going through the figures to me its the 11743.90 7% iva on the 167.770 minus the 3000 we paid for deposit making 8743.90 which is the difference between 167.770 and 176513.90 does that make sense

Well the way I read it you have paid 12,630€ in "B". The 3000 deposit should be incorporated within the deed price. To be fair on that amount of money I thuink it unlikely you will get a knock at the door - possible but unlikely - all the same the developer is knocking the tax office and the burden will fall on you if it gets picked up on - plus the IVA you have avoided and a penalty

You will notice that I have discreetly edited my previous post and corrected the (minor) mathematical error so that my figure is the same as Smiley's! I was only €40 out and I put it down to fat fingers on the calculator.

I didn't know about the 3k deposit paid - sorry if you mentioned it earlier. I agree with Smiley's thoughts. On this amount of "B" it's highly unlikely that any questions will be asked, and it's certainly not worth losing sleep over. On the other hand, it is not legal or correct, and nobody has any right to force you to under-declare. Also, the IVA that you will be saving amounts to €886.90 (unless I've slipped again), which admittedly would buy you a decent sofa, but is hardly worth breaking the law for.

And we have movement on ours as well the solicitor has come back to us advising that the builders initiated the deed price of 167,770 to suggest to us that we may want to save on taxes.

If we want to put the original purchase price on the title deeds we inform our solicitor that is what we want to do and they will go back to the builder and infrom them of our decision

Conrad, I wonder if we have the same solicitors. 

I received a reply from my solicitors today, however, she did not answer my questions, I wonder why? 

She informed me that - 'by now you will have received a new breakdown of costs from your agent which does not ask for a cash payment.  The deeds will show the correct purchase price'.

That was it, she did not eelaborate on anything.  At least it will be legal and above board. 

Jeansis, no you shouldn't have to get on at them, this shouldn't be an issue.  Maybe she felt the force of my fingers on the keyboard as I furiously typed away!!
