dear pete and jonty,
wake up and smell the coffee.. if i wanted a beach i would have bought at a beach i wanted sports facilities and a pool so i bought where i was told they would be. you do realise that the price you paid for your place reflected the facilities it was going to have.
there were cheaper options available but they did not have the facilities that san caytaneo had. that is why i bought there and that i why we bought two properties there i can assure you that we spent a lot of time looking around and were generally impressed with toray i want to be able to use the facilities and it is our plan to spend a lot of time there as we have young children. we are not just trying to wiggle out of an contract but when you buy something you do want what you were promised. according to you both you would be happy to buy a car with no wheels once it was the right colour for you.
toray have promised a lot of people that the pools would be built by now do you even not think it strange that they will commit to no date or supply no information about wat is to be built???. then do you not even think it strange that the land that they are going to build on they do not even own? surely even you both would think there is something slightly off.
it now appears that the only way the pool etc is going ahead will be from pressure from people who are withholding their money. these people are not trying to wriggle out of contracts like jonty suggested they would be i would say like me having worked hard to pay for these buildings and now are finding out that something is not rite.
my suggestions to you both is to start your own thread to slagg off people who only are pepared to pay for something that they are going to recieve.
or perhaps you can come up with suggestions how i can transport 3 toddlers to a beach without driving there????

I have also completed on my property, but i want what i paid for, and not a piece of wasteland. This is a serious issue for a lot of people, and they should be supported by everybody who has already completed. Taray already have our money so they are not going to take much attention of us. I think its the people that have not completed will get more attention from taray, as they want their money, so lets all support them and not have this wait and see attitude.

There is to be a meeting next Friday regarding the pool to be held at the pub in the village, One of the Spanish residents has a relative on the council in Murcia and he has been setting it up so we could have more information for yo later

To anyone in the same possition as me. We paid extra for a quad due to it overlooking the pools and sports facilities. It's now possible that we have paid extra to overlook a patch of wasteground. I don't think so!
Taray have just written to us stating that our quad is complete and requested we contact our solicitor to arange completion. I have told both my solicitor and Taray , No POOL, no completion, No FLO, NO completion. The reply I recieved is below. But they won't be getting another penny till I get what I was promissed.

We can not apply for the First Occupation License until all the works are finished, so it is going to happen and the end of this month, and then the Town Hall is very slowly with the paperwork so I think that at least after summer it is not going to be granted. But we are signing everyday title deeds with clients that have mortgages without the License because it is not neccesary.
On the other hand, the swimming pool and sport facilities are going to be built in the land that belongs to the Town Hall, so they have to decide exactly what and when it is going to be built. We are just waiting them to decide, we have everything prepared, but in this matter we depend on them. Sorry, but at the moment we do not have more information, but we are trying to achieve thit objective.

It sounds like you are in a very good position and I can't fault your approach with Taray. Their statement is very non committal and leaves the decisions with the council and they could build anything there from a pool, like the municipal one they have built in the village (not very nice and only open 2 months of the year) or leave it as waste land for years, who knows.
When we purchased ours they were very specific about the facilities. At no time did they say "here may be a pool its up to the council"??? We would not have placed a deposit if this was made mention of. We feel mislead and I am sure many of us feel the same but good on you for what a stand you have made ! and the past four or five comments on this thread all get our support HERE HERE !! VERY WELL SAID FOLKS!!!!

I don't know what it is with Taray.
They sell us this swimming pool and sports complex that they are going to build and finished by September this year.
Then all of a sudden its council land, the councils problem and the councils decision. This will drag on a long time.
Not what we signed up for.

hi all,
yes as with tony we have refused to sign on our penthouse and bunglow underneath. as i previously said this resulted in taray rep then phoned us every day to advise us to the update with the council, but i have no more information than anybody else.
we have been on to our solicitor and he was writing to taray and had given them 7 days to reply so we should be hearing something today and we will certainly let you all know what he is saying.
but as far as i can see taray do not know if or when the pool will be built they cannot confirm anything as they dont own the land. again i would stress to people who live over there that not everybody knows about this site so there are people completing who know nothing about this issue and as from what we can all see taray seem to be only responding to people who have not completed. Tony is correct we have all paid a premium for these facilities and we want what we bought. at no stage was it said to us that there mite be a pool but it was up to the council.
Can anybody attend the meeting and report back to us on what is the outcome. so far we know the following.
1. the land set aside for the pool and sports complex is not owned by taray it is under the ownership of the town council (so we dont waste anymore time checking this out)
2. We were all sold the pool and sports complex and we were all told it would be up and running by 2008 (some of us still have brochures etc backing this up)
3. All the solicitors seem to be working in the same direction but would it not make sense to get one good solicitor to act for all of us therefore pooling our resources?
as i said before we are not looking to get out of our contracts unless we have no option we love the site and the town etc but this really has put a nasty turn on events, we had hoped to be able to go over this summer with the children and instead we have just booked holidays elsewhere whilst taray enjoy interest on our money.

