When I purchased my apartment in block 3 i was given a written e-mail to confirm that i would have unspoilt views of the golf and sea, clearly this is not the case. I have then taken further legal action but without any joy. My only option now is to take the developer to court, however I am not able to do this because of the costs involved. I think all those who are affected by this should take action together or may be look to obtain costings on how much it would cost to remove and then contribute?

I'm on the 3rd floor of Block 2. Any idea how much the mound interferes with the view. Likewise I was told that there were uninterupted views of the sea (guaranteed because of the golf course location)..

I have bought on the ground floor so I am concerned perhaps even more than you. However, I have been informed that the mound will be levelled off. I have not seen it myself. I gather this will be done when the club house is built.
Anyone know when we need to complete on this?

Block 3; The hill obstructs the view from apartments with no's 1 to 4 on all levels. Apartments 5 to 8 on lower levels. At higher levels the view to your right is obstructed but you still get a nice view to the left. The pentouses are about level with the top of the hill.
Block 2; This block is higher then block 3 and the hill obsructs the view of ground and floor 1 only but in all directions.
Block 1; this block is oriented away from the hill and has a minimal effect on apartments with no's 7 and 8 on lower floors.
As far as I am aware the land for the hotel has not been sold and there are no negotiations on going to do so. Until the land is sold and the purchaser releases his plans we will not know what is to become of the hill. The present owners have no plans to move the hill.

My apartment is ground floor of block 3 apartment 2.
With no sign of the hill in front of my apartment being demolished I feel that the developers claim of uninterupted views is a blatant lie. I have asked my lawyer to challenge it. I am claiming a full refund and would be interested to work together with anyone else in a similar position as we all need to share evidence in order to show proof that we have been mis sold.
I know that IPS was the sales organisation who sold me the apartment - any info from others would be useful including success stories!

According to Monty the Golf Pro at Sea Golf the Managing Director of AJA the Development Company is having the house the other side of the Club House from our Blocks built for himself and family - Monty is even giving lessons to the MDs kids. You guys in Blocks 1, 2 and 3 have a real issue and even in Block 4 (ours) it is a nuisance - maybe we could form an orderly queue outside his new home (with fantastic Sea Views) and ask how the issue with Hill could be resolved. One thought I had was for a bunch of us to buy it, move it and build Tennis Courts or whatever and rent back to community to cover costs of buying - there has to be a deal there somewhere to avoid bloodshed!

I feel quite P*ssed off about the whole thing as it truly was not sold to me as "view of big ugly earthen mound". I am not sure how much I am affected though as some reports say that top floor of block 2 is not hindered visually. However I do find that hard to believe and I do think that the view further down the strip is much better (conveniently the photos on some websites are all taken looking out from the lower blocks).

Hi we are going out next week and if the hill is obstructing our view block 3-1-6 then we will have to take some measure to challenge the developers. The land on the top of the hill we are told is up for sale if this is the case then the information we were given when we put down our deposits is wrong. Gordon

I wonder if "someone" could get a petition together to present to the developer. However my feeling is that they will say the land is for sale "as is" and it will be up to the new owner to terraform it depending on their plans for it.
When you are there Gordon, see if you can find out what planning permission has been granted for the land. I think you will find it is not a hotel.

Helo everyone, I have just returned from calanova.We done our snagging not many problems. Developers stand on the the hill is that he never promised anyone to reduce the hill. The land at the time was allocated for a hotel by a third party who has now pulled out. The situation now is that the land is for sale but no one has made any offers as they are asking so much. I feel that the clubhouse when it begins will take most of that area. If any build is done on the top then block 2 ground and first floor will have no view also block 3 ground and first up to row 4. Our solicitors advise anyone with anything saying the hill was to be removed should challenge the developers. We are completing on the 29th sep with morgages through Jeremy Ryan at Evergreen.

In front of block 1 to 5, Calanova Grand Luxe Golf is to be 150 apartments in 6 blocks. 1,2,and 3 bed. Spacious landscaped areas, 3 pools and two tennis courts.
Behind CSG, Calanova Sky Golf is to be 230 apartments in 9 blocks G+2 and G+2+Penthouse.

Hi everyone
We have just returned and have bad news about the hill. We payed a visit to the developer who has bought the land from the csg developer. They didnt know we had bought in csg so was quite free with her information. The buildings that are going to be built on top of the hill are the same as calanova grand at the bottom in front of blocks 10. The developers are waiting for the licence from the town hall and expect to start building around March 08 and will take 3yrs to complete the six blocks (125 apartments). Blocks 1,2 and most of 3 will have no views. When we asked about blocking the views we were told that the people in 1,2,3 had been told by csg developers that the hill would be built on (news to me). We were told a hotel was being built to the right of the hill. The land behind these blocks has also been sold with no plans at the moment. When we visited room 101 about our snagging problems i asked about the hill and they just shrugged their shoulders saying they knew nothing about it.
Just another case of AJA making more money
