Building permit

I have just walked over to the site and there is a very pleasant man in the sales office called Phil. He told me that there are 20 men on site at the moment and more expected very soon. The digger is digging a ditch and the services are going in and tilers are doing some inside tiling. They are waiting for plasterers to do the outside of the middle block of town houses. It seems that there is not just one builder in charge of the whole works but subcontractors for each trade. He told me there are still 15 apartments not sold. There is a show flat which Phil can show you round. He said they are hoping to complete all works in the first quarter of 2007 but this obviously depends on the workforce they are able to get and the time it will take to get the first occupancy licence. I think the news is good for all of you because at one time the site looked like a ghost town and now work has started again. Best wishes

That news just puts our minds at rest after a   worrying few weeks when the site was deserted.

I have been unable to get over there for a number of reasons, the latest being our dog, Ben, has been quite ill.

I have been chasing my lawyer also for some answers re completion/bank gaurantee etc and would like to share with you his update which I detail below.Looks like finances are now in place from a very reputable bank and fingers crossed more action will be evident . Will update if I get anything more official

Dear Sir

Sorry for not contact you before, but I was unable to contact before the

developer's lawyer.

Further me conversation with Majestic's lawyer, it seems they get an

agreement with a Spanish bank named "Banco Pastor" to finalize the

construction.

I have contact also the Director of Banco Pastor in Marbella and it seems

this is correct and they will finalize the constructions of Condesa de Mijas

Golf.

After last inspection, Banco Pastor has inform me the construction is

completed in a 91 %.

Please be informed we have required to the developer's lawyer many times the

deliver of bank guarantees for payments made and last time with a formal

letter.

It seems at this stage, they will not provide the owners with the

guarantees, as the construction is about to be finished.

We are waiting to know when the construction will start again or date to

complete the purchase.

We will give them a prudential period to arrange the construction, to be

able to obtain more information.

I will keep you informed.

I hope all of you are doing well. I apologise for not having sent yet an update on the situation at La Condesa, but I am waiting for the full work force to be on site to do so. As soon as they are all there, I will start informing you on a day to day basis of what is the process and you will be kept updated on all what is being done.

I would like to clear a point about the above mentioned post (with no intention of disrespect to anyone) so that this does not lead to any confusion or misunderstanding.

Banco Pastor have always been the bank who have financed La Condesa. Yes, there has been a new agreement, but this is strickly to do with a revision of the finance, in order to guarantee the completion of the development.

I would like to reasure you all, that we at Majestic are working to deliver your property to you, at the expected standards, within an agreable time scale and that we will continue to assist you in the most effective and accurate way possible.

What do you mean by a 'agreeable time scale'?

Who have you agreed the time scale with? Certainly not with us.

As far i am concerned and all your communications, not once have you agreed a timescale, you have just TOLD us when you may complete.

Why dont you show when you have decided to discuss a 'agreeable time scale' for completion?

I look forward to your response and i am sure everyone else does as well.

Have you used your binoculars recently to see the La Condesa site ?? Do you see any further developmens / activities ? It would help us all greatly if you could update us with your observations.

Hi everyone, Not much happening on the site. Ditch dug at the back, pipes put in, and filled in. There are a few men working on the site. Apparently the developers are still waiting to finalise contracts with all the building trades before work can start. I don´t know if any prospective buyers are in Spain at the moment but if they look around it is obvious that there is no shortage of workers in this area. There are four new developments close by and they are flooded with works. Looks very doubtful if everything will be finished by the end of March 2007, even if work started tomorrow. Please don´t forget that even when the work is complete the developers have to request the licence of first habitation from the Town Hall and this can take a few months to obtain.

Your observations regarding the apparently  abundant supply of building workers in the area has been noted.

 If only we could get 50 of them beavering away on 'La Condesa'  for a couple of months we might be in by March!

 

 

 

 

 

 

Just to update you. I am not a buyer at La Condessa, I came really close to buying one, really close, but bought elsewhere. I was at La Condessa yeterday. There were no workmen on site at all. I was last there in August and almost nothing has been done since. I hope they resolve their problems soon as it will be very nice when it's finished. Good luck.

Dear Majestic representatives and hopeful La Condesa owners

It is rather disappointing that Stephanie has opted not to respond to my earlier questions.  What should one understand from this?  That we are dealing with a professional and reputable company?  That Majestic is concerned about buyers' concerns?  Or even that Majestic cares at all about simple details like completion dates, compliance with the law of the land (unfortunately Spanish law in this case) and responding timely and truthfully. 

Indeed, what should one understand when not one single buyer can contact the Directors of Majestic:  Richard Trevor Roberts, Brendan Peter Kilby, Robert Peter Perfect and Angelique Todesco?

What should one understand when Majestic representatives refuse to address their legal compliance failure and instead direct us to their "lawyer", Francisco Torres and co. at Baugat Abogados?

Does this company not have a conscience?

Visited today, no builders all fenced off, not even anyone in the office!

That's a shame. It is all so disappointing. Thanks for your post.
