To sell or not to sell my property ?????

I am seeking advice from anyone regarding whether to sell or not to sell my property. I really want some facts and figures in order to make that decision.

Has anyone sold their property recently?

I really am urgently needing to find out what exactly the costs are likely to be in order to sell my property in Spain.  I have emailed various solicitors who for some reason or other do not seem to want to give me a direct answer.  I would be pleased to hear from anyone who can tell me of their recent experience of selling in Spain.

It is not necessary to have a solicitor to sell your property in Spain all the work is not by the buyers solicitor unless you have a mortgage to clear. You would have to use the services of a Gestoria to pay taxes etc. If you do insist on using a solicitor instead, a fee of around 300e should be sufficient for a straight forward sale.

Thanks Karen - I do have a mortgage to clear so I think I need to use a solicitor.

I do not think you need a solicitor, even considering you have a mortgage, you need to contact the bank because without them you cannot sell. It means for you to sign out the official deeds to another person, the bank need to receive whatever is left in the mortgage, plus the cancellation fee the seller will pay normally to cancel the mortgage.
The most important thing that you need to ask a solicitor if you are a non resident is if you have to pay the same taxes as a resident. As a resident, we in Spain, have to pay a tax when selling a property. If for example I bought a house for 100.000 (this is in the oficial deeds) and are selling now for 150.000 (also recorded in the new deeds) the seller has to pay 20% taxes to Hacienda on the benefit generated, i.e. 50.000 euros benefit will be tax at a 20% for hacienda. If the seller has no profit, then there is no tax on it.

Thanks Maria - I thought that I would be able to settle the remainder of the mortgage from the proceeds of the sale. I will have to make contact with the bank then to see if I am able to sell -before I do anything else.

Good luck with your sale. maria's comments seem wise. her blogs on this site are thoughtful and well thought out. If you decide to use a solicitor she would seem to be a good choice if she will deal in your area of Spain
