Hi All
we are dissapointed that the pool has not appeared yet but are still quite confident that it will ( Iwe may live to regret saying that) but after several holidays on site we feel it would just end up full of dust and rubbish if they had already started on it because of all the building going on, have you seen the state of the one by the apartment block? lets all try to be positive its a great site and location, we have been really pleased with the build and finish of the surrounding areas so far, we understand that it is a priority for a lot of people but there are so many beautiful beaches with miles of sea and sand not too far away.

i know the site is lovely etc but i am just now very concerned that the pool is now in the hands of the town council and not toray. i have 3 toddlers so for me to get them all packed up and down to a beach was not the option i was going for this is why we did look around until we found the site we wanted and we thought were we bought was perfect. beside a town with shops for all the necessities really nice walks, and the main selling point was a sports complex and a pool.
i live right beside the sea in ireland so i really do love a nice beach but again i have twins aged 2.5 and a girl aged 15th months so i could not manage to bring them all down to a beach the whole idea of us buying there is that i would be able to go over with my husband and he could return home and i would be able to manage them there so you can see now how a pool on our doorstep was an essential part of the package.
if the pool was being left to the last minuite to be built fair enough but then toray would surely be able to give us all a date after all this was their excuse for no pool for 2 years its only in the last few months that this has totally changed to suddenly the pool is nothing to do with them and its totally up to the town council if and when they build a pool.
dont know about anybody else but i feel as if toray are trying to pull a fast one

I agree with you Finn.
When I purchased my Penthouse I was led to believe that Taray were building the pool and sports complex.
Then all of a sudden it is the council.
Now nobody knows when it will be built.
I am going out tomorrow for 10 days and will try to get to the bottom of it.
I will not complete until that pool is built as for me it formed part of the contract.
I will post on my return.

I am exactly of the same opinion as Irishfin and Laserman. The complex is key to my buying onto the site fo the same reasons as yourselves. I will not pay any more money without confirmation of a completion date for the leisure complex. I have emailed my solicitor but had no reply so look forward to any info reported back through this forum.

Good on you all for putting the pressure on we are in the position that they have our money and have already completed so any suggestions as to what we could do to offer support would be welcomed. We were over there last week and must say the building equipment needed to excavate and build a pool was nowhere to be seen.

Hi All
Ist day in Spain today. I am staying in Dreamhills up near Torreveja. Weather is absoluteley fantastic.
I hope to get down to San Cayetana later this week and will try and get some answers about the pool.
I suppose I will get fobbed off but will give it a go.
Will keep you all posted.

I was due to complete on Manzana 5 in March, due to an unplanned baby, I was forced to buy phase 2 which I was told will be completed in June 2009. I've paid 30% deposit around £42,000 which taray refused to refund me and Parador Properties did'tn want to back me up in getting my refund. Between the solicitors, Taray and Parador I was left with no choice but to down size and wait until 2009. taray is earning alot of interest from people like us and from what I am hearing, work has not started.
Rang Parador Properties but no news as to when the work will start. The solicitor can not confirm anything as yet. Does anybody have a similar experience? Is there any way of getting my deposit back?

Hi, sorry to hear this, i have heard taray can not start phase 2 until phase 1 is complete and as there is a lot of problems regarding the pool i dont think it will be any time soon.

Does this mean you have lost your deposit on the phase 1 property or has this been transferred to phase 2?
The penalty is usually 25% of the purchase price excluding VAT.
I am going down to San Cayetano this week so will try and get news on phase 2.

I've managed to transfer the money on to phase 2 but with all the problems encountered on phase 1 and the credit crunch it's all doom and gloom at this moment. But if phase 2 is suppose to complete in June 2009 as I am told, maybe there might be a way out for me. Thanks for replying anyway.

