I emailed SMD last week using the 'contact us' facility on their website.
I asked about the 'photos and also if they could confirm a 'New' completion date.
I have previously used this facility to contact them but never got a reply, so I expect my last message will go the same way.
Some people posted a few months ago stating their lawyers had asked them to compile a list in order for them to claim compensation for late delivery as stated in our contracts.
My own solicitor never contacted me, but I did compile a list and send it to them explaining my reasons for doing so. I.e., other purchasers solicitors had contacted them asking for these details. As I have not had a reply or even an acknowledgement of my communication I can only assume they are dealing with it.
Has anyone had further communication with their lawyers regarding the compensation?
Also has anyone visited the site in the past two or three weeks? If so, did they manage to view their apartment and if so is the view day still Fridays at 12.30pm? Who can be contacted to make the arrangements to view as I understand 'Insitu' are no longer involved?

Sorry didn't mean to do it twice! This message was last edited by larny on 10/15/2007.

Hi Larny,
Thankyou for that. We are over between 6&17th November and intend to view.
Added 15.59pm
I've just contacted Lourdes by 'phone and made an appointment to view. I asked her if smds camera had broken since we've had no pics. for over two weeks. She promised to look into it.

I was given to understand that Lourdes was Isitue. Also concerned at no photos but when visiting on 2nd Oct all was going well, even saw surplus building supplies ,pipes etc being taken away by lorry and the building by the pool(toilets etc) being completed.Gateways to 6,7& 8 being completed with post boxes and entry phones and lorry loads of top soil being deliverd.Things may have slowed last week as it was Fiesta week but why can we not get reliable progress forcasts.Even our lawyers seem unable to help put our minds at rest.

I visited site last week, and due to the public holiday, all was very quite on site, with only a security gaurd present on site.
Looked to be well on the way to finishing with lots of top-soil laid and not much building stuff littered around externally, but couldnt gain access inside the fenced area. I still wouldnt guess to a completion this year though...

I have just come off the 'phone to Lourdes after trying all morning to contact her.
I told her that lack of communication from them and failure to answer our queries has caused unnecessary concern.
She told me the internet connection that is used to put up the 'photos has been down. Telefonica, their internet provider has told them it should be working again this week.
So.............................fingers crossed.

My lawyer has contacted me on my prompt with the following note...
I am pleased to confirm that we have contacted the Developer and they have
informed us that the certificate from the Architect of the finishing of
building is ready and that they will apply for the First Occupancy Licence
next week. The problem is that this licence could take 2 or 3 months and
therefore completion will not take place until the beginning of next year.
(Instead the developer is going to try to obtain it before that date if
possible) but it will not depend on them as it is an Administrative
formality and depends on the Town Hall ( in this case of Mijas).
Looks like things are progressing well so nothing at the moment gives me any real cause for concern except the license will be granted and the landscaping etc not complete.

Thanks for that chuck, I only wish my lawyer was as quick off the mark with their replies. I have to wait until next week when she gets back from wherever. Although I am still waiting for a reply to an email I sent them in June.

You're not by any chance with Manzanares are you? We have the same problems with emails and, like you, have been told we will have to wait until she gets back next week. I don't suppose they'll be that slow when it comes to asking us for money!
Still, it's excellent news about the licences and perhaps by the time the LFO comes through the landscaping will all be finished.
