I can answer some of your questions
When you sign for your property you will be given the free hold for your property the only time it is different is when more then one property in built on the same plot 'ie' apartments this will be issued as a flying free hold.
The LFO's the first area has its LFO's now and are being changed over to the main suppliers and off builders supply.
The council inspect the site every 6 months and demand any changes they feel are not in-keeping or strayed from the original plan to be changed immediately so if there was extra buildings on the site I would it would be corrected, that is not saying that agreed changes with the council are not made.

The meet in the pub I understand it did not go ahead if it did I have not spoke to any one that went to it
The meet with TARAY was OK but no real answers Taray explained that that requested permission to build the in the area of the spots and pool over 9 months ago but there has been a extraordinary delays in any of there request over the last year with the council
Taray have allowed the use of the pool along side of the flats until the permission is give
Taray say they are committed to forefill the sports and pool area but the time scale is still in the hands of the council,
Taray also said that if the permission takes to long they are willing to build a pool on their own land as they will not need the councils consent but it will be along side the sales office ( so the question that was asked does TARAY own the land for the pool the answer is NO)
There is to be a second meet in a months time plus conformation of what Taray have said and promised.

Same old story from Taray lets blame the council.
The pool by the flats was totally unusable when I was out a month ago.
A pool by the sales office is of no use to me. I bought my Penthouse so it would be right by the pool. Not a half mile walk.
Did they say anything at the meeting about the Sports Complex?

well said laserman, we have four children three under 3 years and don't fancy a long walk to the other side of the road to the supposed pool, where will they suggest next ( on the roof)

Did the council turn up at the meeting?
I thought they were supposed to be there.
The question I asked earlier about the sports complex just to clarify.
Taray said they were committed to building it but did they say exactly what they are building.
Did Taray put any of this in writing.

Hi everyone,
On a positive note, just thought I would let you know that we have friends at our quad at the moment and they have used the pool by the flats without any problems. We are going over in two weeks - can't wait.

well all
weeks have passed and we are still no further. Now builders holidays etc in spain. here we are booking our holidays
for somewhere else. any body else agree what a waste of a lot of money
have thought about this and we are now going down the legal route to have our monies returned
i am very dissapointed and despite what earlier posts have said i am not making this decision to wiggle out of a contract
just so fed up at this stage.
surely if everything was ok then taray could have gone to that meeting with firm dates and commitments to us
but no more of the same old story. I love the development and the surrounding area but i cannot short sell my self
i would not be happy without all the facilities promised i would constantly feel as if i was done.
i have worked too hard for my money to line somebody's pockets who i now feel is laughing a me.
if anybody else has or is thinking of going down this route can you please contact us as we need advice or would be interested in joining you and maybe splitting costs.

We are exactly of the same mind as you......right now we are going to cut our losses and try to move on. We are dissappointed and can't believe the money we are going to loose....we have paid a 30% deposit and only stand to get 25% of it back.......the dream has disintegrated.........and I believe the development is complete on phase 1 with regards to the houses.....we are gutted but at this stage we are just trying to get something back. We have just spoken to our solicitor this morning and advised her that we are not going to complete and to try and retrieve as much as the deposit as possible ...........she is of the opinion that we will not win any court case against Taray for a full refund and thinks we are losing by not completing and will lose a substantial amount of money....at this stage if we get anything back it will be a bonus......its an awful situation and we fell in love with San Cayetano and the area.......the shine has gone.....and along with the way the market is everything is a lot more dicey e.g rental and resale..........What stage are you at with regards completing? Do you know of anyone else who has not completed and what was the outcome?
Our solicitor is forwarding a letter from Taray confirming a committment from them with regards to the pool....I will forward it to you when we get it if you would like....really mixed feeling s now and my sister is in Spain at the moment and has visited San Cayetano and says its lovely....dosen't help....

Did you mean you only get 5% back not 25%. As I understand the contract a penalty of 25% is payable on cancellation.
Don't just believe your solicitor about not getting your money back. There have been many cases where developers have not provided the facilities they promised and lost. A considerable amount of solicitors work hand in hand with the builders so get a second opinion.
Is your property ready? Has the LFO been granted? Have Taray demanded their money?

hi all,
still no more information and no more comfirmations. i was interested to read in other peoples postings that they seemed to be well aware that there was going to be an issue about the pool back when they were buying and that they were under the impression that the pool would not be started until 2009.
i am beginning to think that i imagined the whole sale pitch i was given by toray when i bought back in 2006 about how lucky we were that our premises would not be ready for 2 years (2008) as the sports facilities and pool would be completed then?
was i the only one ?

That is exactly what we were told. We actually bought this property because we were assured everything would be complete when we signed for the villa. We turned down a much cheaper and bigger property because we didn't want to be visiting when building was still ongoing.

glad to hear i was not the only one. Just when i read other peoples postings about all of us moaning and how they were all aware about the councils involvement etc i began to think i was the only one.
i wonder will they thank us if we are successful and get the pool built or will they be upset that they are actually getting what they paid for??
everybody seems to be on holiday at the moment in spain can anybody advise if the lfo have been granted yet for our phase??

We signed the contract for our property at San Cayetano in March 2007. When the original deposit was handed over (3000 Euros) we were told that the pool would be built by the Summer of 2008. This was confirmed by Antonio who was, at that time, in the Sales Office on site.
At no time was there any question about Taray completing the site as promised in their video and publicity material which included the map of the proposed site. A Spanish solicitor has confirmed via Eye on Spain that any publicity given at the time of sale forms part of the contract!
All of us who expected the facilities of the pool, club house, driving range and tennis courts to be built must fight for our case. This is to let you know that we are now taking legal advice is this matter - as this is a clear case of misrepresentation.

I think your summary is spot on! and a very fair point of view. We also are fair minded people and like many others we have paid out our lifes savings into this home in the sun. it is very unfair if we don't get all that was on the illustrations. When we paid our money that was exactly the promise of the site specification. Taray have said they have had problems with planning, but to be honest they have not offered any compensation. We feel that 20,000 pounds would be the sum we would want if we were to have a residential property in Spain that has no green areas pool etc. After all we did want to rent ours out to friends for holidays,but lets all face it ours is a village in Spain 20mins drive to the coast and resorts not many peoples idea of a good self catering holiday location. At the meeting Taray said they would be putting things into writing for us all I have not had any letter from them perhaps everone else has?
The one and only time they did write to me was to tell us the property was complete and ask for their money. As far as I am concerned its not complete without the large swimming pool that was in the plan.If we dont get this I would like to join a group of like minded people and share the costs of collective action. All our disputes are exactly the same with the same party for the same reasons, so I for one pledge my financial support to such a small group and ask others to respond who wish to be counted in. We can then research a the best law firm and employing them should not be as expensive as a sole venture..........Names please of interested people, we have to start the ball rolling somewhere

I echoe you view point exactly Widds. The only letter iv had from Taray is asking for my balance and iv duly put it to the bottom of my in tray! My solicitor is non responsive so the only support Im getting is from you folks on the forum.
