We've just got back from a great week over there.

I too, like GLENG, am about to have my kitchen re-done, and have also got a 6 month long term rental in, via a local company who I can totally recommend.  (Its the same company GLENG used). I have passed their names around to other owners while I was out there.  PM me if you need more info.

OVP have ruined my faith in human nature (AND I CANNOT EXPRESS THAT ENOUGH). But don't think everyone is like them, For once I have come back from Spain with a smile on my face. It goes to show that this will be a great site once it is fully utilised. We can't do anything about the surrounding building work - just got to hang on in until it is sorted out. Thats an occupational hazard of buying off plain in spain,

For those that have completed, we need a positive approach to making this site work. It is really pretty, well maintained, and everyone out there seems to enjoy it.  I need to collect as many contacts as possible because sooner or later there are going to be huge community charge issues if we don't address the matter now.

I scrutinised everything and most of our issues are community ones, and I am not sure at the moment how to address them.

They are:-

Pool only opens at 12. Lifeguard sits there with his IPOD on, disappears all the time (Even found him on a balcony that does not even face the pool!!)

Security guy props the gate open and goes to sleep in his car

NO working door entry system yet

Block D lift broken.

Communal toilets - boiler pipes pulled out

All doors to electrical switchgear and plumbing are open and SHOULD be locked. This could be a big danger to children.

WE ARE PAYING FOR ALL OF THIS AND I THINK WE NEED TO TAKE THE BULL BY THE HORNS AND CONTROL IT OURSELVES.

On a positive note, the gardens are wonderful, well maintained and very pretty.

We need more people out there to make the place buzz. I fear that if we continue like we are, with only a handful of owners paying the community charge, they will withold the services and the place will start to fall apart.

I am talking to OVP on tuesday as I am going to get to the bottom of this.

For those of you who have completed, you really need to get out there and kick arse big time with OVP / VILLAPAC and QUALITYSURVEY.

That is the only way you will get things done

My snagging report was so poor I got a full refund from QUALITYSURVEY. They did not even spot that my front door or patio door did not lock!

Please note this is Phase 1 ONLY.  Phase 2 looks way off completion to me. (I have pics if anyone is interested).

Just been reading what Nigie has said and I would encourage other owners to post their comments about the communal areas and services upon their return from Manilva. 

I have sent the following e mail to Condominium services in order to get things sorted out.  Stuart Jones will forward a copy of this email to the developer.

Hi Lawerence and Alex.

I am a owner on Manilva Beach phase 1.  I am writing this e mail to you on behalf of many other owners on Manilva Beach.  We all have concerns about some of the responsibilities Condominium Services have to us as owners on this development.
We are aware that there is still outstanding communal snagging work that the developer needs to address.  We understand that it is your responsibility to get the developer to address any communal snagging issues or outstanding communal works on Manilva Beach phase 1.
There is also a problem with the security and the life guard.
I would like to draw your attention to the website www.eyeonspain.com where you can see regular postings from owners relating to the Manilva Beach development.  Both the security and the Life guard are mentioned as not doing their jobs properly.  When I visited in December 2006 the security guard  on the gate had drank enough alcohol to knock a horse.  This is not acceptable.  It is not the impression we as owners want to give to future clients who may be renting out our appartments.

There is also a mention of electricity boxes open and boiler pipes in communal toilet areas hanging out.  This may well be a health and safety issue.

I would like to point out that as owners we are not happy paying for anything other than a first class service.
  I trust that you will address the above concerns and keep me fully informed of progress.
I would advise you monitor the eye on Spain website daily so as you can read the comments of owners when they return from their visit.  This can only help you as a company as I am sure that you will want to deliver the best service possible to us as your clients.

We would also like to know when the first Community of owners meeting is going to take place.

Hi to all on here,

I too have just got back from ,Manilva. Good to meet You Nige, Thanks for your help.

I need the help of anyone who has been out to site and either stayed in the 'Show' apartment or visited it, or can say they have seen someone in it.

If you could let me know all of the details, times dates and length of stay, I would be most gratefull.

The 'Show' apartment is in fact MY apartment and I was only told 2 months ago that my furiture was in place, but it would seem that is was inplace in october 06, and used by others to save Ocean view a Hotel Bill. On my electric and water account, Also my furniture, which is nothing like the Villa Pack Furniture.

I am trying to compile as much info for my solicitor for an imenant action against OVP.

Your help would be very much appreciated.

Hi Jim,

My wife can verify your apartment was occupied on Friday 3rd august 2007.

She returned back to England on the 4th, so is not sure for how long.

There was almost no apartments occupied that week so it was very aparrent when someone new came onto the site, and your apartment is in the most prominent place of all of them, right next to the lower gate.

I know your apartment, it is the show home and is featured on the OVP literature.

I also know two other couples who were out there that time and will email them to ask them. One overlooks your apartment directly so they may have some good information.

Hi Nige

My brother is at our apartment this week and is furious that the pool only opens at midday. We need to address this situation asap. He has been told that he has to use the two pools on phases 2 & 3 before 12:00!!

I can't believe (well perhaps I can!!) that Ocean View didnt look into the fact that we would need a lifeguard if the pool was over a certain size!!

This is a nightmare - how can we send clients to our apartments if the pool is not going to be open 24/7?

The board clearly states that if you swim without a lifeguard being present then you do so at your own risk - surely this should suffice. I wonder if every complex on the Costa del Sol has the same problem? I don't remember there being a lifeguard at Princesa Kristina when we stayed there?

