We are in same situation that started in 2006. We got fobbed off by our original solicitors who just played the waiting game between the builders, courts and banks. In the end we changed to GM legal experts who appear very pro-active in this type of claim against the banks using law 57/68 for recovering deposits. However, We still are in the court queue waiting for the next hearing date.
So check out GM legal experts OR Costa Luz Lawyers who also offer this type of action. Both of these firms can be located on these forums and you can ask them about the details of your individual case. As each case can be different.
I do not know if any legal team operates a no win no fee arrangement for this type of work.
There is no quick route to recovery but both of these firms have had a number of successful results in the past year or two.

Hi all , caled in at the site last week must say the building has been tidied up externally , also the area around the development is now quite nice with the promised green area at the back of the building completley finished, also just down the road a new Mercadona has been built all the roads have now been tarmaced and the pavemants finished . With all this being done cant see those in power not wanting the development completed. I have worked in building and it would be a sound investment for a developer with it just requiring fitting out .
Wonder who had paid for the work done to the building all the entry points have been sealed and the damaged window frames /shutters to the apps taken out and tidied up . One big Question remains is where do we stand in law / recompence as I cant see them leaving it unfinished in the medium term.

It beggars belief that a fellow EU member treats citizens of fellow member nations in such a disgraceful manner, one would think that Spain is some remote banana republic. After reading the contents of many threads similar to this one, I have concluded that if you don't intend to spend more than six months a year in Spain then renting is the way to go. I'm getting 2% p/a in a 40 days notice cash ISA, if this was say 3% it would fund 6 months luxury rental (not high season), I don't envisage old style rates in the future, but the current rates are hardly inspiring.
My heart bleeds for you guys, all that you wanted was to live the dream, but ended up in a nightmare situation.

Has anyone managed to get their money back yet? Our solicitors have written to urbasas solicitors to no avail and a letter sent to the address that we had for the bank in elche was returned as not there

Hi Lucy re the bank I have details at home in UK, Im in Spain at the moment but will post details when I return to UK sometime in June. The high Court in Spain has declared that all Banks are now liable for recompense for any off plan purchases which were made prior to 2008 and even tho many have now been merged since the 2008 crisis whoever took over them are now liable .In local free papers a few solicitors are now offering no win no fee for the service but personally I have done nothing yet would prefer to use our own as they will hopefully fight more for our case when thing become more clear .

just asked my good lady who informs me the original bank was Banco Pastor in Elche who are now defunked and have been taken over by Banco Popular who are the 4th largest bank in Spain, and this is in my opinion could be responsible for repayment ,still not holding out much hope but will be contacyting our solicitor in Spain
