hi all,
just wondering if anybody knows the story about the pool. everytime i have spoken to toray i have gotten a different answer, firstly they were holding off due to completion of other buildings etc etc now the latest is that they are not responsible for the pool at all that it will be up to the town council if and when the decide to build the pool.
This has really put the alarm bells ringing in our house as with three toddlers we purchased the penthouse with the express idea that a pool and sports complex would be built and ready for 2008 and so far not a sign of either.
i know there is a pool in the town but it is not much use to me if it is only open for 2 months of the year. I have gotten on to my solicitor and he has said that there are loads of complaints about this issue and that he is of the opinion that the builder will have to build a pool but that is not really wat i want to hear.
and anybody throw any light on this subject>>>>>

As far as im concerned, it was written into everybodys contract when they purchased their property that taray were buliding the pool and sports complex.I expect them to honour this, because if they dont they will be in breach of contract. If it was the other way around, im sure they would quickly let us know.

Hi sandra greene here. I am glad that people are bringing this up. I thought that i was the only one upset about the pool. We have been in touch with Taray several times to discover that the land the pool is to be built on is coucil land and no guarantee will be given by taray about building the pool. I too only bought here as ther was a pool to be in place. Taray told me directly that they were building the pool but if you check your contract there is no mention of a pool. Bit of a shock it was to us. I too have three cheildren who will have no interest being there unless the pool is in place. I don,t know where that leaves us but one word comes to mind. Duped. I would have bought elsewhere. I believe that i was mislead by taray. Does anyone else agree. All we can do is hope that the coucil will give permission to build. If Taray are as good as everyone says surely they will get permission to build the pool. Lets hope

I am really dissapointed about the pool as well, we visited lots of developments before buying in San Cayetano and all of them had pools. We were also assured by Taray that there would be a pool, and we told our three grandsons who's sole interest in Spain is a pool. Is a pool not the "norm" in all developments Spain, and can anyone tell me why the flats have one? we were not told about that! why did they just not build a big one and be done with it, and then everyone would have been happy. I am not getting at the people in the flats, they have probably paid extra, but I thought we were also paying extra for a pool.

You're right - the way I look at it is that we've all paid for the pool as part of our purchase price. If the pool doesn't materialize, our properties are worth so much less should we wish to sell.

My feelings on Taray's honesty is well documented on this site. The sales office told us in March 2007 that when the properties are finished they will built the pool, driving range, club house etc etc.
Now, once they have everyones money, Taray have no plans to complete. In the current economic climate I can not see Taray spending money on this area unless forced to do so.
The prices on phase 2 (if it is ever built) includes a pool and they were similar to phase 1, so you would expect part of your purchase price to go towards a pool. The upkeep and running costs would have to be met by the local council but if they already have one pool would they need 2? One solution might be to have it gated for use by Taray properties only, and the cost put on everones community charge.

A bit naughty perhaps - but has anyone thought of hanging around the sales office and talking to potential purchasers about our plight? If we can put people off buying from Taray, they will soon get their act in order.
We could put up posters around the Hacienda Taray and San Cayetano saying the same thing so that it would be difficult for potential purchasers to miss the message. We could hit Taray in the pocket. Now that would hurt!!!!!
Surely some of you also have some similar ideas that would put pressure on Taray.
Suggestions?
Anybody offer to co-ordinate a plan of action? (I'm in the UK)

Colin, I notice you have talked about community charges, but we have been told by several people living on the site that there will not be community charges as the site has been adopted by the council. Has anyone else heard about this?
We were also told when we were out about 3 weeks ago that they would be starting to build the clubhouse etc very shortly. I thought this meant the pool as well, but reading your comments on here it sounds like I have misunderstood. I also understood that Taray were building the pool & the amenities & then the council would run them.

María de Castro has also stated elsewhere on EoS that promotors have to build according to the architect's plans and according to advertising and marketing materials. The Taray website is still showing the original plans, which incidentally do not include a pool for the apartment block.
Our agent has stated that the site is supposed to be Taray's premier site with first class facilities and our solicitor has stated that the mention on pool in the annex to our contract is only an example.
What is the latest from the Taray Head Office? Has anyone spoken to Teresa in Customer Services? Unfortunately, my e-mails remain unanswered.

