Since announcing on the forum that i was successful in obtaining a refund i was inundated with requests from this board and another i use, for details of the lawyer i used. I contacted my lawyer yesterday just to seek permission before i forwarded her contact details to members on the message boards. This is the reply i got along with her email address so you can decide for yourself if you wish to contact her.

I HAVE NOW HAD TO REMOVE THE LAWYERS EMAIL ADDRESS DUE TO THE NUMBER OF REQUESTS FOR HELP SHE RECEIVED.

I will be more than happy to help that other purchasers on Arenal Golf who wish to cancel their contracts with Arenal 2000, although I cannot promise we will manage to do it but can try.

We are currently involved in a few other cases, and it is most probably they have to complete at least they give a try through the Court, it happens that their bank guarantees have now expired and their contracts does not contain accurate information regarding a completion date.

Hi Samson,

Can you indicate if you made claim against the developer or under the guarantee.?

Did you have to bring proceedings?

Did you have to pay legal fees up front to your lawyer in relation to the cancellation proceedure?

How long did the cancellation proceedure take from start to finish?

Any info would be greatly appreciated.

Hi all, since putting an announcement on the forum for the contact details of the Lawyer we used to obtain a refund she has been swamped with requests for help. Idid not realize the impact it would have. In the last few days she has had to deal with Lawyers,Estate Agents and Purchasers asking for information on how she cancelled my contract.We are talking hundreds not just 10 or 20.
My contract was cancelled using the Bank Guarantee. Only people with contracts that state a completion of Dec 06 and in blocks 4 to 11 can cancel this way. If your contract says June 07 then unfortunately you will have to wait until Sept 07 until you can use the bank guarantee.If you want to cancel for any other reason like your circumstances have changed or you have changed your mind then you will have take it up with your own Lawyer and probably fight them in court.
I put the info on here as i thought i might be able to offer help to one or two people out there who were in a similar situation as ourselves. It seems this was a mistake on my behalf as i did not realize people would misinterpret that refunds were available to everyone who asked.

the letter has been sent to gerens head office in Cordoba ,as this is who we should be dealing with  and not staff at site office hope we get aresult
