 In a recent Court hearing in Marbella, the Town Hall (Technical dept) confirmed to the Judge that the development is illegal.

Now that the reins have been passed back to Marbella Town Hall, once they have reviwed the new PGOU 2007 (Marbella Town Plan). then hopefully a decsion about the legallity of the development will follow and the misery endured by so many people will come to an end, one way or another.

Hi Tish

Please can you confirm where it says that this particular development is illegal and if so why is it beng singled out  by you in when there are dozens of others in the same or worse situation.

I recall only last week when you stated how nice everthing was looking so a little perplexed by your postings.

I have a property on this devopment as you know and am visting my solicitor next week in Marbella

 I am aware that you say  there are discounted units for those that will not complete so would appreciate any info.

I am aware of some discounted apartments in the last block which do not enjoy the same benefits as the rest of the development.,

As we property owners are having a get together next week and you have no involvement in this development we are at a loss as to why you continue to obtain outdated information and post it on our website thread.

Just for the record I started this GREEN HILLS FORUM!!!!!!!

The information  that you insinuate is outdated actually came straight from our lawyer who was in Court in Marbella last Friday 22nd June.2007.  The technical (department?) from MARBELLA  TOWN HALL confirmed to the judge that Green Hills is illegal.   Also the developers administrator was ordered to leave the Court by the judge because he was very impolite during the hearing. IS THAT EVIDENCE ENOUGH FOR YOU?

As we property owners are having a get together next week and you have no involvement in this development we are at a loss as to why you continue to obtain outdated information and post it on our website thread.

We have an involvement in this development as we still have pending  Court cases against the developers and our original lawyer. 

Will you refrain from being everyones spokesperson  and saying "we" when actually it is only you!  Do not  think you are the only one who has any right to an opinion. You are not! No body else has said anything , which if they were bothered then they could post for themselves.

If I remember correctly  you were banned from our forum by  Justin who owns the website.  !!!!!!!!!!!!!!!!!!

Thankyou for the infomation and as it is so new we can sort it out when we are inSpain next week.

WE have a meeting with the residence and and solicitors and WE can look into this matter and the other that you mentioned and will reply on return.

WE will also be considering our options and those available to those that have not completed yet and again will post our findings.

Thank for the time taken involving yourself on our development and hopefully you will get your solictors fees back and appreciate that Eralia paid all of you deposit back which is far better than most people in similar situations with different developers.

Yes we got our deposit back because we worked damned hard to do so for 2 and a half years...long before anyone had even heard the word "corruption" in Spain. We worked very hard to bring  the situation we found ourselves in ,out into the open and after many trips to Spain and conversations with the Town Hall, things did start to come out into the open.  The rest as they say is history.

As I have told you before, it was  someone from the legal dept at the Town Hall who said to tell people from this development not to part with anymore money as it would not be granted an LFO.  They were spot on! I have many friends who are still trying to sort this mess out. I  would dearly love to see them get some kind of result ...soon.

Eralia did not pay us a penny.  Our case was against the bank and despite their appeal against us, we won! It was not as you once inferred ,a done deal.,,,,far from it. 

Why would you have any options to consider? You have completed and according to your post yesterday you are laughing with a huge apartment for a good price. You said you "luv it to bits"

I'm sure if my husband or anyone else for that matter were to put in an offer at Green Hills now , they would bite your hand off. (heaven forbid he did!) There are so many vacant apartments.

What options are available to people depends on how good their lawyer is.

Well at least you were successful and the developer must have ensured you had a bank guarantee to claim on.

As I have said before ,yes we and many other owners are very happy with what we have and I refer to a recent posting that you yourself considered it a lovely area.

Being an owner on this development perhaps I have just a little more insight to matters concerning mine and my fellow neighbours apartments and tend to not listen to hearsay to much.

The situation is little different from the 50,000 other properties in Marbella which as you know is getting sorted as a matter of urgency and is well documented that Marbella will be one of the safest places to by there after.

I see you appear to not want me to post on this website which silly me thought it was for owners and those with genuine interests in this particular development.

I do appologise as I didnt realise that it was you that started this thread and therefore only open to you , it appears that no one else is listening anyway looking at the postings so will leave it all to you.

While we are sorry that you have had a bad experience on the first phase of this development because it was not built we are now talking the second phase which is now complete to a excellent standard and if any one should doupt this then we would be more than happy to forward photos to confirm.

Once again I appogise and will find somewhere else for us owners to post.

Jim you seem to get off on complete fabrication. I do not care if you write on the sides of the Houses of Parliament  or your local public conveniences or this forum...it's all waffle.. In short ,I couldn't careless what you do. Get on with your life and stop stalking me. It a sad indictment of your personality. You write nothing of any substance or sound information  in any forum you use.  I'm ahead of you there and you hate it!  Do not forget  your other friend & I formed a large "GH" group that is still very active and that we are very much part of.  There are not very many occupants at GH. Hi Tish and Sunbelt

Having bought an appt. in the upper blocks (money back  thank goodness) but also a purchaser of a 2-bed in the lower blocks, I appreciate being able to read any news re. the latest of what is happening.