The following is an e-mail that i got today from my agent from her lawyers.
Dear Clients,
After the conversation kept yesterday with the councillor of the town hall of torrepacheco. in charge of urbanistic affairs, he has confirmed to me that the ground where taray wants to build a swimming pool and sports facilities is reserved and assigned to the town hall.
So the town hall is the one who has to decide what it can be built on this piece of land. At the present moment, they have had conversations with taray regarding the matter, but nothing firm has been agreed. Everything will depend that the town hall considers the swimming pool and sport facilities can be useful to the town in the area San Cayetano.
Obviously some kind of agreements will be required between the promoter and the town hall in order to fix the management of these installations, and how the maintenance costs will be paid between the owners in Hacienda San Cayetano, and the rest of the population in the area. At the moment the councillor is unable to give us a concrete date.
Looks like we have been had by taray.

Taray has mis lead and mis advertise, so we should all try (THOSE WHO HASNT COMPLETE) to get our deposit back. Any chance of organising a legal battle with Taray?

Hi Tomvoron i am in dublin too, i would like for all of us to get together and take legal action against taray, first we have to get legal advice from a spanish solicitor before we go gunho, just to see where we stand with spanish law. I will talk to my spanish solicitor and see what he says(i dont know if he is any good) i would suggest you all do the same and see what they all say only then we can pick a good one to represent us if we have a leg to stand on.

I was down in San Cayetano yesterday.
The Taray guy in the office told me the council will build the pool but it could take upto 3 years.
I also spoke to a few other people who are out there and they believe the pool will not be built by the council and that Taray will end up building it.
If the council did build it. Would this mean it would only be open 2 months a year.
When I bought my place I was lead to believe Taray were building the pool and complex and it would be ready by September this year.
At the moment the site for the pool is being used as storage for all Tarays plant and equipment.
I am hoping to see my solicitor while I am out here so will keep you posted.

Its our belief that we all need to formulate a method of dealing with this problem! We, like you, all purchaced this property above other deveopments ... a pool was on our essential criteria for us to be able to enjoy a holiday home. Very Importantly we paid 20,000 euros more for a home on this Taray site than on the alteratives, one being United Golf 97,800 euros plus tax which had all facilities, lets face it would they get away without building a golf course??. Why should Taray get away with not building our leisure complex!! Like you we have paid for it ! We should all be outraged, and collectively take them on and win! I A pool is what we have all paid for why should we put up with waste land, maybe youth clubs or worse, instead of our leisure area. If you all look back on this post you will read that they have pulled this stunt before.

If you look at the recent thread that i have posted, you will understand why i am starting to get get really pi**ed off. The only people that i see writing about this issue are the ones who are waiting to complete on their properties, or those who are using them for holidays. What do the people who are living there fulltime have to say about this problem, does it not bother them. Fulltimers respond.

Well said Tom! why not take things a step further and start a thread for FULL TIMERS ONLY ! (if you feel that special), we like everyone else have paid for our properties and have every right to share our concerns on this thread regardless of if we are using our property for our retirement ,family holidays or indeed still waiting to complete.We all expect what we were promised by Taray. I feel mislead and don't care how p***ed of you are that others may have their own opions, further being a resident I would have expected a more community lead attitude.

hi all before we all lose run of ourselves full timers out there and part timers etc as far as i can see its the people who have completed and paid cannot get any answers and i know as one contacted me by phone they asked me as i have not completed and toray are waiting on my money that maybe i am in a position to get some answers this is the reason that i am suggesting to people not to complete not transferring your money is the only thing that is going to get some response from toray you are going to hit them where it hurts.
i dont think it matters if you are there full time or not we were all sold the idea that the properties would have a pool and sports comples and i am sure we are like everybody else saw cheaper but this development was complete with more things ie pool and sports facilites we cannot start slagging each other off we have to all work together and fight this i really think if you got a group together that have not cocmpleted along wit those that have and look at legal action.
surelly they cannot get away with this it is blatent false advertising under eu law. it was not an artist impression we were told the pool would be there when we completed
we need to all get together on this and start stepping this up
