'Should have been' residents of Sierra Golf

Hi to all the people who used to post on this Forum, who should now have been residents on Sierra Golf. What has happened to all those fighting to get their properties or money back? We would love to hear of any progress on cases or disputes on this particular site. 

Our plot was M11-4, it was never completed or handed over. We took the Developer Procobar to court, (this was because the builder 'Grupo Masa' legally hides behind the various developers to ensure they have no responsibility.  We won our case finally in 2010 but Procobar ignored the ruling. Our solicitor went back to court and got a court judgement to seize bank accounts and property as recompense. Still no money but a property has been seized for us - an Eagle just near the swimming Pool. We still do not know what the implications of this are, wether it belongs to us, or wether it has to be auctioned to raise money for us, we just don't know. 

Is there anyone else out there who used to post on this forum who is in a similar situation, who has either been happily recompensed or is still waiting and waiting.

I love to hear all the good news on Sierra Golf, the gardening, the quiz nights etc, but at certain times I feel so angry and disappointed that this should have been us asking when the next quiz night is.

So forgive me all of you who don't want to know about all the still unhappy people, who have been cheated by the corruption in Spain, but after yet anther sleepless night, thinking what might have been, I just need to hear from someone in a similar situation and just let my frustrations out. We too have taken Procobar to court over our unfinished property. This is still ongoing after 3 years in the courts system. How long did your case take to process.

Sierra Golf is a lovely location with good people there as we always go there on our hols for a look and a beer.

Hi Nailor,  sorry to hear you too are having problems. We first put a deposit on our house in Oct 2006, it only needed the garden walls and gates to complete it, so in 2007, 9 months after we should have signed everything over, we started procedings in 2008. This took many many months to get started as we thought we were dealing with Grupo Masa, but in fact we were dealing with Procobar who is a branch of Grupo Masa, (silent company, in name only). Finally after years we won our case in 2010, deposit, plus interest plus legal costs. Great, but Procobar again refused any communications or even to acknowledge court ruling. Back to court again and judged ruled in our favour that our lawyers could seize bank accounts or property to the value owed. This time bank refused to pay up, saying the developer still owed them money. Unbelievable, if this were in England some one would be in jail. Finally the court have seized a property on Sierra Golf, an 'Eagle' situated near the swimming pool. We are presently still waiting for answers from our solicitors to say, why did they seize the Eagle and not our property which was an ' Open ', (a more expensive model and a bungalow) as opposed to the 3 storey Eagle. Secondly what are the implications of this property for us, do we own it, does it have to be auctioned, We just don't know. If it has to be auctioned then we will probably never see our money again.

We have heard from a resident on Sierra Golf, that before the builders abandoned the site, they stripped most of the houses of solar panels, kitchens, bathrooms and even gates. They also said that the property value had completely dropped and that the biggest houses the Albatros were up for sale for under 100,000 euros and they still weren't selling.

We are now in our late sixties and only glad that we didn't sell up our family home in the UK to go to Spain, we would be happy now with the money refunded which would allow us quite a few holidays in Spain whilst we are still able. The total money owed to us with interest is now around the 88,000 euro mark.

I wish you every success with your battle, as that's what it is, and hope that you will be luckier with the banks, builders etc that you are involved in and not as we are with corrupt companies and banks. Good Luck, R

Yes in the same boat as you...We tried to buy an Albatross in 2007/8/9...can't remember exactly now as it is so long ago.

We virtually paid everything up front and when we were to sign the deeds and hand over the final payment our Solicitor noticed that Masa/Procobar had an outstanding debt attached to our property to the tune of over 100,000 euros. which they hadn't paid off.

They tried to get our Solicitor to sign on the understanding that they would pay the debt at some time in the future!!!!!!!!!!!!! Our Solicitor refused to sign until they paid off the debt because we could have been landed with the debt which I fully believe would have been the case.

