I think this case is brought before the courts by a person who bought numerous properties from polaris and had 40% deposits paid and now cannot afford to close out. I think he would have preferred to have his deposits repaid rather than a 20k discount on contracts that he still cannot afford to close out on but now he MUST close otherwise he will loose his deposits.
This case suits Polaris as they know he cannot close out and all the properties will be returned to them and they can keep the deposits
you are looking at 200+ properties in deal.
