We live right by the new J de M and it seem's to be coming on OK but I cant see them being finished for a few month's yet, theres lots of activity going on and they have now dug up another ditch around the complex.

Have just been in touch with the bosses in Marbella and they are know saying they are enforcing a force majeure ,,,,,,,,,in accordance to the contract!..which means it could take another 5 months to complete...........What a Joke!!

Also waiting for news, the last our lawyer said was she was told the end of April, given the accuracy thus far, i highly doubt it...... am awaiting a reply from Rushcliffe on when they are anticipating completion, haven't heard of the "force Majeur" bit, but it wouldn't surprise me!

Given the economic situation in Spain, the exchange rate tanking just now and the known legal problems with the devevlopment, nothing would surprise me anymore!!

Nice to hear from other people who are purchasing there,........well eventually!

I got this reply today from the contact at the Moraira office

When we have started the official 'fin de obra' (end of works) process on the 30th April I will be in a position to try and give you a more accurate date for completing.

Sounds just like the same old havent got a clue really!!!,,,,,I think the June or July estimation sounds more realistic.

The fact that there still working on the development is the only sign that they will be finished " One Day "??

Havent spoke to my lawyers in Calpe about this matter, but spoke to Maria del castro  ( who helps and advises a lot of people on this web-site ).. regarding the Force majeure,,and she told me it was totally illegal what they are doing. and the delays they are enforcing,,,,but it seems more trouble to go to court to force compensation. As all I want to do is complete and start enjoying my investment.

LOL,  I know what you mean, just want it to be completed and get on with it as well!!

My lawyers aren't saying much, when they do respond they do seem to just say they will advise when the developers get in touch, so not exactly full of hope with them!

Oh well, lets wait and see what happens in the next few months then...

Dear all,

I have been watching the exchange of emails on the is topic and can comment as below,

• The complex should have been completed in September 2007.  Under the contract the developer had the legal right to extend the completion date by 6 months meaning completion should have been by March 2008. The developer are no in breach of the contractual terms and no extra period of grace is allowed.
• We are no taking legal action to recover money owed as Rushcliffe are in breach of the contract.
• I understad that  other purchasers are taking simular actions.

Thanks Diverwine for the update, all information is welcomed here I suspect!

I know they are now over the 6 months grace period, I guess I just expected they would be late what with it being a Spanish build!

Feel free not to answer but can I ask, are you taking legal action because you don't want to complete, so to get a refund of your deposit or to get some compensation for the delay before you complete? With the Euro exchange rate being challenging and the known legal problems with the development, it is interesting to understand the motivations

We have also bought an apartment in Jardines de Montemar and were planning to holiday there this summer but as we are not able to get a completion date this is looking doubtful. We are going over to Benissa for a few days soon so will be interested to see the site progress. We will keep you posted. Has anyone looked at  buying furniture packages through Inside Right, If so, what do you think?

Welcome aboard raging bull!! Fantastic to have another buyer on bord.  As Breki says would be great to hear anything from a buyer who has been on the ground.  I was hoping to go in August to stay, still keeping fingers crossed though!! will probably go over anyway even if its not ready to have a look.

Regarding furniture, although i haven't ordered, have almost picked a package, customised from the company below, they have been very efficient at responding and i am likely to order soon, but wating to see if anything comes from the end of april, starting the handover process quote from rushcliffe.......
