i purchased an apt 3 years ago in manzana 6 / block 3 and have been facing with many problems in dealing with this business. to put the difficulties to a higher level, i am from Hungary and i can represent a pretty big group of conned (?) hungarian investors of la reserva. you are not alone dear brit owners... unforunately there is no such a big press for this penarroya scandal in Hungary like by you.
i was very happy to find this website and forum and studied it through carefully in the past few days. i understand the hesitation between suing the already paid 30% back or completion. but i received a letter from my solicitor in the recent days forwarding a draft sent by developer in case i would like to give commission to the developer to resale my property before completion and as soon as they received the full amount from the new purchaser they will reimburse me my previously paid money (the 30%). i haven't met any posts here mentioning this option. do you have any remarks to it?
the draft is in fact ridicluous. it is like a letter (starting with "dear sir,..."), without any recipient or addressee, and it does not tell anything about the interests since the passed original date of completion which was fixed in the contract of purchase. i should put the data of my apt in the first sentence and sign it at the bottom. i received it when i asked my lawyer to explain why are the apt-s of some of my fellow-investors on sale at the la reserva sales office although they were not required to complete nor informed to get "dismissed" from the property. actually the developer simply threw them out from their contract, took their money and put the property again on the market as his own. weird, however i cannot be surprized so far...
the case of my lawyer and real estate agent is another fairy tale. the agent was a guy from the UK with a hungarian wife, both disappeared more than a year ago but weren't helpful at all after taking our money. the lawyer is the same with different secretaries answering about in an average of two months to my almost weekly letters. not always coherent information, not in time, not to all my questions, etc.
i would really appreciate if you gave me some advice or share your opinions with me in this reimbursement topic. i hope i could call your attention with this thread. excuse me not to post the above mentioned letter or names here but i feel like i was an actor in a huge plot and i can't trust anymore. i send it in private message if needed.
