G'day folks,
I just want to say hi as I am new to this forum.
I know this is similar to other posts on here but I want to know what, or if there is anything I can do about this hell that has happened to me. I have my doubts.
HURRAY. I passed contracts for an apartment at Gran Mirador 4, Rio Park in September 2006.
BOO. It is now May 2009, 31 months after signing it and the apartment still requires substantial work for it to be completed.
BOO. I have lost the chance I had of a loan because they have taken so long to build it. What a problem that was, losing months of sleep and getting my mate involved so that I could secure the mortgage etc.
HURRAY. I had resigned myself to the fact that I had lost my deposit through no fault of my own, when I checked my contract out again recently. It says that if the developers (San Juan Urbana) don’t complete within 24 months, I can ask for my deposit back.
HURRAY, I thought. I asked my Spanish lawyer to start the process of getting my deposit back.
BOO, my lawyers can’t get in touch with San Juan Urbana for love nor money. They have removed their website from the internet.
HURRAY, I thought. The deposit is guaranteed with a major Spanish bank so surely, I can get my deposit back. I informed my lawyer.
BOO. My lawyer comes back to me with the fact that although San Juan Urbana said that they would agree to the bank guarantee, they never actually did it. ****** bad expletive.
HURRAY. My lawyer said that I have a good chance of reclaiming my deposit if I took San Juan Urbana to court.
BOO. Euro 4000. Can’t afford this although I would get it back IF I won the case. IF. Too risky.
That maybe the end, I can’t take it any further, BUT I will put my house on it, (no pun intended), that San Juan Urbana will come back to me when it finally is completed and ask me to pay up, or take me to court.
I just wonder if I can do something about the agents that sold me on the apartment. I have always been cautious so I wouldn’t have gone through with the deal if I had known that the bank guarantee wasn’t in place.
This is what it said in the agents brochure :-
“Is my exchange deposit secure?”
“Yes. Bank guarantees are in place with one of Spain’s largest high street banks. This means that in the unlikely event that the developer goes bankrupt, you will receive your deposit back with interest or another developer will complete the project to the original specifications.”
Well the bank guarantees weren’t in place. I feel lied to, and cheated but what can I do? I am a small player with no money because those ******* have it.
Is there anyone else on here that is having problems with Gran Mirador 4, Rio Park and the developers, San Juan Urbana?
I would welcome any comments.
I am tempted to start up an action group against these developers who give the Spanish a bad name.
