN, THAT IS WHAT I MEAN BY A WRONG DECISION, NO OFFENCE MENT BUT WE ALL MAKE DECISIONS, YOU ARE SURE THAT YOURS IS THE RIGHT ONE FOR YOU AND ALL THOSE THAT HAVE PULLED OUT OR ARE IN THE PROCESS OF DOING SO.

MINE IS TO HANG ON IN THERE HOPEING I  AND OTHERS WHO ARE STILL IN THERE HAVE MADE THE RIGHT CHOICE,BUT YOU MUST ADMIT A LOT OF PROGRESS HAS BEEN MADE THE DEVELOPMENTS FULL APPROVAL AND RESTART SEEMS VERY CLOSE

AS THE DEVELOPER I WOULD BE HAPPY TO GIVE PEOPLE THERE MONEY BACK,  PARTICULARLY AT THIS LATE STAGE HAVING HAD THE USE OF IT WITH ALL THAT IT BRINGS AND OF COURSE THE RE-SALE OF THERE PLOT  WITH THE MUCH INCREASED VALUE THAT ADDS UP TO AN EVEN GREATER PROFIT FOR HUMA!

Whereas I agree that there are probably a few people (I know of 2) that are having regrets about cancelling their contracts, I'm also sure that the vast majority, who have cancelled, are quite happy with their decision.  I'm not so sure that Huma are encouraging anyone to cancel.

 

The way I see it is that Huma would have to sell any 'returned' property for at least 17.6% more than the original price in order to achieve their original profit margin.

 

e.g.  Original selling price = 100000€, and original commission paid (15%) = 15000€.  Therefore Huma received 85000€ but repaid 100000€ - Huma are 15000€ short. 

If Huma resold the property for 117600€ and paid 17600€ commission (15%) leaving 100000€, they would end up were they were originally, i.e.  the 85000€ original selling price + the 15000€ original commission.

 

Confused???????????

If anybody on this web sight saw SELLING A PROPERTY ABROAD on chanel 4 two weeks ago the jhunta of andalucia the new caretakers of planning have 40000 developments to review that means units not country clubs or golf clubs.However 4000 will probably demolished because of fraudulent planning by the arested parties in malaga .It was said by the new planning deparments it wil probably take up to 5 years to proccess all the planning on all new developments passed previousley by the now extinct  planning department..Another member on this web sight has stated they live in spain and there are so many new builds at a stand still i have been to spain alot in the past few years it is totaly acurate .Any body waiting for the ACC go ahead will have to wait a long long time .Have a good think about what i have posted.Graham

I CAN AGREE WITH WHAT YOU ARE SAYING REGARDING PROPERTIES THAT HAVE BEEN BUILT WITH DUBIOUS PLANNING CONSENT AND OTHERS THAT ARE UNDER CONSTRUCTION , BUT DO YOU NOT FEEL THAT THE COUNTRY CLUB WAS HALTED A LONG TIME AGO WITH STEPS TAKEN TO RECTIFY THE SITUATION USING THE CORRECT CHANNELS AND IS HENCE AT THE FRONT OF WHAT COULD BECOME A VERY LONG LIST OF DEVELOPMENTS!!

ON THE OTHER SIDE OF THINGS OF COURSE IF CONSTRUCTION IS BROUGHT TO A STANDSTILL ON THE MAJORITY OF DEVELOPMENTS WHAT ABOUT THE VAST NUMBERS OF CONSTRUCTION WORKERS? WITHOUT WORK OR MONEY

CANT SEE THE SPANISH GOVERMENT STANDING FOR THAT FOR TO LONG ! CAN YOU?

OR ARE WE ABOUT TO GET A LARGE INFLUX OF SPANISH WORKERS IN THE U.K?

I DONT THINK SO, MAYBE ANOTHER DEPARTMENT TO DEAL WITH THE CRISIS !
