We spoke to Aifos last week and have been given a new date of three months time for completion!!! We are purchasing in block Aguamarina. Does anyone else have any information on what is happening?

Have you had the completion date yet from Aifos? What is happening now. I have had a couple of people contacting me for advice. I am so glad we got out of it thats all I can say

The day we see Aifos actually complete on any properties and actually hand them over to owners
will be one of total astonishment to me. That said I actually do get the feeling this could
actually happen within the next 3 months or so,
We actually have a reservation on this Development in Los Conchas the only block not
to be built. I get the feeling I'll be dead before that';s ever built, Its 4 years May04 since
we reserved,
it's a shame as the postion of this Devleopment is lovely hence why we chose. I really cannot understand
and never will why Aifos did not just get on with it and get Developments finished and handed over to
Owners. By their own actions they have totally destroyed their own brand name. would anyone in their
right mind ever now buy(Ha Ha better phrase give Aifos money for nothing) any Afios property ?
Its quite staggering how they are not bankrupt yet. It will be amazing if they are not by the end of this year.
If thet had behaved in reasonable manner We would have probably have bought other properities. as it
is we will never spend another penny on a property in spain ever again.

I doubt that Hacienda Marina will ever be completed and handed over to you all. Aifos does not have building permission for some of the blocks and they cannot get completion certificates for those that may be completed. The spanish authorities and town halls know Aifos inside and out and are not giving any permission or granting completion for their properties in the Costa del Sol anyway. All due to the corruption scandal and the fact that they have taken people's money just to invest on half done developments in order to get more unsuspecting buyers. A VICIOUS CIRCLE. They are still operating but yes one day they will either go bankrupt or be closed down by the Spanish government. Unfortunately this does not help you all as your money will all be floating on half built properties. My advice is go to the best lawyer you can and get out just as we did. It took us three years to be told that our property did not even have an application licence yet they took thousands from us, then when we told them what we knew they tried to offer us other properties (only for us to find out they had completion problems and were not being granted occupational licence for the property they tried to offer us. It took us 8 months living out there in our holiday home to find a good lawyer who got our money back for us all within 21 days of our intial visit to the lawyer. However, everyones circumstances may be diferent so If not possible to do this then if you have paid a great deal of installment money, take them to court for Breach of Contract as Hacienda Marina entirity was supposed to be completed two years ago. It may take a few thousand but the cost of approx 7000 euros to gain back 90,000 euros is well worth it. Good Luck to you all Brown

We have been to do the snagging of our apartment in Aguamarina block and were told that our apartment is worse than most! Lovely.
We have uploaded photo's or Aguamarina and the snunning views of the water tank. Aifos said that that we would need to battle with the council if we wanted trees planted in the rubble area between the pavement and the fencing to hide the ugly tank. We were told when we bought many years ago that the tank would be grassed and trees planted but don't have anytthing in writing, does anyone else had anything from Aifos about this?
The common areas are very poorly finished and in need of repair and painting generally and the landscaping is a joke. We were told that we should complain to Aifos . If a number of us complain together we might just carry more weight. Doubtful they will care, I know, but worth a try. If anyone else buying in the three blocks which they say are completed want to get a complain together please private message me and I will get in touch with you.
We have received a letter from Aifos this weekend saying our apartment is now available for completion and that we now have 15 days to complete. Has anyone now received this despite there being no first habitacion licence?
Could a new nightmare be beginning?

AIFOS HAVE GOT THE OCCUPATION LICENCE FOR THIS COMPLEX........SO WE CAN COMPLETE AND MOVE IN!! THIS HAPPENED YESTERDAY!
WE HAVE TO MOVE FAST AND SIGN ALL THE PAPERS BEFORE AIFOS GOES INTO BANKCRUPCY...

the whole complex of 102 apartments have obtained the licence, i can send you the copy of the licence, this has happened because banesto has paid a bank guarantee with the town hall of benalmadena...i

That is good news to hear. So is it Corales, Caracola and Aquamarina all three combined blocks at the top? It can not be Rebalaje or Las Conchas as it was never started. So if itis the three or part of the three it is excellent news for those who have bought in there and yes go to your lawyer immediately to see what is happening. Good Luck. to you all.

Recieved a phone call from Aifos three nights ago whilst in the UK informing me to go on the 29th December to sign papers as they have habitation license,I might point out that this is the first time I have ever heard from Aifos since 2003,I told them they were having a laugh,that they were in court being sued by ourselves,and to get in touch with my lawyer not me.
May I remind you all that we bought this property when our grand daughter was three years pld,told it would be ready intime for her fith birthday,SHE TURNED TEN YEARS OLD IN OCTOBER.
From what I can gather there will just be the three blocks up there and NOT the whole urbanisation we were promised so its going to be a long haul up and down to the shops,fine if you have a car.
Good Luck to you all who have decided to take the loan from Banasto.

AIFOS IS IN BANKCRUPCY AND THOSE WHO ARE IN COURT NOW , THEY WONT BE ABLE TO FIND ANY FREE ASSET OF AIFOS IN ORDER TO RECOVER THE AMOUNTS, SO YOU WILL WIN THE CASE BUT YOU WONT RECOVER THE AMOUNTS PAID TO AIFOS, THIS IS THE END OF AIFOS.......THERE WONT BY ANY ALTERNATIVE IN THE FUTURE, .....THIS IS SERIOUS NOW.......

In any case it is a matter of time, I do not think honestly they are going to survive any longer in 2009 as they have debts with all the banks and public institutions. I am a Lawyer and my client is buying in Caracola, the apartment is over and the license is in place.

Any progress on this Leslely ? Could I hazard a guess that you are wasting your time with the Spanish (In)justiice system ? We have "won" our case against Aifos. They agreed to repay us and the court told them to do so by the end of March. As totally expected we have got nothing back as yet.So we are having to waste the next 18months or so going thru the (in)ustice system trying to get the embargoed property auctioned off. There is some remote possibility we may eventually get something back but I would be amazed if we ever get a penny back.Thank you Aifos for killing any prospect we ever had of a home in the sun.John

We, that is our lawyers have been in court several times on our behalf,and as yo should know by the email I forwarded to you that Aifos tried to sue us for not paying the last payment,but they came a cropper I think because we cancelled about two years before the habitation licence was granted and Luis has proof of this,Aifos were trying to say that we refused to move in due to the drop in property prices which is a load of bull shit,we had to pay our lawyers another 2000e to counter act their action and give us right to reply.
We are now in court number 12 in February of next year so God help us we really need to win but we really need to get repayments back asap.
Im so sorry for your perdiciment I know what a fight we have all had over the years and its not fair,we are now living on a mobile home parque in Alameda just outside of Antequer which is still in the province of Malaga,its a beautiful place a bit isolated but hey ho,the yearly rental of our ground is cheap internet and tv telephone is also un costly,When did you find out that you had won and had to go to auction,It seems Aifos dont like repaying thier dues.