Our second attempt to sign the deeds and make our final payment had the same result....Masa/Procobar are bandits!!!!!!!

We have taken them to court and have had the case found in our favour ( money back plus interest etc) in January 2012. Our Solicitors have seized three of their assets but until the ruling can be handed to Masa's Admimistrators who are invisible, it seems we cannot get any further. 

The legal system in Spain needs some serious looking at...I'm sure that if the case had gone against us we there would have been demands on our doorstep next day..We speak to our Solicitor fairly regularly who says that the cause is due to the tardiness of the Spanish Courts......Can anyone shed any light on this???

I will never ever ever understand the Spanish legal system that allows builders, developers and banks to ignore the law and Court Judgements against them. The builders in question are still building houses about 10 miles from Sierra Golf. HOW CAN THEY DO THAT WHEN THEY OWE SO MUCH MONEY. And how can the banks keep lending them money to do this. They should all be locked up and their own properties seized, let them have a bit go stress and anxiety instead of them living the good life at the expense of all the people they have conned.. The local authorities know the situation, why do they let them keep opening new sites and o conning new people. Something surely has to improve. I think we will be writing once again to our MEP, surely we have some rights in this European Union. R

I too was in the process to purchase a property on sierra golf back in 2007, but in 2009 decided enough was enough and decided to opt out. I have been waiting for an hearing for over 3 years now. My solictors only respond to me if there is any change to the circumstances.  Papers have been served on Masa, they tried to do a deal in 2010, ie for me to proceed with  the property but with a significant reduction. I did not entertain it.

Last update which was in May 2012, that my case had been allocated Court number 3, but I still wait for a date, but reading the outcome below suggest nothing happens anyway.

I am hopeing there will be an upturn in the economy in Spain, and these empty properties on Sierra Golf will be in demand, therefore forcing Masa to settle with us all., I keep hearing about the Paramount studios theme park, hopefully that will eventually get underway.

Sadly Chris there is no hope for getting anything back from Masa or Procobar. When we signed our contract it was actually with Procobar not Masa even though the papers and receipts and updates etc came from Masa. Procobar are a subsidiary of Masa, but all they have to do to avoid the law is to ignore it. Court summons, court judgements, court papers, just ignore, we are now trying to get our money out of one of their bank accounts with BBVA that the court have seized with a court judgement seizure and even a court writ in December, but even the banks just ignore. Our court judgement was finalised in 2010 but nothing has happened. Our solicitors (Costaluz) also seized a property, an Eagle on Sierra Golf, but we are told that doesn't belong to us neither does our original house that stands only metres away, we happen't any claim on this now we have won our case. So good luck with your case but dont't expect anything and you won't be disappointed. Rosemary

 WHAT A SHAME TOU DID NOT COMPLETE ,WITH A DISCOUNT ,WE WORK IN SHEFFEILD AND LIVE IN ROTHERHAM

I am sorry for those people who would have enjoyed the site haver not had the opportunity,  its such a shame.

What is clear from the information people share, is how different people are dealt with.

We put  a deposit down with atlas in  October 2006 and were advised that things would be finished in 2007 we had not realised it was supposed to be phase 1 naievely thought it was the whole site. 

paying the total of teh deposits by teh dec in 2006 and we waited and dealt with Atlas eventualy agreeing to take possession and sign even if we did not have electric.

Jan 2008 and are so glad we did we didnt get any discout or any other offer but also we were not expected to pay off the mortgage Masa had when we attended the notary in Elche.

Others we know were faced with an extra bill and expected to pay between 9 and 15 thousand euros to pay masa's debt!!!

What we do have is a mortgage as advised by Atlas which even after these years of paying (including the hefty deposit we paid) may not even now be covered with the house's worth.  

What we do have is a property which we enjoy for holidays, which and friends and family use too. We have a retreat when we want quiet and comfort, and have made a wealth of new friends all made on SG. 

I dont think anyone of us has made any money.
