OVP have sent me a communication.

It gives all the phone numbers of people we need to speak to for Air Con, furniture, Snagging etc....

Anyone else had one ? These numbers have been burning a hole in my phone bill for the last 6 months!

Yes we have had one to. Guess they have sent out a batch to everyone, unfortunately its about 12 months or more too late. Seems like this is there way of finally washing their hands of us in other words go away your on your own.

I think I had the same letter.

So much for the old cliche, "cradle to the grave service".

Whilst I understand that post completion we, as the legal owners, have the main responsibilities, OVP must realise that us owners have ended up with a property that is not as it was sold to us.

I don't know about the rest of you, but I was told that the development would take 18 months to build and would be ready to rent out immediately after and I would be recouping the mortgage payments well before now.

Not so in reality.

I might as well rip-up all the financial projections presented to me by OVP. Instaead of being an investment, it ihas turned into a financial nightmare that I can't see a way out of.

Do I -

a) sell at a loss (even if I can) and hand over even more tax to the Spanish authorities or

b) persevere with the whole debarkle, get a furniture package and air con organised and try and rent it out to cover my monthly outgoings.

Option b sounds attractive in theory, but I still can't get my snagging works finished so what hope have I got of getting the apartment (or the communal areas) in a fit state to rent out within the next year?.

If any one can come up with a viable option c) I would love to know about it so as to avert financial disaster.

It very much gives the 'washing our hands of you' impression I think. I have a document with Cradle to the Grave on it. Talk about gross misrepresentation!

As for your option C.  Thats the winning the lottery option !

I took option B and am now on a long term rent. Covers some but not all of the costs, but better than nothing for the moment.

As far as your snagging goes, the best advice i can give, is get yourself over there and sort it out yourself. Highlight all the issues and get Raul to turn up and do them. He works like stink and will do all your snagging in a day. However he is well peeved off and I don't know how much longer he will be there. I found that was the only way to progress with mine. I went 2 or 3 times, had so many furniture issues it was untrue. But while I was there I was on the phone direct to villapac barking orders at them. You've paid good money for all this stuff and the least they can do is provide a service to you.

Then when its all sorted, join the rest of the crew and file a law suit against OVP for all the issues too numerous to list here!

I think you would be wasting even more money going after OVP. I believe they have absolutely no responsibility towards you at all as your contracts are with the developer, furniture people, management services etc etc.

OVP are a UK registered company and you can do something legally if you havent got what you paid for. There is someone on this site who is 'rallying the troups' so it might be worth going back through the threads to find them. Do not complete until you are perfectly happy and there are plenty of viable alternatives with regards to furnishings and rentals

I too had a letter. I was in communication with OVP over the short fall in my apartments' furniture, not supplied by VillaPack as it was the show apartment and has been in for nearly two years, but they now won't take my calls so it looks like the door has been slamed in our faces and were on our own.

I have spoken to Global Aim about an interest only mortgage and they said there are some avaliable with no set up or change over fee.  At least with that in place the monthly out goings would be reduced, therefore the 'long haul sit and wait for price rise' option wouldn't be such a painfull one.

As for taking OVP to court, I think their lifespan is vastly shortened with these later developents they have involvment in and by the time it gets to court they will be long gone, ripping someone else off. Personaly I think that the best option is to get the community of owners off the ground and take control of our own desteny.

 'Cradle to grave', they will put me in my grave.

If you google 'Disney, Spain'  it brings up some interesting links, surely they can't all be mickey mouse hoaxes. If there is some truth in them, then we might not do so bad after all. If their isn't any truth in them then atleast believe short term to make the nightmare less vivid.

Okeycokey2000 -yes I have completed. I caved in to the threats from OVP and the developer who said they were in a position to financially penalise me if I didn't complete.

Nigie - Are you in phase 2? My apartment is.

Long term rent is a possibility, but the communal areas in phase 2 are filthy and are no where ready for renting. Even OVP admit that it could be another year before they will be able to start renting out apartments in phase 2. That's alot of mortgage payments. Furthermore I really don't fancy going through all the extreme hassle I have been going through with OVP, Quality Surveys etc with a furniture package company (see comments from jimhadenough). I find it strange that despite all the bad reports I have read about Villapack, they are recommended by this web site. Maybe they are the best of a bad bunch.

