Hi All
We have received a letter today from Taray saying that the LFO for Manzana 1, block 4 apartments was granted on 21st May 2008. We have been given until the 21st June to complete as per the contract.
However we have executed our right to cancel the contract due to breach by Taray (due to the LFO not being granted within the contracted time) and are currently taking CajaMurcia to court to recover our deposit as they would not honour the bank guarantee.

Our solicitor believes the lack of LFO at the deadline for works to be completed on the contract (120 days after planning approved to commence building work and then a further 24 months to complete work) is grounds for cancellation in itself and also Taray had never supplied us with the bank guarantee (which again is grounds for cancellation)
Having said that Taray and the Bank are not accepting this - hence legal proceedings

Isn't that just typical. Could your solicitor also be at fault for not making sure the guarantee was in place?
How long does your solicitor expect proceedings to take?

We instructed our new lawyer Maria de Castro in November, the court proceedings we issued a few weeks ago and we have been told it could take between 6 months and 2 years.

Hi
Has anyone else received a letter to say the LFO has been granted? as we have not received a letter and thought they were still waiting for it to be granted, we are on manzana 1 block 1, it would be good to know as we would I presume not be on builders supply anymore and should start receiving utility bills.
Any info gratefuly received.

Apart from ourselves, we know of another couple who have received a letter from Taray saying the LFO for Manzana 1 has been granted and that completion must be made within 30 days of the LFO being granted.
They like us are trying to get their deposit back due to lack of LFO.
I wouldn't be surprised if Taray are only sending these letters out as an attempt to pressurise buyers (who are looking to cancel their contracts) to go ahead and complete!!

Sorry think we are at cross purposes, we completed twelve months ago and are very happy with our purchase, but just wondered about the LFO as we had not heard anything, thanks for your reply and we wish you good luck with what ever you decide to do.
