Hi,

Buying a 2 bed villa here at the El Balcon de Moratalla development, near Caravaca, Murcia. Looks fab. Anybody else buying from the UK?

Going out to look in January.  We have different start date from 2 promotors - whar have you been told?

Hello Liz,

I have also sent you a PM - please respond.

We are next out in Feb. We have been told the show villa will be finished by Easter and the build time is late 2009 onwards (depends on your plot)

The prices are great, we purchased a 3 bed villa  through Town and Country Central, how about you?

Hi All

We're going out in Feb to find out more about this.  Want a 3 bed bungalow/apartment.  First foray into the foreign market and everyone says 'don't do it you'll get ripped off.'  Can anyone with experience give me few pointers?  I'm hoping that a decent solicitor is the order of the day and the estate agent has said cam bank are giving a certificate of guarantee to protect my investment.  Anyone know anything about this?

Yes, our solicitor confirms there are now bank guarantees, our agent (Town and Country Central) also confirmed this to be the case. Will send you a PM with more details.

going out in March to have a look at site. Seems too good to be true. Have 'reserved' 2 bed bungalow and trying to find out everything we can about the process of buying .Head is spinning do you get a solicitor in uk or spain before you go or sign anything or part with any money?

 Hello, you will be impressed when you see the site/area - even more so for the current launch prices!

We used a Spanish solicitor - don’t want to be seen as “advertising” in case it gets blocked on the forum, so will send you a PM with details etc. You normal pay a reservation fee, subject to contract.

Hi

I'm due to go out next week, again being from a spanish back-ground not looking for a beach resort.

Can anyone suggest any good solicitors before Monday?

Also provide a little feedback on the guarantees the builder has provided on facilities etc.

 Hi,

Yes, I would go via Fusters (www. http://www.fuster-associates.com/), best if they explain about the bank guarantees if you don’t mind, hope you understand?
My agent (www.townandcountrycentral.co.uk) in the UK informs me a new increased pricing structure is due to be launched after March. If you are based in the UK, you really should go via a UK agent, mine has been of great help and support inc. explaining about bank guarantees etc – and there is no difference in the price of the property. I hope this helps?

Yes, i'm with the same agent, they seem very professional and also very helpful. Will be going out on Monday so will keep the forum posted on progress and information.

I will also try and take a few photos and post them on here if possible.

Hi All

I'm slightly getting concerned regarding which way to go on the solicitors.

Has anyone lse gone the independant route rather than using Fusters, it does worry me slightly that all the agents are recommending Fusters as the solicitors to use.

Also did anyone leave a samll holding amunt until you transfered the deposit to your solicitors?

Going out on Monday and want to be ahead of the game to ensure I do not get pressured to use people I am not fully comfortable with.

Thanks to the advise so far, this forum is great.

I hope this reaches you in time - before you leave for Sunny Spain today?

The reason I am told why most people use Fusters my agent says is "Our office in Spain and Fusters have been working with the developer (they are one of El Balcons best agents) to come up with a scheme that will give everyone CAM Bank guarantees for all monies paid and for the next payments right up until completion.  Bank guarantees protect your money".

 Hi, it gets better! Just had this from my agent re payment terms: “New payments terms, a reservation deposit of just 6,000E and then no more payments until the final license is granted in 8 to 12 months time. When the license is granted the next stage payment will then be payable, balance on completion.”

It appears they have been working with their solicitors and the developer to offer the above and even better all payments are bank guaranteed.  I hope this helps you?

Hi All

I have returned from my trip, and yes you were all right the views are amazing!

Update so far, they are planning on having a few show houses up by end of this summer, also they are looking at putting a webcam up so that we are able to view how the development is going.

A bit of bad news for me was that all Phase 1, 3 bed apartments have been sold and there was only 3 left on the few that the builder has released on Phase 2 which by the way will not be completed till 2012.

Fusters are purely working on behalf of the clients only, but as they have quite a few they are constantly on top of the builders lawyers to ensure all guarantees are in place and contracts are correct.

The hotel will only have 40 rooms, which is great and keeps it rural and small. The builder seems to think that he can sell some of the 3 bed apartments later on in the development for 175,000 euros which means we could all make a nice little profit.

I have taken some pictures that I will try and download.

I have just received this Email from Mark at the promoters who are working for the developer in Moratalla. It is not good news and you are advised not to proceed with your purchase see below.

I want to confirm the outcome of a meeting I had with the developer earlier today.

 I was asked to attend a meeting this morning to be told that the terms of the current properties reserved had changed and that he was no longer prepared to honour the prices or terms previously agreed.

 The ´new´ deal is as follows and will be confirmed by the developer when you contact them.

 The pre release prices are now only valid with a guarantee from a non Bank of Spain recognized insurance company called Huggies Royal.

 The next payment would now be due within 30 days, payable directly into the developers bank account  before the granting of the final license. The developer would then have total access to the money with no restrictions on  usage instead of the money being in a protected account as previously agreed.

 The only protection being from the above mentioned insurance company which having made initial enquiries ourselves we do not believe would be acceptable to clients, agents or solicitors.

 If the client wanted a bank guarantee they would have to pay an extra 40,000 Euros for the property. When I asked how this guarantee would be provided I was told not to worry about it.

 I stated that this was unacceptable and that from today we would no longer work with the company in either the sales of the properties or the completion of the site pools and gardens which we had been contracted to complete.

 As a result we have removed the English version of the website as well as the telephone line and we will no longer be involved in any aspect of this development.

 Clients who have paid deposits to solicitors should, we think, request the return of the funds and buy elsewhere and clients who have paid monies directly to the developers bank account should also request the return of the money directly from the developer. I have been told there is no problem with the return of the monies in full should the client not wish to progress with the purchase.

 As a side issue we are owed a considerable sum of monies from the developer for works undertaken on site and it would seem we will have to take legal action to recover the sum outstanding.

 Obviously each client has to determine if  they wish to continue with the purchase on the ´new´ terms but personally I can only advise against this as I believe the potential for problems in the future is far greater than if a recognized bank were providing the guarantee for clients money.

 Over 30 properties had been reserved with deposits committed however the developer seems unconcerned at the loss of over 3 million Euros worth of revenue.

 I  can only apologize for this issue but it is completely out of my control and I had no indication from the developer until this morning of the changes highlighted above. I believe the terms stated above are completely unacceptable and unsafe for clients and do not wish to be associated with the developers current or future actions.

Thanks for this, I have got straight onto my agent and will forward the email direct to the solicitors.

I can't believe this, it's probably because they are planning on releasing the next batch at 130,000 euros so they obviously think we will all pay the extra.

So will you be pulling out?

If that's the case we might consider pulling out too and just looking for something else, the only thing was the price was brilliant and there's not alot around at the moment close to that.

Anyone know whay happened to "Mark the swimming pool guy" from Imgae SL who was working on the site? I have tried to contact him without success, is his company still running or has it gone bust?
