Hello Rebekeh and everyone else. I am new to this forum and my name is Alex. I too have been struggling with my apartment in Aloha since I bought it in 2002. The information given to me by my lawyer (sometimes not very clear in their translations) since June is the following:
-the
Town Hall has requested some new urban documentation to allow the completion of
the building and subsequently granting the awaited first occupation licence. -some purchasers who initially wanted to cancell the
Private Purchase Contract have preferred to wait, given that accordingly to the
promoter the apartments should be delivered during the first six months of 2007. -the promoter´s position is not to proceed with the cancellations of the Private
Purchase Contracts already signed or the refund of the funds already paid to
the developer for the property, since finally they estimate to deliver the properties
during the next year. They have clarified us that they can not
continue with the refund of funds since the promoter needs this money to be
able to complete the works in the development. The above info was given to me during the months of JUne, July and August. There is no update. Rebekeh are you sure the licence has been granted then? In that case, that sounds quite positive. Regards Alex

Hi Rebekeh
I asked my solicitor about the situation and he had not heard anything. He asked if you has a copy of the licence from your solicitor ? If so, perhaps you could email it to me. This is great news - but after so many years of dissapointments with SHC I am a bit reluctant to get too excited just yet :-)

Yes I too haven't heard from my lawyer about the licence, but I have quickly sent an email to find out. Will keep you posted. Its great to be able to communicate with Aloha purchasers such as yourselves. Its certainly been a nightmare situation.

HI, This is very frustrating, I see that so many purchasers check this site and so few respond! Thank you for letting me know. It's very difficult when you have to rely on your lawyers. I have emailed them again and asked for some form of proof. I have even re read the email to check i haven't misread something. It says the license to continue construction has been granted and that he is trying to reach them for an estimated completion date. I will let you know as soon as they respond, they don't seem to be in a hurry as it's not nearing completion yet, they will i'm sure become more responsive when they need money! Hi Rebekeh, Today my lawyer came back with the following:
Just today the developer’s
lawyer has answered stating that they managed to refinance the debt which the company
had and the works has been took up again (for example with the air conditioning’s
company in order to finalize the installations).
They expect that the
apartments will be completed before next summer. This is very frustrating info as its the first I hear about any sort of debt they may have. I am not sure who is telling the truth anymore. I do believe that all those involved in this nightmare should form some sort of Buyers committee where we can all get together and agree to what steps to take. I am thinking that once this is all over (wishful thinking) that we can all pursue some sort of compensation. The more people involved the better. This has been done before, as seen on TV. I am convinced this needs to be reported to either the press or other media organisation. But lets take one step at a time.

hello everyone!
I am one of the owners of the flats in Aloha Hill, I went there in the summer and the road leading to the flats wasnt even touched. i spoke with one of the workers there who said building work will be begining. again.
i am in constant contact with Manuel Gonzalez, and his secretary sent me an email detailing that it should be ready the first 6 months of next year basically summer time.
I have also spoken with Francisco Navaretter, the lawyer for the construction work and we were supposed to revieve a second news letter 2 months ago which i have been chasing. the excuses they gave were that they needed to translate, which in turn i replied that i could do it as i am a proffesional spanish-english translator, to which he started to stutter. a bit suspect.
i am making plans to go out there in january to see what is going in.
In the holiday seasoni doubt very much that anything will get done on the construction site.
if anyone has extra new please get in touch.

My lawyer has emailed to let me know the development has been stopped again.
They are trying to get a proceedure number to access details at the town hall and will let me know Thursday. Again she is having great problems communicating with the promoters and the developers lawyers.
If any one is any clearer i would appreciate a reply.

I have spoken with my lawyer who believes the apartments are not going to be finished this year has anybody else managed to get any answers from the developers? I know they are in trouble again with the Town Hall but it seems they are so much closer to being finished yet we're further away from completion than last time they stopped building work!

Dear Everyone,
i have been trying to get hold of the developments lawyers for weeks now and no word. i have tried manual gonzalez too and no response from him until i recieved an email stating that he has handed in his notice on 10 or 15 th july (he coulnt remember which ) and no longer is part of the development.
A new administrator has been appointed.
I'm not sure what to think as he had so much faith in it being a good purchase now that he is gone. there must be serious issues
My personal lawyer hasnt got a glue they are a year behind with any forthcoming information.
i am in spain at the moment and plan on visiting the site and maybe meeting up with this new developer.
i will keep you posted on what the outcome is.

Hi Barry,
Didnt end up getting as far as marbella i'm afraid. However i have spoken with the new developer. he says there are issues between the shareholders but which should not have any baring on us.
Work has been stopped on the apartments due to a number of factors. One being they build more than what they should have and because the underground parking can be seen they are counting that as another floor.
The developer sounded confident that these matters can be resolve. Then again so did the last developer until he went and quit.
If anyone has any additional news, please let me know.

My lawyer has requested information from the Town Hall, just out lining the permission etc and what they are waiting for, again no good news form the administrators and my lawyer is pushing me to cancel the contract.
Has any body else heard anything or had any problems receiving money back? sorry for the negative message.

If your Lawyer push you is because the finantial situation of them is not good and you can loose your money.

Hello everybody,
I have a friend in UK wich bought a property in Aloha Club Hill and is not having the property nor the money back.
She asked me for help due I'm in Malaga, so I'm looking for information on the Internet and everywhere.
I've found this forum and seems to me very interesting to me, but I see there is no updates since year 2008, so I wonder what happened since then.
Could anybody kindly answer How is the situation about Aloha Hill Club and what happen if an owner wants to get the money back as is the case of my friend? I've heard they offer only 50% money back. Is that true?
