Hi

We are just about to purchase a 2 bed, 2 bath, penthouse duplex apt, we looked at the property and offered 40,000 euro below the asking price and to our surprise the vendor accepted it!! 

Now after reading some of the messages on this forum, Im starting to think that we havent got a bargain and the vendor has had a lucky escape!!

Im wondering if we are making a huge mistake?  When we viewed I noticed damp, which they told me was just where a bit of rain had come through!! That was obviously a lie!!  Ive asked the agent who we are buying the apt from various questions but he seems to go out of his way  not to answer them!!  I think the apt is phase 1, if you are driving from the clubhouse towards the beach it is along there on the left. 

So when was phase 1 realeased?  And how long is the building gaurantee?  As the agents said at the time of viewing that the damp was down to the vendor but now we have paid our deposit he is saying it is down to the builder!?!  Is it best for us to get a survey on the property like we do in the UK?? 

Please any good or bad points would be very much appreciated!!

Definitely get a survey and if you are getting a mortgage the bank etc may well wish this problem to be sorted. If the vendor is getting a lucky deal then they will not want to miss this and will try do keep it together. Ask for a guarantee from the builder or the vendor as to whom fixes the problem before you go any further. I would think that they will try and sort it before losing the deal. Just as a matter of interest how much are they charging you?

Thanks for that information!! As I said everything is well appreciated!  Sorry, when you ask how much are they charging do you mean to fix the problem of the damp?  To be honest im not really sure what is happening at the moment, reason being when we viewed the apt I noticed the damp and told the agent who said not to worry the vendor would sort it out.  At the beginning of the weel he is said it is down to the builder as it is under guarantee.  I have just had the agent call and I told him about this website and peoples experiences with the damp and it was a bit of a problem and we werent happy to go along wih the purchase unless the vendor got it sorted or at least started getting in contact with the builders.  He said well if we pad the vendor some more money then he would get i sorted out!?   But why would we want to do that if its undeer guarantee!?  In my eyes the vendor should be taking a lot less for the apartment!!

What is supposed to be included in the maintenace charges???

I believe the properties have a 10 year warranty. I have had a damp problem in my apartment (phase 2) but the developers/builders have been very prompt in hopefully fixing the problem. I suspect it's down to the current owner to get them to fix it and I don't think you should be penalised unless the problem was reflected in the asking price?

I wouldn`t give the vendor a dime until i would have a legal undertaking from either him or the developer on who is going to repair the problem. Call his bluff. I think it`s a bit cheeky of them to ask for money before fixing without a guarantee of repair by someone. Maybe this is why he was so quick to take the 40,000 less offer!!
