Hi,

I am new to this site and am relieved to see that there are other buyers in the same situation as me.  We paid our deposit on El Pinet at La Marina back in June 2004. We were told the property would be complete by December 2004.    We paid a bit more money in December 2005 as instructed by our spanish lawyer as a gesture of goodwill to San Jose.  Shame their good will has not been reciprocated.

I have an independent spanish lawyer who has an office in London and in Alicante who is regulated by the Law Society and he has been very good.  The latest information I am aware of is that the building licence for El Pinet has been put on hold until November as the local conservationists have complained again to Elche council that the development is too near the natural sand dunes and the sea.  I understand that they can agree with them or let the building go ahead anyway!

My lawyer is currently looking into a cancellation for us.  However, he says that San Jose are not breaching their contract - having said that I cant believe that they can hold out indefinitely if they are not to be awarded the building licence.

Has anyone any further news.  I hope to get some feedback from my lawyer this week.

Hi Everyone,

We have a front line property, we are fortunate than most but we do wonder if our property is at risk of being demolished. I'm not sure how much you all know but the work had to stop again, just before the local elections. It seems to be a local group of people that keeps getting the works stopped, their name is something like "The Friends Of Alicante", they are a group of bird watchers. Not a bad thing but do they realise that people are try to live there and have spent/parted  with hard earned cash!!

San Jose along with Elche counsil were trying to get permision from the residence to get legal representation to take it to appeal in Valencia. All fine but when we were pushing SJ they keeped giving us El Bull Sh*t !!  To add insult a local counsillor said we shouldn't be living there, why? When we have sold our other main properties, were are we supposed to live.

The best of it is I and others have received counsil tax bills for 2006, if we are not supposed to be in El Pinet and what services have we had? I spoke with our soliciters and they said it wasn't worth fightng and we better have monies for 2004 & 2005.

I can understand the locals getting upset but when there area is finished we can all get on and live our lives in peace and maybe yes we will have a school, a police station and maybe shops. Its go to be better than it was before or didn't " The Friends Of Alicante" see the plastic bags that people threw out of there cars coming from the beach, builders rubble etc.  

Don't get me wrong I do like the Spanish way, but you would think they would stop using El Pinet as a political football or should it be bull fight.

I think I have said enough for now

Hi

 

 We were in Pinet last June and attended a public meeting held by San Jose, (an English interpreter translated.) The meeting was in the grounds of the show house.

 

Apparently the work was stopped because a judge ordered it (this was also reported in the Costa Blanca News.) The reason being: - the green party had lodged a complaint saying that some of the site was in the protected area. San Jose stated they have done nothing wrong and all the approved plans could be seen at both Elche and Vanlencia town halls.

 

They also went on to say that the Green Party lodge these objections as a matter of course on many new developments. San Jose could not say how long this procedure (the judge making a decision would take.) There should be minutes of this meeting perhaps in the show property.

 

I do take your point about the council tax it does seem unfair the article in the CBN said the judge could not understand why there were occupants at Pinet, I assume because of the habitation certificate issue.

I know of this meeting and its a group called "The Friends of Alicante" it might  be called a "Green Party" but its a group of bird spotter and ramblers.
San Jose  were told to stop long before this all kicked off a second time but just carried on regardless. They may not be the bad guys totally but they just carried on taking peoples money in the mean time for a further 1-2 years, till Elche Council/ Valencia government stepped in.
Have you Clive, or other you know had tax bills from Elche council?
