the trees overhang from what is now an empty property (Finca in large grounds) we don't know who actually has the property now, we think it has been re-possesed.

I have a similar problem. The Civil Code provides that large trees must be at least 2 metres from the boundary, and smaller ones 1 metre. My understanding is that, as in England, you can cut them back to the boundary or require the owner to do so. Theoretically you could get a Court Order enforcing these provisions but self-help is probably cheaper (and more effective).
