hi all yes there is a real live plonker in our midst and i dont't even have to see my gp to make that statement!!!!

to answer debbies question yes i can read and listen as well in fact i am multi talented i can even sense when i am be sent down a garden path by somebody whom i think is probably in the employ of taray.

to all of us who believe in getting what we have paid for is anybody going to be able to go to the meeting next week (apart from debbie) i think its on friday, just i have a christening on the saturday or i would fly over.

i like you all would just like to know what the hell is going on and try and get this resolved asap as with a lot of people we have nearly everything arrange and this is really p**ing me off at this stage .

We are over there from Thursday 24th So if we know where the meeting is we will go and report facts (or whats said ) directly back to you.  If anyone knows the details please let us know so we may attend and  become your eyes and ears..ps we know what the score is so you can count on us.......... There is to be a meeting next Friday regarding the pool to be held at the pub in the village, One of the Spanish residents has a relative on the council in Murcia and he has been setting it up so we could have more information for yo later

Next Friday - would that be 18 July?  Or would that be 25 July?   Pub in the village - would that be the Rose and Thistle?  If the meeting has already taken place, would someone whe attended please post any news for those who can't be in Spain at the moment.

Although we are disapointed that the pool has not yet materialised I agree with Debbiemoth that the information that we have been given from Taray each time we have asked about the pool has been consistent, in that they dont plan to even start until late this year, now whether you think we are looking through rose tinted glasses is in fact your opinion but we are not panicking yet and are not letting this spoil the many holidays we have enjoyed there in the last 12 months since we completed.

I was out there last week and visited the Municipal pool which is very good and has all the facilities you could want I admit there is a cost but I think this is minimal having the convenience of a pool on your doorstep until ours is completed. Please dont think that everyone shares your view on being so negative towards Taray, lets face it I have been on sites where there are pools and people dont even use them!!!!!!!!!

not the point use them or not most people  who bought in this develement have children or granchildren , i can see it now  hi kids lets go to spain to our place , but sorry there is no pool and no where to play, but you can go to the beach when grandad get his driving licence. when they get back they can tell all there friends what a wonderful holiday they had and how they will do it all again next school holidays.  I think even the older kids will cop on that we were riped off. (even if some of the adults don't)

I think what has upset me most of all is the gradual shift of information from a communal pool (paid for by owners) to be open in Summer of 2008 (which is what we were given to believe when we signed up in April 2006), to the municipal pool (run by Taray for 30 years and then handed over to the Town Hall) to be open by the end of 2008 (information supplied by agent in August 2006), to the current information which is a municipal pool (owned and run by Town Hall, possibly not even built by Taray?) to be opened at an unspecified time in the future.  As far as I am aware, the sports facilities and pools have always been planned to happen but it is the way that they are made available to owners to use that has changed considerably.

Julieanne - reading your latest post on this thread, are you under the impression that the pool will be communal and financed by community fees when the Community of Owners is set up?  

It seems that people still have not been told that the pool and other facilities to be built at Hacienda San Cayetano will also be municipal and on a similar pay-per-use basis.

Yes we are under the impression that it will be a municipal pool and on a pay as you use basis, which suits us fine as it keeps the urb fees lower. It also simplifies insurance and liability issues should anybody ever be unfortunate  enough to hurt themselves whilst using these facilities.

If you want to see the hassles with a communal pool just take a look at the Balsicas pool issues!!

Alfin There are several areas on site for the children to play on at the moment, the park areas and play facilities that they have provided already are great and very safe, there are also 3 similar areas in the village.