I asked Bianca in the sale office in April about the pool and club house and was told that she did not know when it would be built. The have no plans to build it in the near future. We are purchasing on phase 2 soley because of the pool issue. An open pool will be used by all and sundry, not just people from San Cayetano. If Taray are obliged to built a pool I think a manyana approach would be taken if no dates are written in stone.
Most of my emails from Taray do take a long time to get answers.
Mo - my community charge was only an example that might be considered to obtain a well looked after pool. Tarays defination of 'very shortly' is probably years away. Through dealing with Taray, SOON means a year away and NEXT WEEK means 6 months away. Might be a translation thing?
Last year Taray were saying it would be completed by summer 2008. Well it is now summer 2008(almost) and no pool. I feel sorry for those who have been conned by Taray (all of us).
But what can we do?

Hi All,
Can somebody give me the e-mail address for teresa in customer services. The more people that write to her, the sooner she will have to reply to them. Like Nan and Ewen i have nothing against the people who have bought the apartments, but how did they get a pool when they were never in the original plans. Maybe someone who has bought an apartment can explain this. Can someone tell me how i am going to tell my kids that they have no use of a swimming pool on the complex, and the one that is on it, is for the sole use of the people that have bought an apartment (which i presume it will be). While they relax by their pool the rest of us will have to do with the village pool or trudge all the way to the beach. We were all told that we were going to get a communal pool when we handed over our deposits.

Isn't this just typical of purchasing in Spain. I was sold my place on the understanding that Taray would provide the pool and sports complex. Then it is the council and now it may not be built.
I have emailed my solicitor to get clarification and I will post his reply when I get it.
I believe the state of the economy and the poor euro rate is causing Taray cash flow problems. Hence cutting the building of the pools and their reluctance to start phase 2. They rely on new purchase deposits to carry on building. Obviously sales are poor at the moment so they are pulling in the strings to cut their costs. Thats my opion any way. My place is complete in block 6 but I am not completung till all these problems are sorted out.
I may be a bit dense and I must have missed the posting but what is the pool built for the appartments?

We are in block 6 too and we are waiting for the LPO to come through before signing.
The pool for the appartment block - the one block that is different from the others on our row - has been built at the end of their block, where parking is shown on the original plans. There are photos on here - see 47786, 61024, 46631, 3533 and 7038. It has even been filled with water which surprised me as they normally wait until building has finished so that it doesn't get dirty. Is this an indication that the leisure facilities are not about to be built?

Thanks for that. I too am waiting for the LFO because times as they are you can't take any chances. I wish I had bought re-sale now, at least you know what your getting and what facilities are available.. My solicitor does not appear to be in cahoots with Taray or Parador so hopefully he will come back with a sensible answer.

We too are glad that we are not the only ones who have had difficulty getting any straight answers re the pool. We got two different answers from Sales and customer service. Like suggested, when we visited in February, we went to the the sales office and brought up the issue of the pool on phase one while Teresa was in the middle of one of her sales pitches to potential buyers. It was not taken kindly and we were very firml;y reassured that " of course the pool will be built" but to consult with customer service on the details. We persisted and were told by Teresa it would be November and were curtly cut out of conversation. Helder in customer service told us the same day that there was no definite time frame for the building of the pool. Our solicitor meanwhile has assured us of the integrity of Taray but as yet nothing can be confirmed in writing. Surely if the brochure shows and descibes a pool area and it dosen't materialise then it is false advertising? We intend to e-mail customer services and keep doing so until we get some answers. Everyone should......

hi all, so there is no answer about the pool and the other pool is only open for 2 months of the year and my solicitor is talking about us going to court as there is nosign of any pool being ever built we have not completed on our sale and have no intention of until this is sorted are anybdy else in the same boat.
i was assured by toray that the pool would be completed by 2008 at the latest and that we were luckey that our penthouse was in block 7 as all the amenities would be completed by then
i am not a happy camper and i have no intentions of letting this go or completing on a unit tat is not wat i bought or wanted. its false advertising and luckey for us we are covered under eu law which is very clear about these sort of matters.
hope somebody from toray is monitoring these posts as you have picked on the wrong group of people to try and con.
that is an excellent idea to ask them questions in front of the reps i would say they will give us an answer very quickly

My sentiments entirely.
I have asked my solicitor to see if Taray are in breach of contract.
I am in block 6 Penthouse and have no intention of completeing until it is sorted out.

Last week we came over and took possession of our quad in Manzana 5. We met with Teresa from Taray when we handed over the final payment and got the keys. On leaving I asked her about the concerns with the pool issue and she is very aware of this issue with buyers and residents. She explained that she is on the case and constantly onto the local council who seem to be very very slow in resolving this matter. I asked her point blank if it was going to happen and she said yes, hopefully this summer but because of the way the local council is dragging it's heels that it would be more likely to be next year. Not good news for anyone really.
