As we know Cleyton GES announced the end of 'Finca Parcs' as their project on 21 September 2009 when the Refunds Process was launched.
The Finca Parcs website has not been updated since February 2009. In fact for the past 4 or 5 years it had promised things such as legally required CAM Bank Guarantees for every purchaser, which as we know, despite being a legal requirement, were not issued to at least 100 Finca Parcs purchasers.
In addition since 2006 the Finca Parcs website claimed that Cleyton GES had a land portfolio of 2400 dwellings. We tried for around 18 months to visit some of these 2400 dwellings to talk to some Cleyton GES clients and see for ourselves the quality of construction that Cleyton GES had in its 'portfolio'. THE TRUTH IS WE FOUND NONE - and more importantly Cleyton GES could not tell us where any of the 2400 dwellings were.
Instead with no help from Cleyton GES we tracked down some houses and small urbanisations built by Finca Expert SL. To say we were 'shocked' with what we saw is an understatement. A number of postings were written over the past few years on this forum regarding the history of Cleyton GES SL and Finca Expert SL. Many postings were unfairly removed by Eye On Spain shortly after posting, probably at the request of Cleyton GES, who were very keen to cover up their previous 'work' under the name Finca Expert.
However many staff and management names were common in both Finca Expert SL and Cleyton GES SL.
In 2004/5, Finca Expert SL published sales flyers advertising 'their new project' at 'Las Higuericas, Finca Parcs'.
Many 'Finca Expert' purchasers from the never built Finca Expert 'San Isidro' development were transferred onto Finca Parcs.
So although the staff and management of Cleyton GES have always attempted to deny links between Finca Expert and Cleyton GES, the truth is they were/are very much linked. However, for reasons which are now obvious Cleyton GES did not want potential Finca Parcs purchasers to see their previous 'work' or to talk to owners on their Finca Expert developments.
As for the Cleyton GES land portfolio of 2400 dwellings, it seems they will be consigned to history as an 'imaginary dream', because unless someone can take me to see them, they are certainly not reality.
I would not read too much into the fact that last week the Finca Parcs website was removed.
The biggest issue now is that in the official statement issued on 21 September 2009 Cleyton GES stated:
"For those clients that are still awaiting the issue of their respective Bank Guarantee a bank instrument will be issued with a maturity date twelve months from the date of issue, this will include the sum of 6% interest from the date of reservation until the date of maturity."
And on 24 September 2009 Cleyton GES stated:
"PROVISION WILL BE MADE FOR ALL CLIENTS WITHOUT BANK GUARANTEES TO RECEIVE A FULL REFUND."
So here we are on 13 December 2009 and not only do we not have a refund, but despite complying almost immediately with the Cleyton GES requirement of forwarding copies of Sales Agreements and Bank Transfer documents to Finca Parcs Refunds, we still do not have any tangible evidence to suggest that the Refunds Process is genuine.
This is a shocking situation and it seems that despite some purchasers suffering almost 6 years of broken promises, false hopes and incorrect statements, Finca Expert / Finca Parcs / Cleyton GES seem to be reluctant to rectify the illegal situation that has occured as a direct result of their failure to comply with LEY 57/68.
