It's now probably time to start a form of collective action against OVP as the main agents for the Manilva Phase 1 and 2 projects. Will need to review the legality of the contract and seek advice accordingly, but much better to do this as a group rather than in all working in isolation so as to gain some momentum in seeing this project completed. It will be 4 years this summer since 'off-plan' selling was introduced by OVP @ Manilva and as such, there would appear to be a case of misrepresentation as the initial sales pitch was based on an 18 month lead-time, failing that, there is almost certainly a case for contract annulment as the timeframe is simply beyond what would be deemed reasonable for any delay in completion.

I read your comment with interest, as I too am waiting for my now massively overdue Manilva property to complete. However, I do not think that pursuing OVP would be a good course of action. I already have thousands tied up in this development, and have been paying through the nose on my funds that are held. Taking legal action now would delay things even further - possibly for years!! - and I just cannot afford that!! Having spoken to my lawyer in the UK I think that the best course of action for me will be to complete on the property asap and then pursue the developer for compensation. If you are in a financial position to wait for a long time for any resolution then good luck, but I'd advise anyone who is struggling to get their property first and then go for your guns!!!!

I agree with Alltoomuch.  Those who can complete need to do so to prevent further delays (as we did last week).  We can then form an action group to look at what went wrong, who shouild have prevented it going wrong and who we might have a case aainst

the advice we had from independant lawyers (whatever you do, ignore advice from agent recommended lawyers) was forget about claiming after completion, once they have your money, the agents get their commision and you have nothing apart from an apartment with no LFO which could mean years of faults, promblems and hassle, and you signed for that!  I would very much advise talking to Marea de castro, the helpful lawyer who posts on this site, or Drakan, another one who posts on SPI. It really is like being between a rock and a hard place, but please don't throw more good money at these developments before all the correct paperwork is in place. If anyone advises you to complete in a rush or without everthing in place, i would smell a rat and check it out with the above mentioned.

The LFO has been issued for Manilva Beach (at least for Blocks 7 & 8) and our independent spanish solicitor recommended by a friend who has purchased in Spain before has signed on our behalf through Power of Atorney.  I would always recommend caution and of course seek legal advice but whilst we are all fed up with the way this development has been handled let's not panic and become doom laden.  Has anyone actually seen the inside of the apartments and do they appear to match the specification given on the contract?

I have recently inpected the site on 21st April & actually bumped into a representative of Jetoil the developer, I took this oportunity to pick his brains with regards to delays. He was very open & told me about some of the reasons:-

Firstly his company was not aware of an additional development to the rear of Manilva beach, probably due to poor comunication from the town hall. The original plan was for Manilva Beach & one other set of apartments near to the road so the mains power supply, water, sewage & drainage were therefore designed for this demand only. Aparently after waiting many months for the services to be completed Jetoil was granted permission to start building, halfway through the build the services had to be significantly upgraded for the new development, so the build plan was further delayed by many months. In addition to this, land drainage, lights & a road had to be built to accomodate the additional traffic & a pass off from the town hall. Also very long waiting time for licences & LFO, again waiting for town hall.

My apartment is in block 6 phase 3, all work completed except for taps & a couple of light switches. The power & water were being connected whilst I was there. The pools were half full for testing & the landscaping near completion. Apartment looks good, but the kitchen small with few cupboards, but apart from that & the delays I'm reasonably happy. I'll post a couple of photos.