Hi Julieanne, your missing the point here , my kids can play on swings ,slides ect at home but they can not swim out in the open because it is too cold, the reason for a place in the sun is because you can swim out side and it is warm, so what did we do we bought a place in spain with a pool for this reason, and guess what now, no pool.   so i have to except this, ''i don't think so''

julie ann etc yes i am sure the current municipal pool is lovely but it is open for 2 months of the year as far as i am aware now this is not what i want it might be ok with you but not with me.

i love swimming and i believe in teaching your children to swim young very strongly so i will certainly be using the pool and again to go over and over this point again that certain people keep missing I BOUGHT IN THIS DEVELOPMENT BECAUSE THERE WERE GOING TO BE TWO POOLS OPEN ALL THE YEAR ROUND AND ALSO A SPORTS COMPLEX THAT WOULD HAVE FACILITIES FOR OUR CHILDREN AS THEY GREW OLDER.

Hope this clarifies this for you

We have recently received this from our solicitor with regard to the pool;

"the pool which will be built as part of your urbanisation will be for public use and will be built in a public area owned by the Town Hall, on or next to the urbanisation. The construction of the pool should be starting soon once the Town Hall has provided Taray with the building license to begin work. However, Taray is unable to provide a date when this is likely to start or when it will be finished"

It is all resting on the Town Hall and, as this is Spain, all things move alot slower then we are use to in the UK ! but this slower pace of life is what some of us are looking for.  I agree you wouldn't buy a car with no engine, but that's the gamble of buying off plan . San Cayetano will be our permanant home and we leave the UK early September. Part of the attraction was to live in a semi rural area, but one that had good links to airports, shopping, beach etc. and we are looking forward to it greatly.

I do feel that some of the comments made on threads, regarding this matter ,have become unpleasant. It is everyones right to have, and voice an opinion but lets keep it friendly....after all we may be living next door to each other at sometime in the future !!

Hi All

This was  reply from my lawyer i wonder if she is right about the town hall?


Yesterday Teresa told me that they were going to build the pool but they were just waiting for the building permit. 

 

After that, I send an email to her asking for a copy of the application of that licence, so she admited us that the pools has been planned in land that has been assigned to the Town Hall in the Urban Plan. I know that sometime ago,  promoters like Roda built the Club house on land that was assigned to the Town Hall, but  I don´t think that Torre Pacheco´s Town Hall is going to accept  that private pool in his land  because they already have more problems that they can handle because of the sale of land to Polaris.

 

                                                                                                                                                                                                                                                                        I have demanded a meeting at Taray to discuss the situation and to see the project sudmitted to the Town Hall.

                                                                                                                                                                                                                                                                                                                                   If we are right and there are not many chances to get a private pool for the urbanization, the clients will need to decide what to do: 

 

  • Resolve the contract ( I can see good chances to win a Court case if they do not accept resolution) and get the money back.
  • Continue with the purchase  but  not completing until they will build the swimming pool ( obviously taking Taray to Court later asking  for compensation  for rentals, interests paid in mortgage for deposit.....
  • Complete on the property and join the other residents in a common lawsuit against Taray.
  • Negotiate a reduction of the price because of the swimming pool.

 I will inform you of any news and appreciate if you do the same.

Hi All

Have you noticed that Taray never put anything in writing. If they did I'm sure it would say "Without Predujice" at the top.

The only information we get is verbal or through solicitors.

If anybody has anything in writing from Taray let me know.

As we all know most of our chosen solicitors work with Taray anyway.

Lets all not lose focus. This is not just about a swimming pool. Don't forget the sports complex.

All we want is what we paid for.

At last Taray with the council have said there will be a meeting this coming Monday at 1:30 out side of the sales office,  Taray said 'to talk about the building of the pool' I have not heard of any thing about sports section so see you all then its been a long time coming and after lots of meeting that have never happened, but it is Spain.

  in  the meeting with the town council could someone
  clarify with them
  a) whether our houses are on legal land built by taray or does the land belong to town hall . Also Is taray building the designated amount of houses permitted by the town council and no more? 
  b) why the area of land for the pool and leisure facilities belongs to the town hall when taray advertrised  as though the land belonged to taray
  c) are all documentation in place for completing including L.F.O
