In line with current regulations our community installed gates around our swimming pool.  At some point later it was decided and agreed at the AGM to lock the gates to prevent people using the pool after 8pm, particularly to avoid drunk people deciding to go for a swim on the way home from a drunken night out.  A few people complained about the locked gates as it meant they had to use a slightly longer route to access their apartments.  Our lawyer verbally advised that is was illegal to lock the gates the swimming pool as it restricted 'right of access'.  Can you advise if this advice is correct and if so which part of Spanish Law would cover this issue.

I can't see why your lawyer woudl say it is illegal to lock a swimming pool

opening times of community swimming pools are decided by the community and many pools close at evening for safety etc.

Our swimming pool is locked outside agreed hours approved at an AGM of the communidad Some owners don't like it but that is what was agreed at the meeting by a majority vote

Thanks for the replies.

I am going to try to find out which Spanish law covers this and ask if anyone contacted our insurers to check it out. Our president just wants to make sure everything is done by the book and following the lawyer's advice removed the locks.  

Needless to say some eejits use the pool on a semi regular basis and normally after a drunken night out.

camposol peeing in the pool is more common than you think drunk or sober and a myth regarding the cloudy blue or red often quoted - just a ploy to scare kids

I think rebecca adlington once admitted to it whilst she was training

"Our president just wants to make sure everything is done by the book" ....a sensible objective, but it Spain it's an extremely large book and open to a wide range of interpretations.  Under the HPL decisions made at an AGM are deemed highly important and your President is obliged to follow these.

Not sure it was at all wise to seek legal advice, this is just one lawyers opinion which no doubt was purely verbal.  If someone drowns you may find that his advice was less emphatic than you thought.

If the decision to lock the gates is challenged, those who wish to do so should take the matter to the local court whose decision is of course of far greater value.

Mmmm...just thought to myself that you guys always manage to lower the level of any discussion.

But in fairness, on this occasion, I suppose you could argue you are talking about increasing the level.
