I recommended ACC to a friend and they are considering transferring to Oasis,as they never got a BG.

Can I ask - has any of the people that have transferred got a Bank Guarantee for their new property and if not when are you promised them?

I am worried to let my friend go ahead if they end up in a worse situation.

I would appreciate your replies.

The procedure is that you first sign a  cancellation contract and an OTCC reservation form ] plus if you want to a form giving you the right to transfer back to ACC if it re starts before OTCC is ready] Your money is then transferred to Huma Indalo SL, which is the developer of OTCC

The contract will follow circa end of April although I think some people have been able to sign this at the same time as the cancellation contract

And the guarantee in a further 4 weeks This is from ACC Seguros which is an insurance company and is just as acceptable as a bank guarantee

All the documents are available for buyers [ and I have a PDF of them if anyone is interested]

For those like myself who do not have a BG for ACC this route seemed the best option as MCC was not for us Also like OTCC location

If you hate Huma then probably nothing anyone can say can convince you that OTCC is OK

But clearly in my view this development has been set up to enable the Huma owners and their bankers to salvage something out of the ACC mess  

If the banks did not support OTCC then Huma would not be able to transfer the money to the new company If it was not legit there would not be any guarantees available and they have made sure that all the paper work is available upfront

The  mind boggles at the thought that they have gone to all this trouble as part of a big ' con'!!!!

Now, there is always a risk that it will go pear shaped but not having a BG for ACC, it is a pragmatic way out...going to court for our money seemed a waste of money as the BG people will get their money first and there may not be any left for us

Not perfect but the ACC dream is over [ at least for the time being] and we do now move forward

Everyone who does not have a BG should at least have a look at OTCC and MCC and then make their own minds up

If you have a BG, then you have a third option

  

 

 

Tell me, what is the use of a Bank Guarantee, the Banks are now refusing to pay out on them, as well as having to take Huma to court , many of us are having to take the Banks to court. To anyone buying on this new site, be very, very ,careful. The mess that is ACC could well have an impact on this site. If money has been diverted from ACC to Oasis that, according to a judge I know in the Costa Del Sol is a criminal misappropriation of funds and would be severly punishable in law. Oasis could be shut down whilst investigations take place. Call me stupid, but why would the Banks refuse to pay out your money, which is supposedly held in a separate account and your's, and your's alone, if everything was above board. To not question this is very foolhardy.

I cannot believe that people who bought on ACC are even considering moving over to OTCC, if you did not get a BG for ACC why on earth do you think that you will get one for OTCC.

You are falling in the trap of encouraging HUMA to just keep changing their name and keeping your money.

How on earth does ot take 4 weeks to get a BG ? I for one would not trust them that I would get one leaving it that long.

Rowlandsb i am sure you must be getting something out of HUMA because all you do is say how wonderful they are and how you are looking forward to this new development with them. Surely you must have woken up and smelt the coffee that they are nothing but crooks and with you encouranging people, you are just lining their pockets with peoples hard earned money and lifetime dreams.

If you transfer to this developement you are just prolonging the outcome, they have not got a pot to P#ss in and you are just giving them an escape clause for another 2-3 years.

Just not prepared to pay the cost of taking Huma through the courts on the off chance that I will get paid before all those with bank guarantees

It is just a pragmatic option...if we had found something at MCC at the same price as the Tarifa which we liked then we would have had a property by now...something tangible for our money

I do not care a s..t about Huma, their reputation or really what has gone on for 2 years or more

I only care about the 40 % I put down in October 2005 and giving myself a chance of making it secure

And in due course I will find out if I have made the right decision

Calling Huma a load of s..t has no bearing on making this decision

Whilst all constructive comments are welcome, and this is my opinion, I am cautious as far as Rowlandsbb is concerned.

He states he is a buyer, and there is nothing to the contrary with regards to this, BUT he is an agent. He sells properties along the  Southern Spanish coastline.This is on his myspace or whatever it is on the bottom of his posts..

 I am glad his website is no longer advertised under his posts.That is not what this site is for.

This site is for BUYERS and I think  AGENTS should not be allowed to post. We do not know if it is with a favourable prejudice toward the developer.

I look on this site for unbias, factual information from BUYERS who are going through the same process as me.There is always going to be the suggestion information posted by AGENTS on these boards is not without bias or prejudice. We do not know if they have a financial interest in selling properties at the site in question. 

Taking HUMA to Court has cost me a down payment of 2,500 euros.

If it goes all the way to Court and I do not get costs awarded it will cost me another 2,500 euros.

Thats 5,000 euros in total.

The simple fact that my solicitor refers to is that HUMA are in breach of contract. That is in black and white.They signed.They didnt deliver. The solicitor, the Notary have said this to me. 

I will provide details of my solicitor to any person who wants it and I do not get any payment for new clients !!  Im doing this because I dont want fellow Brits to be ripped off.

Buying somewhere you dont really want isnt saving or safeguarding money. You have to pay for it. With a big lump sum or a monthly mortgage payment. Then you pay the monthly costs...For somewhere in your heart of hearts you do not want.

If you dont really want it will a buyer want it if you try to re-sell ?

This is my opinion or take on the situation...Im staking 5000 euros that I get our money back.......we will get our money back.

I wish you luck with getting your money back from Huma, but why do you keep calling other people who have decided not to take the same option as YOU, regardless of them being a agent etc

I  decided to take the option and transfer to the OCC and think it is a better site than the ACC, but then that is my opinion. I would of thought you had enough to do getting your money back, without calling everybody else, or is this soar grapes because watch Dog won't listen to you either.

I dont know what you mean by called exactly, but we have not phoned anyone or sent a Private Message unless someone has asked as something in a Private Message first.. 

I have received numerous private messages asking who my solicitor is and I have replied to these with the details.As I said that is to help people in the same situation.

I have never contacted Watchdog or given my details to anyone for the attention of Watchdog. I have never had any dealings with Watchdog in the past.I do not wish to be interviewed or have any contact with Watchdog over ACC.

It is not sour grapes at all......If I wanted to chage to OCC we would have done !  

I stand by my comments about Agents.

I do not have enough to do getting my money back as I employ a Solicitor to do it for me !

You can change to OCC and I hope that it is successful, I was there on Friday 11th April and it didnt have the same appeal as ACC. Our tastes/requirements are different to yours obviously but that does not make one of us right or wrong.

OCC is  being built by HUMA who I do not trust, who have money belonging to other customers they have no right to keep and and are refusing to return due to financial problems. They had financial problems in May 2005 before building at ACC stopped, that is why they could not give Bank Guarantees for the second stage payment.

No one at OCC seems to have a  Bank Guarantee yet and the ACC experience must be a factor in deciding whether to buy at OCC.        

 

 

 

Has anyone who transferred from ACC got their BG yet because if not, well I don't have to spell it out. I sincerely hope these have been issued because if they haven't you have got to do something about it before it's too late. Fortuanetly I have one from ACC and I have executed it, although still not got my money from Bank, they are stalling because so many developments have run into trouble and literally hundred of people are cashing them in and the Banks are under pressure. Obviously if they had kept the money in separate accounts as they are required to do by law then there would be no problem, however it dosen't take a genius to work out where the ACC money went.
Before someone gets on their high horse I don't care if people transferred to this site because of lack of BG at ACC , it's a democracy and people are entitled to what what they feel is right for them regardless of other peoples opinions. I just hope people are not burying their head in the sands because if you haven't got a BG by now, do you really think you will ever get one?. Please someone prove me wrong, I just hate to think these people are getting away with it again.
