Hi all,
There is a design fault with the buildings on Phase 1 (possibly other phases too) - which essentially stems from the lack of guttering and drainage on the individual terrace areas. From most of the apartments in each block, if you wash down your terrace the water drains down onto the below terrace and therefore is inconvenient from everyone. At the last AGM (in my black - 53) Resortalia noted that owners should avoid washing down individual terraces until a remedy has been devised.
When I spoke to Resortalia about this, they confirmed that the building developer would not make any amendments or remedies. See the response from Resortalia below:
" In relation to this issue we are sorry to inform you that the builder developer is not going to solve anything, they say that the buildings are build according to the plans and that they don’t have to touch anything.
The solution would be installing guttering, but we haven’t been able to find a kind of guttering that doesn’t affect to much the façade of the building.
May we inform you that this aesthetic change must be done by each owner and the community has to evaluate the kind application that is going to be installed, in order to maintain the harmony of the buildings. "
Now, I am personally not convinced with this response from the developer - I believe this is a design fault and therefore according to Spanish law, this must be remedied by the developer (therefore they should assume the cost).
Also, Resortalia are now not responding to any of my emails when I'm asking for an update on what to do!
Has anyone else heard about this issue? Does anyone have any advice or suggestions?
