"Last month, on August 16th, Marbella Town Hall Planning Dept. rejected the developer's application for a Licence of First Occupation through Administrative Silence for Los Lagos, Santa Maria Golf......on two grounds.
One of the reasons stated is that the building licence for Los Lagos was based on an illegal plan for the area (one of the corrupt Mayor Gil's own plans).
The building licence was not in accordance with the Junta's 1986 PGOU plan - which allowed only the building of townhouses or individual houses. Not 340 apartments!
Therefore application for LFO rejected, and the building licence is now waiting for a judicial review.
If you are being pressed to complete on this development - or threatened to complete or you'll lose 50% as in some cases I know - tell them to 'take a hike'. "
Note that the 'judicial review' could take a very long time

My lawyer said its a possibility because of the amount of claims going before the courts .I spoke to another lawyer today who sujested a web site FORUM.....loads of info on los lagos and the lawyers involved ...Well worth a visit..Send a pm to me if you would like it.

Hi Ela, I think I know what forum you are talking about. Very informative and lots of sound advice. I would like to complete at Los Lagos, but will not do it until we have electricity and water supplied by private contracts from the official suppliers. In the long run, in my opinion, I don´t think there will be any major problems with the licence since it is not built in a green zone.

are any LFO being issued for los lagos.If not is it safe to complete without this.I jave heard that Banks are not issueing any mortgages on Los Lagos at the moment.Is this true, the developer says no need to have LFO and wants us to take over their mortgage.Cant really get that much out of lawyers except that there was a recent court case that indicated that no need for LFO since completion can take place on this silence of administration.any thoughts and guidance on these issues.Is there an issue on the legality of Los Lagos.Be gratreful for any information.

As I understand the electricity and water boards will not connect you with a private contract unless a LFO is in place. Meanwhile the developer will supply water and electricity. If he, for any reason can´t pay his bills or go bust, the supplies will be cut off and everybody will be left without.The LFO has been revoked so the licence under administrative silence does not apply and the building licence is under investigation. The licence was issued to build villas and town houses, not masses of apartments. I want to complete but will not do so until the licence is issued. It is a complicated sitiuation and if you don´t get any sense or support from your solicitor you should get another.There is an article in this weeks "sur in english" that you might find interesting. www.surinenglish.com

My name is Jose Ramon , I am a Lawyer who is defending several clients who want to obtain their deposits back plus compensation.
The situation of the development is perfectly known, very serious, the town hall denied the habitation lisence and consider illegal the building lisence.
Lawyers are asking for embargos, I obtained one the other day and if you do not went to the Court you can have a surprise because a judge can put one or more embargos in your property.
