Not since July 2008.
The development was partially built when we visited but no sign of work being donce while we were there (may be a builder's holiday)

A contact of mine was up at Alora a couple of days ago. He says that no work is taking place on that development. According to the security guards at the site, the builders have left. I don't know the reason, but builders usually leave when they stop getting paid. He said the development is supposed to be delivered by the end of June 2009, which looks very unlikely now. As I understand it, the bank guarantees cannot be executed until 6 months after that date (the end of December 2009). It looks like investors might have to wait until the beginning of 2010 to claim their money back if work has stopped.
It may be time to contact your lawyers or the developer directly to find out what is going on. If anyone hears anything, post a reply here.

We visit the site on Friday 28th Nov 08. It had progressed a little bit since July but did not see any one working while we were there or any security guards.
We are trying to find out whether the building is still being worked on.

Latest I have heard is that they have had problems with their builders. I understand they have replaced them, but even if they start work again (which I am not sure if they have or are intending to), the development is likely to take over 12 months to complete given the current state of progress. I am trying to get more information.

I have just spoken with the promoter responsible for Casa Toro, Comercializacion y Gestion Inmobiliaria (www.malagahouse.com).
The person I spoke to told me that they stopped work for 1.5-2 months in November / December as they were forced to replace one of their sub-contractors who was experiencing financial difficulties. As a result of the sub-contractor's financial problems, they were struggling to pay their builders and so demanded that CGI paid them upfront rather than in arrears. CGI refused and found a replacement sub-contractor. This took time and required clearance from the mortgage bank, Cajamar.
The person I spoke to assured me that the development would be completed on time, i.e. by May / June 2009. My contact on the ground, who visited the site back in December and has several years of experience of selling off-plan developments, says there is no way that they can hit that deadline.

I have received an email today from Andalucian Dream Homes,the agent who sold to me.They confirm that work has stopped and they cannot get a reply from the developer,but they will keep trying.Has anyone any further news ?

I had an email from LOS yesterday.
They have spoken to the developer and have been told that works will finish by October this year and they expect to get the first habitation permit before the end of the year.

On June 19th when I came back to England work was very much in progress, and had been for a week. They will have to move pretty fast to have it completed by October though.

Does anyone one know the law regarding lack of completion by specified date. Does one ever get a right of retraction from purchase and if so what happensto deposit?

No We have not heard anything.
Do you know whether the developer is still working on the development as we have not had any correspondence back from them at all.

Hi Nigel,
We too have an apartment at Casa Tora, again no details, this should have been finished in March 2009, our Lawyer says the builder is allowed 6 months grace until the end of 2009 31/12/2009.
Spanish lawyers hate having to get off there backsides, ours has never been to Alora, he says he is updated by the builder who says they are on track, a likely story.
As far as I am concerned I want our money back, and so should everyone else ask for there's back.
This would not happen in the UK or would it!!

We visited the Alora site at the end of October. Some work was being done but there is still a lot to do.

Thanks for the photos Nigel.
It would be good to hear views of others regarding this development.
Due to finances we need to find an alternative to completion and would welcome any suggestions from anyone.

New to this site.
Bought off plan at casa toro in early 2007 and watched it all go horribly wrong in the market. Feeling really hard done by at the mo and not sure what to do.
Had a mail from Lawyers of spain who reckon it is nearing completion in the next few weeks (but I have heard that before). Not seen any pictorial evidence and frankly do not feel Ihave been kept in the loop sufficiently by Lawyers (have never heard from Andalucian Dream Homes the initial estate agents not a good show by them).
My initial payment schedule showed completion at the 1st or 3rd quarter of 2009 obviously beyond that now lawyers feel the developer gets at least 6 month grace before deemed in breach of contract, however this is all info gained second hand from Lawyers of Spain and I cant be sure they will have my best interests at heart.
Anyway happy to get any advice from folk in similar position with better experience than my self. I would love to get some of my deposit back as I feel I have been duped, but I hope I cant be forced to complete as that will break me.
Anyway thanks for listening any advice would be gratefully appreciated

We brought off plan in 2007 for an apartment on the casa toro development.Have followed the progress?!! -and wondered just what is going on.Have had no reply from the developer ever, supposed to meet them in 2009-February we went to Marbella and the Lawyersofspain office and when we got there told they were not coming-shock i don`t think so-but Lawyersofspain sent us e-mail beforehand saying they would definitely be attending the meeting?.
Have had little or no contact from the Lawyersofspain since little help and advice either after all they are supposed to be representing us.Also Andulucian Dream Homes have had no contact whatsoever so poor show there.So overall little or no communication whatsoever.We have asked a few people and the reply we get -you pays your money you take your chance-well yeah but not for incompetence and no advice or input?.
Looks like the next step is to try and get the deposit back through the` builders guarantee scheme`-could be fun but it`s there for exactly this outcome,now to see if it is worth the paper it is written on?.
What to do next ,anybody else have any ideas or advice please get in touch.