Forgive me but I'm new to this!!
And this is not really a reply.
To put you all in the picture - Sara (my wife) and her mum did one of those 'free trips' to Spain a few years ago and came home with 'this is the way forward, let's buy a Spanish property'. So having never seen the place agreed to go along with the idea. Paid the deposits, read with interest the progress reports. Then left the rest to the ladies to sort out, mortgage, furniture etc.
Well it didn't happen and I have just been asked to assist in sorting out the mortgage.
So that's the history.
I thought I'd just enter 'San Cayetano' in the search engine and hey presto found you guys!
Now I'm concerned, "wot no pool"!, not owned by Taray, oh dear.
So what should I/we do now?

Hello everyone
First of all in responce to the last entry. Myself and my family used the pool by the school last summer and can only describe it as 1st class, very clean, very quiet and best of very cheep.
Anyway, back the the important stuff. I've just recieved the below reply to my refusal to complete until given definate dates for FLO and pool complex.
I think both questions were answered in my previous e mail but anyway I answered you again:
1) The License of First Occupation, has NOT BEEN GRANTED, we are going to apply for that next week and then we depend on the Town Hall, but as I explained to you it usually takes a few months. As I told you, it is not a requirement to sign the title deeds, because we will give all the properties free water and electricity supplies.
2) We are definetely going to do the swimming pool, but as I told you we are just waiting the Town Hall to give us the instrucctions that we can start.
On conclusion, both things depend on the Town Hall so unfortunately I can not give you exactly dates.

hi tony and all,
god how many ways can they say this. i will not be signing completion like yourself until we get lfo in place and also a set reply in relation to the pool. Our solicitor has contacted Taray and has had no reply.
Its a bit of a joke at this stage i know there are many of us like ourselves that were all ready for the purchase at the start of the year we have mortage set up and everything on standby and then this is holding us all up.
we all just keep repeating our selves and we are getting no where.
when is the meeting taking place with the town council will anybody from here be in attendance and be able to answer back to all of us??
to M & S dont panic yet i hope would be the message i would relay i cannot see how taray will get out of this we are all singing from the same hymn sheet at this stage so something will have to be done by taray in order to get us all to complete.

So is it a misconception or did nobody read their contracts before signing them at the soliitors?
I still don't see that there is anything that can be done yet. If we put our trust in a Spanish lawyer and believe that the "fact" of a pool is written in the contract without being able to read the contract, how can we all be making such a fuss now? Personally, I think all you moaners all have a "selective listening" problem that you should see your GP about.
I have consistently had a cynical attitude to all that I have heard (from all parties who have had an interest in selling a property to me) and have no misconceptions about the pool, sporting facilities etc. Although I wish they were already all in place, I am not panicking. My solicitor has, at all times, made everything clear to me and I believe that Taray have been honest and have told a consistent story throughout. Those of you shouting the odds in this thread probably should never have bought in the first place.

I don't think we have selective hearing I think you have Rose tinted glasses.
We were all sold a Sports complex and pool as you were. It does not have to be stated in the contract to be legally binding. We all have the brochures and DVD clearly stating these facts.
You obviously have not read this thread because we have all been continually lied to by Taray. Not having these facilities will not only knock thousands of Euros off the price of the property including yours) but also deprive us of the facilities as to why we bought here.
We all live the dream so don't say we should not have bought here. Its just our dreams are different to yours we expect what we paid for.
Would you buy a car and then when they deliver it they say sorry no engine. I don't think so!!
A very large group of us are fighting for something that is rightfully ours and will benefit everybody on sight.
So leave us to it.

I believe the pool, etc WILL be built, but that now is not the time to be wasting energy on it.

Debbiemoth, Do you work for Taray ?or had you just been drinking when you typed up your last post!! If not why not try the PM link to email your opinion to your friends, we are trying to seek collective support and actions here, and only constructive facts are going to help those of us that really care and will address the problem. It is not like buying a bag of crisps then being a bit disappointed because there's a hole in the bag and they are soft!! We stand to lose about ten thousand pounds and I have not got it to waste not without a fight first.