The sooner we have an owners meeting the better I think!

Hi Tracy,

Its disgusting and needs addressing. I have emailed condominium services and hope for a reply today when I get home.

To add insult to injury, the dumb lifeguard actually locked me in the complex and i had to scale the fence that was surplus to requirements at Guantanamo Bay.

You know what I mean!

Can you also mail CS so they know there are a few people on their case ? Google Condominium Services ES and you'll find a page to contact them from. They say a 24 hr turnaround.

Thank you for your email. We very much appreciate your concern.
 
Firstly, I must point out a number of potentially “confusing” issues for new owners who have purchased a property in Spain:
 
  • A “management company” in English terms is distinctly different from the Spanish style “administration de fincas”. Management here is decided by owners who then in their General Meeting delegate the responsibilities to their elected President and Board. The President and Board then in turn delegate to the appointed administrator to manage contracting services and accounting issues. I am attaching for your ease and reference an article which explains this – namely, “The role of the Administrator”.
 
  • I am also attaching a further article entitled “The role of the President” for your information.
 
  • We note the “behaviour” of the lifeguard and will deal with this via a financial retention of the respective company we will however require photographic evidence or double testimony. Thank you for bringing this to our attention.
 
  • The “security” company is the one nominated by the developer/President which our administration was obliged to contract.  However, we do remain sympathetic to your feedback regarding this issue but it is important to take into account that security guards are  arguably the lowest paid profession in the western world.  Other companies have higher service levels and meet the objectives and procedures which our administration expects.
 
  • A complex’s fees (costs) begin the day after the architect extends the building’s work certificate.  The developer/ President then absorbs most costs until the complex receives its first occupancy license. Prior to May 1st essential maintenance has been being carried out in order to preserve gardens, swimming pools etc. The cost of these must be met by the community of owners. On May 1st charges or the first fees were levied to cover all the obligatory services in place in communal areas such as electrics, water, lifts, maintenance of pools and gardens, night security, administration, buildings insurance and other general services and maintenance.
 
  • The developer/ President is making required repairs to identified snaggings as per our detection but perhaps is not such a timely fashion as owners would expect. It would be our proposal to the Developer/ President, as is normal procedure for him, to call a General Meeting when all deeding of properties of the other two phases/communities are completed. At that point in time the Community would transfer into the hands of the owners. Likewise  at this point in time with 280 properties contributing to services such as security, general maintenance, certain synergies and scale of economies can be made.
 
  • We have reviewed part of the ongoing forum and note certain misunderstandings as to roles and responsibilities. We also note that there are some proactive concerned owners that should, between themselves start to make the appropriate filtering system to select a President, Vice President and Board Members, so that the process of handover from Developer to owners in managed in a planned and constructive manner.
 
I hope that the above comments clarify some issues. If there remain other outstanding issues, please do not hesitate to contact our accounts, communications or supervision department.

Hi Nigel

I had the same email response from CS. Not good enough and it doesnt answer the problem of the pool opening times. I am going over there next Saturday and will try to speak to Luigi and Raoul about it as it is absolutely crazy!!

I think the time has come to arrange an owners meeting. I think we need to get the ball rolling and see how many people would be interested in attending. Obvious problem is logistics?

Can people post a response on this website as to whether they would be interested in attending an owners meeting? I dont know how else to contact all the owners. Does anyone else have any ideas?

Time for action I think!!!!

BTW - I hope your ceiling has recovered:)

Glen and I had a chat last night and are trying to think of all the relevant things we need to discuss with CS, in terms of current problems like the pool, and the future, and also payments. It seems to me people are paying different amounts.

I think they need to a) resolve the current issues, and if they are out of their jurisdiction, point us in the right direction. And b) give us a full breakdown of what we are paying for, and what services we get, and c) sort out where we go in the future.

I think a lot of the problem here is typical OVP, and not so much CS. We were all buying a property, and going into their 'lucrative rental scheme', and expected (as clearly described in their brochure) a cradle to the grave service. All the way through I always seemed to be the unfortunate one who miraculously didnt get correspondence, things got lost in the post, etc.. etc... Only after reading this forum and meeting people out there do I now realise almost everyone was in the same boat. Wouldn't surprise me if they hadnt even communicated with Condominium Services.

We know you read this forum OVP so can you please respond with your defence ? Not sure whether you have noticed but your customers here are all seriously disattisfied ! 9as they seem to be with most of your developments on other forums too).

I am going to compile all the emails I have and email to get peoples views on a meeting.  If we can get some concrete facts from Condominium Services in the meantime, then at least we will know what to discuss and how to get the problems resolved.

If I was your brother, Id jump the fence. They locked me in it the other side (and lets face it its hard not to miss someone when there are only 2 of you there!) . I have never heard of anything so ridiculous in my life. I suspect it is because we are only paying for 1/2 a day lifeguard service!

we are also very dissatisfied customers of ovp,so again we would also be very keen to attend a

meeting asap.we are going over there on tuesday ,found out we have no breaker on our electricity

supply,so we.ve got no electricity at all in our apartment block b phase 1,according to the air-con

guy.No one as even bothered to let us know about this whatsoever,although we have papers in

place stating utilities are connected! Is anyone else over there this week, if so we are in block b

We will more than likely be uses torches, but if you are  please get in touch .
