hi everybody
we bought our property through parador properties , i have just rung them and spoke to someone called vicky and informed her that what we were sold has not materialised ie pool etc have asked for clarifaction as to when the pool will be built etc she says she will get in touch with taray and see what she can find out i wont hold my breath as they have already had our money so they wont be bothered but have stressed that a lot of people are not happy and what they are selling is misleading we want answers now not in ten years time , if you look on the sales websites for san cayetano all the others are saying communal pool sports complex etc .

hi have been in contact with taray on the phone and they are having a meeting with town council i presume today and will be back on to me tomorrow with the latest.
as far as i am aware they dont even own the land the pool is going to be built on so cant really understand all of this messing around why dont they just go ahead with a pool on the land they do own.
as i said from the very start of this thread all the people who have completed cannot get a straight answer so i would reallly stress to people not to complete until this is resolved the only way is to hold back on the money this will get a response.

every single house on phase 1 is done just bits and bats to finish and the cranes gone.
So now would be the ideal time to build ??????
Even if taray get back to you i wouldnt believe a word they say any way.
It would be good if we could arrange a meeting with taray and all parties who are willing to hold back.
I know it would involve flights etc for people in england but in the long run it will be worth it.
Because lets get straight to the point who would want to buy a resale here with no pool.
taray will be looking at this site reading all this so im sure they will get the message
over and out

place also pool and leisure facilities. have written to danil services our solicitor concerning
from all of this but have had no response as as yet. if the pool land belongs to the town council
eirlys could it be possible that our properties have been built on land owned by the council????

Dear all
By mis-advertising, taray has ensure buyers like us rush to part with our hard earned money to start this project. Obviously some builders think we are a bunch of idiots. even if they held on to our monies and then having to compensate us several years later, does that mean we are going to get the interest back as well? This pool scenario is putting me right off from buying. I can' see phase 2 completing in june 2009 if building hasn't started as yet.

Last month Taray told me the first properties in phase 2 will be ready in October 2009. So we are now looking at December 2009 at the earliest, if planning is granted this week. Dont hold your breath.
Taray have been constant liars / changing items through out my communications with them. Get any thing in writing and have penalty clause written in if Taray fail to deliver. Taray will only respond to being hit in the pocket legally.
If it is a breach of contract by Taray then the threat of several people using their Bank Guarantee might get them to listen. Even then Taray will know it will cost 3000 euros and 9 months minimum to present the BG.
Vindaloo26 - the 120 days is a contractual date by which Taray must start building after they have recieved planning permission. ie if planning is granted this week as Taray say it will then they must start building by end of September, or Taray are in breach of contract.
I still believe Taray have had no intention to start building phase 2 until phase 1 was finished, therefore lying to every one for 15 months.

Thanks Colin, I can't see Taray completing the build in June 2009 but I could be wrong. I transferred to manzana 9.1. granted the build quality is good but they are compulasive liars telling you what you want to hear. I bought on the basis that there is going to be a pool leisure centre etc. not concrete jungle. I could have gone elsewhere in 2006 and purchase something much cheaper or even turkey cash since it was cheap at the time.

Hi Guys
Lets face it. It is no good talking to Taray, Parador, Parador owners club or whoever you bought from. All we get is mis-information.
What we need to know is where we stand legally. So all sit tight I am seeing my solicitor this afternoon and will be asking all the relevant questions.
Then we can plan what to do next.

dave i think its the right way to see where we stand legally. I have been speaking to rep from taray today and he confirmed the some sort of pool area will be built by toray when the town council tells it to do so.
He cannot say when this will be it could be next year it could be in ten years, they cannot say what facilities will be in this building only that there will be some sort of pool. sorry i have not any better news how can they not know what facilities are going to be in it as they could when they were selling them to us.
we now need to see where the legal team advise us to do.
hope you have good news for us later 3000 and 9 months does not sound too bad to me when they have such a huge amount of our money for nothing

I dont know what brochure you have with the plans on but the one we were given is showing the apartment block quite cleearly and states that this area ( in the shape on a letter H) was intended for apartments and that is just what has been built, although it does not show the pool which they now have in this block, but you are wrong in saying this block has been turned from a sports facility into a block of flats because that is what Taray had on the original plans so I dont think we have been mislead over that part.

Hi Laserman the map we have clearly show a leisure complex and 2 tennis courts and another court that looks like a small football pitch,. this is what we were sold by Taray, may be another bunch of lies but no need to smart about it, were did you think the leisure centre and pool was going to go then. may be on another site that taray purchased just for us. lol

Yes I agree the map does clearly show a pool and tennis courts and other things, but my point to laserman was that he had stated the building marked out for this had been turned into apartments and that is not true, the H style building is an apartment block as stated on the original plans and that is what has been built apart from the addition of their own pool, in front of that is the proposed site for the pool and other ameneties.

Hi Everyone
I have just had a look at the new brochure for Hacienda Taray at San Cayetano and it still shows the pool etc under 'Primera Fase', (I picked up the one printed in Spanish).
I have also just tried to get on Taray's website and I can't, www.taray.es a meassage says that the website may be being updated.

Hi Guys
I stand corrected about the block of Flats. Somebody on site told me they were where the leisure centre should be but now I have checked they were wrong.
I have seen my solicitor and what we have to prove is that Taray mis sold us the phase 1 on the grounds of the leisure centre and pool. We can prove by the brochure & contract that this is what was offered to us and has not materialed.
I am reluctant to put all the legal details on an open forum as we know Taray probably read this, so if you would like to send me a pm I will forward all the legal options avilable to us.
I will answer your pm´s tomorrow.
Off to catch my plane.

As you can see from the last post, this is what i was sold two years ago and it included a swimming pool and sports complex. If they were not in the picture then i would have gone elsewhere and bought where they were included in the price.

We agree with you Tom, we we given the same plan almost 2 years ago and there was never any question about the pool not being provided, otherwise we would not even considered buying here, as it was a prime feature on our shopping list.
In addition, we were also given a DVD titled 'Wake up in a place of dreams' in which which the dialgue refers to the development featuring swimming pools (not the singular but the plural) and quite clearly shows 2 pools, We were also given a Taray booklet with the same title as the DVD. On the page showing the main plan (the same as Tom has provided below) it refers to, and I quote:-
Swimmimg Pool: A large pool surrounded by gardens where you can sunbathe or lie in the shade . And for the children's safety, there is also an infants pool. It also goes on about the Green Areas and the Sports facilities.
We think Taray must have woken up in a place of dreams when they though that they could just wash their hands of providing a pool and think that eveyone would just accept it,when they had clearly sold the properties with the benifit of a pool.
We are going out in about 10 days time and we have requested our agent to set up a meeting for us with themselves and someone senior from Taray to sort this out, as we have obviously been miss-sold. At the moment we have not had a reply on this but we will not let it go.
We are also very interested to see how others get on persuing other avenues
