hi my names mark and new to this web site we along with all of you are frustrated by san jose does any one know what is going on is the development illegal, and how do we get our deposit back, please let me know if you have any info. our property is two years late this july.2007

I'm new to this forum but not to the never ending El Pinet saga. I bought my apartment off plan in June 2003.....and I'm still waiting.  I have ventured down the legal route as it does say in the contract that you can get deposits refunded. However, having enlisted the help of a Spanish speaking lawyer in the UK and ultimately threatening court action, San Jose simply said 'go ahead'.  I was offered an alternative property but if I wanted to be on  golf course I'd've bought there in the first place.

Is there a number of people planning on joining forces and trying the route of reclaiming deposits again?  Does anyone know what happened with the elections as I believe El Pinets next move was dependant on this.

I have a casa at Buenavista (just past La Marina Camping). We have also brought off plan at Jumilla (Santa Ana Del Monte) a San Jose golf course development. Because of the delays we are thinking of asking San Jose for a transfer perhaps to Pinet!

I know you have had problems and that some houses are in the so called brown area. What is the current situation? Do you think that you may have habitation certificates soon?  I can’t believe the authorities will let this situation go on for much longer.

How can San Jose refuse you your deposit when they still have not started building?  They have breached your contract definitely so why can your solicitor not get your money back?  they are reselling some of the apartments so some must have been refunded.