Surely we shouldn't be discussing whether anyone has the right to post or not - the important thing is for all of us to share all news?

Have heard that someone from lower blocks has been receiving their monies back from the developer in the form of monthly payments, but this arrangement has suddenly stopped with the developer saying they now have no more money.  Anyone else heard this?

I am out  at Green Hills next week to meet with the residence and our solicitor(very good freind in Marbella) regarding a problem I have with another development .

Not heard that one regarding someone getting stage repayments but there again I have heard so many hearsays regarding this development which to date always turn out to be rather exagerated and posted by some that have no interest only personal motives.( Not that you would do that Tish)

I have some great pictures if you want to see how the development is looking and will happily take some of your apartment if you want.as these show the real development and the area that its in.

Jim, thank you for your post.  You seem to have completed and are happy which makes me feel better.  We haven't completed yet but thankfully have a Bank Guarantee.  We are now not sure what to do, in a dilemma!   Do you know how many have completed so far?  I am worried about this news that the developer (apparently) does not have any more money, but as you suggest, it could just be hearsay?  We really do need just facts.

Would certainly appreciate receiving any news as a result of your trip, that would be most helpful.  I am unable to go to Spain at the moment, unfortunately too many committments here in the UK.  Thank you for your offer of pictures, we do know the area well and feel it is the best in the area.  How sad all this has happened.

No problem with forwarding any details on Green Hills.

You must have loved the area to gone for two apartments? and having been fortunate to have one of the only solicitors who ensured you had a bank guarantee,surely this should be your first call for advice.

Really lovely area and really feel for anyone caught up in phase one  believing  the whole corrupt situation that has been going on for so long just hit at the wrong time and understand that the developers lost a fortune caught up in this mess.

Being in the situation of having an apartment on phase two ,you no doupt will have received letters regarding the sale of interests on this and other Eralia developments in the area and again strongly suggest you deal with your solicitors rather that go for hear say comments,out dated and often dangerous advice.

As I mentioned I am having a meeting with other residence and solicitor who is a dear friend in Marbella  next week so will check out the real up date situation.

Hope you decide to keep your apartment and if you need anything while I am away please send a P/M and my associate Charles  will ensure I get the message ,would be great to have you on board and meet for a glass or two of vino.

Anyway have to go as you  my dear wife is on her way home and promised to tidy up after a party last night and these damn fingerprints seem everywhere.

So as not to offend Tish suggest we start another thread for residence and appologise yet again for intruding on her site which appears now to have the issue regarding her ownership of the site deleted.

Once again sorry to you Tish but hopefully you will understand that I am keen to get as many residence together as possible to ensure we form our commitee and as Chris has suddenly appeared after all this time I didnt want to miss this opportunity.

Jim - Thank you for your post, but am rather confused by its tone.   I certainly do not understand why you have re-posted my post from the 'Green Hills not built'  thread.

The reason I did not mention my purchase in the lower level phase was simply because that particular thread was about just that - 'Green Hills not built' - the upper level phase.

I did not feel it was relevant to mention it to people only concerned with the 'not built' part of the development.  The two situations are so different, legally-speaking it is rather like dealing with two separate developments.  Yes, having been successful in getting my money back on my upper level purchase I do feel in a position to help others with information from our experience on that phase.  However, the lower level situation is a totally different situation from all standpoints, especially the legal position, and does require a different approach.  Am sure you can appreciate that.  Incidentally, our purchase in the upper level phase was in the Summer 2003 and we purchased in the lower level in November the same year.  Why do you assume that the latter purchase was in June this year?

With regards to the couple Tish mentioned, I am not interested to pursue this particular route.  My interest was purely regarding the point that it seems their arrangement has ceased due to the developer not having any more money.  This is the aspect that concerns me as it may affect our dilemma as to whether to complete or not.  I am contacting my lawyer today for answers to this point and the point made in the post from Tish that the Town Hall are 'confirming' the development is illegal.  At the moment my lawyer is recommending not to complete because of the lack of the required licences.

Incidentally you say in your post that my Bank Guarantee will be useless.  I have read on another forum of success in court with people from the lower level in claiming on their Bank Guarantees but understand the Bank has appealed.  Therefore I am confused why you make such a bold statement.  Can you explain why you say this?

Whereas I appreciate your possible good intentions to help, having just read through another thread that was running here (which has been locked), it does seem you somewhat court controversy.  For us personally, we have only one aim in joining forums such as this.  To share information and to learn as much as possible to help what is for us, all of us, a very worrying situation.  Whereas I appreciate your offer of joining your residents group, as I am not a resident (yet, if ever) I'm afraid I will have to decline.

 

Having been through one court case successfully, may I offer some advice.  Sometimes in life it is best to travel the straight road to achieve what you want.  Turning left and right unnecessarily to reach your destination could result in you only encountering many unnecessary 'roundabouts' and will take longer.   I wish you luck on your trip and do hope you are willing to share any information learnt as to the current situation which could benefit many of us.  And do remember your sunhat.  The weather there is a lot sunnier than ....say.... the North Sea.
