For someone not bothered you have done a heck of a lot of research, made more postings than most and posted longer replies than most..  Seems to me like it bothers you a great deal.

Non smokers have an absolute right to clean fresh unpolluted air.  Smokers have no rights to ruin the healtgh of others. There can be no question of that.

Cars do not come into the equasion, as they are now a very neccessary evil, (how would you get your ciggys delivered without the combustion engine?) but at least research is being done to improve emissions, or eliminate them alltogether.  If this were done with ciggarettes, so they had no harmfull effects and no smell, people could smoke anywhere, anyplace, anytime.

At this moment in time my family is going through the agony of watching a bright and beautifull family member, 45 and mother of  young twins slowly dying from throat cancer.  She has never smoked in her life, but was raised in a smokers home, and went on to work in a smoky environment.  She, her children and her husband are paying the ultimate price for the selfishness of others.  If ths law fails it will be a tragedy.  I once saw a news item on TV where infant school children had swabs taken They were able to detect those that came from homes where the parents smoked. Some of   these children had a nicotine level in their saliva equal to having smoked 5 cigarrettes a day.

I live in southern Spain, and according to national statistics 29% of the adult population are smokers which represents a MINORITY  it seems more now because they are all congregating together - outside.

2 walls means 2 walls, it does not mean one either side of the restaurant or bar frontage, that would equal 3.  Canvas awning are walls by any interpretation as they restrict the flow of air.

If in any doubt I suggest asking for the 'libres de reclamation'  there will then be a clear ruling. Calling the police is inefective as they don't really know either and will decide according to how well they know the bar owner.  The aim of the law is to protect the health of everyone who choses not to smoke., which is the majority.   I note that the Malaga restauranter who challenged the law is now facing a €10,000.00 fine, and each of the smokers involved are to be fined €30.00.  this happened in the UK too and resulted in a landlord going to prison.  End of protest.  The law must be seen to have teeth. 

As for infringment of liberties for smokers,  There are many thing we would all like to do that the law prevents us from doing - for the greater good.  It is called civilisation.

Don't know what age you are, but pensioners get a 50% discount and a half day pass is also available.  A full days ski-ing is very tiring for older people so this is a super deal.  By the time I have driven from Malaga and had a bite to eat it is time for the afternoon session - just right.

There's an election next year.  I am very confident that a PSOE victory will lead to a further anti-smoking law that allows non-smokers to enjoy smoke-free air while sitting and drinking or eating outside their favourite bar or restaurant.  

You are an optimist Jek, this has not happened in the UK, and pub gardens have now become the exclusive domain of the smoker, with a few rare exceptions where no smoking areas are provided.  One day maybe, but not anytime soon I fear.
