Court rule against polaris

Just been reading this article and it's interesting that Court has ruled against Polaris for failing to provide the advertised services.

CORVERA management needs to take note! 

must be a misprint ... as its been stated on this forum on numerous occasions ....  " you will not win .. no spanish cout will rule against a local developer " .... how times change !!

It was certainly an interesting article. But as far as i know no one has won a case against Corvera for lack of facilities not forgetting the clubhouse is rapidly being completed whereas on Polaris they are still waiting. Considering Spain is on its knees financially I would be very surprised if the law of the country turned on every developer that has not fully completed on there promised facilities as there must be plenty of developments in the same situation.

Hotel, restaurants, commercial centre, PGA winter HQ etc etc etc. There was slightly more in the brochure than the holy clubhouse.

I think this case is brought before the courts by a person who bought numerous properties from polaris and had 40% deposits paid and now cannot afford to close out. I think he would have preferred to have his deposits repaid rather than a 20k discount on contracts that he still cannot afford to close out on but now he MUST close otherwise he will loose his deposits.

This case suits Polaris as they know he cannot close out and all the properties will be returned to them and they can keep the deposits

you are looking at 200+ properties in deal.