Regarding the Disney development, no one at OVP in Duquesa knows anything and there doesn't seem to be any new news on the internet. Does anyone have any firmer info on whether its going to happen or not?

I fear selling up is my only viable option. Can anyone recommend a good estate agent? What are Spanish tax liabiliites when selling a property?

MRH105, I am on Phase 1.

I don't really know what advice to give to be honest.

When I was over in August, there seemed very little going on on phase 2. What is the state of play regarding maintenance at the moment etc.. It looked like a ghost town. I hope that between now and next year they get it up to the state that Phase 1 is at, but I never see anyone actually working on Phase 2. I notice none of the lifts are switched on, and the gardens don't look maintained, which concerns me somewhat.

As far as estate agents, I hear a lot of people talking about Andalucian Dream Homes.  Its an awkward one. You will probably lose more in selling it that you will in paying a years mortgage interest on an empty property. But if you do pay the interest, youve got to hope that the situation has improved next year.

And to think we bought these to make money !

If you want to sell up then there are several large estate agents in the area, If you go out to the area and get your feet on the ground then there is a local directory, printed monthly free to colletor in Dequasa, for people/ businesses in the dequasa area, but  Andalucian Dream Homes do market all over the UK at the hotel type proprety shows, therefore companies like them do have a broader spread with sales.

If you haven't paid for a furniture pack with OVP yet then don't, you could furnish it for half the price and keep the change for the mortgage payments.

Thats my dilemma.

If I wait for a year, I have to rely on OVP, the developer, Quality Surveys stepping up to their responsibilities ........which hasn't happened yet.

Have you heard anymore about the supposed Disney development??

Disney have confirmed dates for their new complex. Adam Rollins chief executive of the National Association of Estate Agents quoted:

“We have been asked by one of our members Buck Rogers of Albany Real Estate Search LLP for clarification on the Disney project. After consulting the Spanish authorities we now have more clarity for our international agents and for those selling property in Spain. Disney have confirmed that the framework to be able to take the excess numbers of people and in terms of property, hotels, and transport is now underway with the extension of Malaga airport and roads being able to take excess traffic, and the new train link from Fuengirola to La Linea to start soon. Disney expect to start building in July 2008 - to be done in four phases -the first which is a summer camp to open in April 2009, followed by Disney resort rolling out soon over 45 acres. This will be good news for property owners as well as those wanting to purchase a property in a superb climate. Press launch is Jan 08”

Much as I want to believe this message, the mention of 'Buck Rogers, has alarm bells ringing. Do you think that this might be another con. We,ve had so many in the past.  There is another website at www.manilvalife.com/disney  tthat seems to throw some doubt on the whole Disney project.

I agree Carrie - after reading further down the thread that I copied it from, another person cast doubts on the person who wrote it's honesty. Claiming he had mis-sold him a mortgage and telling people not to believe him!

So I think what was put is all pie in the sky.

I couldn't really find anything else recent that suggested there was further progress.

Disney speculation

If you put Disney, Spain,  into google, you will find many diferent search resaults, an artical in the Sunday Times is mentioned worth a read, Then add Manilva to the search and it looks like the local town hall and other official sites have comments too.

Buck Rogers does sound a little out of this world, shall we say, but the other sites sound promising.

If everyone else in the World think it may happen then at least the property prices will hold out or even rise, whether or not it materialises.  I also heard from a local that the Hyett hotel chain were in the process of purchasing the 'Don Juan' hotel, which is just opposite Manilva Beach. Why would they do that unless something big was comming?  We can only keep our fingures crossed and ride the storm.  If it doesn't happen then prices will rise, they always do. It will just take a while.  After all Manilva Beach is a lovely layed out urbanisation, much better than many around.

We need to be positive about our investment and work together on maintaining its charm, through the community of owners, that way we have a fighting chance of success.
