Hi all

Looking for opinions on buying a property on MCC that has no habitation certificate. Have had advice both to go ahead it won't be a problem and not to touch it with a bargepole. Both of these advisers seem sound people so confusion is my new best friend. All opinions and any examples of experience of this problem welcomed.

See Legal opinion below. Just be careful what advice you get from other Property Owners in Spain. Some people are ignorant of the Current Laws in Spain. It could be very costly if you did not get one of these certificates.

The owners of MCC, Huma Med, are in Administration/Liquidation so no one has a vested interest in complying with the regulations which will enable you to obtain a LFO:technically you should not live in a new property without one!

Also it is unusual to have mains water and electric without an LFO-another serious problem

but there again you may like the the location and house and the price may be very attractive due to the lack of LFO but in the future a sale may become even more difficult than at present

However to be pragmatic, currently there is a very wide choice of properties at low prices which do have all the correct paperwork, so why take any risk at all!!

The original buyers at MCC took that risk. I understand some did receive their LFO but others not when the recession started but that was different times

One thing is certain: Huma Med will go. Someone will buy the left overs of the site to make money and the new owners are unlikley to be interesetd in owners who do not have their LFO and if they intend to provide the facilities needed then they may well charge

From all reports those who live on MCC enjoy it and have little day to day problems-I think there is a MCC Members Forum: worth a look if you can get a pasword to get in

Thanks lads I believe there are properties on MCC which have their certs which so very unfair to those who have not. Why give some properties legality and some not it makes no sense. Anyways I will look at the ones who have. Have read an earlier thread on this subject and the majority seem to advise not to purchase without.

Also been led to believe that Banks will not provide a mortgage on a property without legal licence in place thus limiting future selling potential.

Can the current owners not push the local town hall to provide them with these certificates, surely if some properties on the urbanization have them the ones without have a bloody good argument for insisting on theirs? or maybe they are just not bothered???? I suppose if you already have utilities and are not planning on selling down the road whats the point. However having seen some of those programmes where people bought properties in Spain that ended up in nightmare situations it makes you very wary of buying anything that has any shortcoming in the legal dept.
