court cases against non payers of the community

I purchased an off plan apartment in spain(2004)for investment,through Sun seakers/london,then ERALIA,its now completed.12months into the build,i was contacted by a freind(in spain)who informed me about "white whale".It was headline news,Mafia,money laundering,and a legal firm,D.V.A.guess what,my lawyer worked for them(i was introduced to her/dva by agent from..eralia.).Several heart stopping phone calls to/from Spain,i decided to (1)get a new,reputable lawyer to investigate further(2)receive confirmation that my money (deposits)was transfered to the appropriate people concerned(3)that i did actually purchase a spanish property,if so ,confirmation of legal docuements(written in spanish etc.and there whereabouts.)this is of the most paramount importance.I then received a xmas card from ..eralia.Not long after this,an english news paper then had a report on...white whale,and the investigation(s)and the sad story of people who had lost everything because of the scandal that was now emerging.My new lawyer,contacted me with the news that (1)i was one of the lucky ones.(2)docuementation was found and that my money had gone to the correct people concerned.(3)i did have a spanish apartment(4)If i hadnt paid the larger deposit etc,then ..the outcome would have been less welcome!At least i received a xmas card from eralia,thats ALL info/help that i received from them.Have things improved?Anyone else with similar experiences,I cant be the only one in this never ending saga.

Bluesman....I have purchased an off plan apartment in the La Hacienda del Senorio de Cifuentes development. It is still not completed and is now due to complete in Spring 2007. I was under the impression that everything was going ok until I read some things on the forum. I am now waiting to hear back from my lawyer. I haven't heard anything from Eralia and was today told in a phone conversation from them that if I had any questions to speak with my lawyer. It doesn't sound very positive! Anyone else bought in this development? I would love to hear from you

I just wanted to let you know that I had previously been contacted by a client who had bought a property in this development, direct from another agent and of course through Eralia.  I am now trying to help this client sell his property.  From this, we both visited the site and also spoke with the develper and lawyers.  They both informed us that everything was going ok and that completion would be in April 2007. They also said that at this time the habitation license will be allocated without problem.  The role of ensuring all is ok, should in essence fall with the solicitor.  The development itslef looks fantastic to be truthful, the views are magnificent across the whole of the coast.  My client has a unit that is elevated and facing south west, without doubt one of the best units on the development.  Once again, I have been to the site recently and spoken with the developer, so should you need any assistance, please do not hesitate to contact me.

Just wanted to add my experience with purchasing an apartment at this Eralia development to perhaps allay some fears expressed below.  I have been very impressed with Eralia. They are a reputable firm with an excellent track record, thankfully with no involvement in the recent discoveries of corruption and ensuing court cases.  This is a quality development from a quality company.  On a personal level I have been very pleased with their efficiency: I emailed to request that the second bathroom was installed with a bath and shower over instead of just a shower as in the plans.  After previous experience of working with builders here in the UK and knowing that it is advisable to stay on site and keep a very close eye on making sure plans are adhered to, we went over to Spain some weeks later expecting this not to have happened on the strength of a couple of emails, but there it was, fitted in exactly as requested.

We were lucky enough to have bought a garden 3 bed flat right at the front of the development, chosen because the view infront is well established where all the flats were sold very quickly on release. Unfortunately my husband had a brain haemorrage last year, hasn't worked for 9 months and is about to have a brain operation.  We are gutted to have to now sell the apartment but we have had to change our plans.  For those of you who can hang on to your flat, it will be an excellent investment in the future.  The clamp down on corruption can only help in the long run, there has been a halt called on all future development plans and there are strong rumours of a new Disney resort just 2 exits further down the motorway, even that planning permission has been submitted, although how true that is I'm not sure.

I should be able to get over there in a couple of weeks so will let you know how it is progressing when I come back. I have posted some photos from my last visit in September.
