Something very strange happened over the past few days. My old solicitor took my claim to court and won both the 1st instance and the appeal v Sol Mijas Developers SL. However, I was expected to pay the legal costs myself. I managed to find approximately 20k euro by taking a UK bank loan out for £15k.
I became increasingly frustrated and felt what I wasn't in control of the situation (being a lone female) so I eventually moved to a UK based notary who was recommended.
It turned out that despite having long conversations with a named contact at Banco Pastor he wasn't getting anywhere....and took funds from the initial payment without providing an explanation for it. I took this matter up with the Legal Ombudsman and received a refund.
I then found Maria....who helped with reclaiming an insured amount. I trusted her because she seemed empathetic. I now am in a quandry as Marias firm won a claim against the bank for the capital in December 2012...and I regained the funds less legal costs (which I am told are presently with the court.
Now Sol Mijas Developers are not only in the Spanish national press for their part in alleged money laundering, but their lawyers got in touch with my old lawyer offering me a fund transaction.
I'll keep you posted on the eventual outcome.
