marbella LFO

As usual there seems to be no news about the town hall issuing license's to all the illegal builds that have now been declared legal by the PGOU. I did read that there is a time limit till May for developers to agree compensation with the Town Hall. Has anyone got any news or know where to look.?

the time limit was published in the sur inenglish and some friends enquired at the town hall about our development, our developer is dragging his feet as usual and they where told then that after May the council would start court proceedings against developers that don't comply. Its the usual round in circles attitude the lawyers must do well in Spain!!!!

Jamesyvonne - the link has been removed from the Sur. Your developer is one of the 95 accused in the Malaya case which is currently underway. He's already facing a prison sentence. There are many who have 'won' cases against him (refusing to complete on his illegal properties), the Judges have ruled that he repay the money he owes to these legitimate claimants, but he blatantly refuses. No doubt Marbella Town Hall wants to get their hands on the money he owes them before anyone else is paid out. It's a disgraceful mess.

It's been reported that the Malaya Case is due to run for at least another year. We'll all be shuffling around with our Zimmer frames by the time this is sorted - that's if we're not six foot under! And during this time of course the developers continue to be allowed to appeal the cases brought to court by off-plan 'purchasers' who have 'won' against him.
Do you happen to know if Penarroya is now paying, as he should be, the community fees for his unsold units? The last time I heard, he was not. Good luck to you too Jamesyvonne.
