The situation is thus so far!
A few months ago we found a property we liked look of on a website , contacted the Agent and they emailed all details etc, said they were asked by another Agent to help sell this particular property as it was proving difficult and that the owner was unreasonable hence why not sold, this by the way is what the `original Agent` told them!
While I was in Oliva I drove to the village to view the house , a lady from the Agency I had been dealing with turned up with folder and details , another woman turned up who it transpires is the `Original ` Agent , turned up with nothing but a packet of fags!
The house was run down , hole in roof but I could see the potential , it has been on the market for 5 years , bats poo inside and overgrown garden etc but still I loved it , asking 180,000 and on my return we offered 100,000, house next door reduced from 220,000 to 199,000 but thats larger and needs no major work , so house we like is going to be a lot cheaper so we thought , especially as the larger house will probably sell for about 170,000 .
The Agent we are dealing with passed on our offer to the other Agent who insists on be there for all viewings but offers no comment , bugger all actually! Our Agent has been doing all the running and the work to date .
Our Agent tells us that the owner is back in UK suffering from serious Alzemeirs ,as told to them by original Agent, the other Agent, who is the only one to hold the Keys told our Agent she has Power of Attorney , another call from our Agent and suddenly its not her its a `Lawyer ` who happens to live in the same block of flats in Forna , Alicante , near where the property is , now how amazing is that , but it gets better , she informs the Agent we are dealing with , bearing in mind she reqeusted THEIR help in selling the house , that she will pass on the offer we made but moaned terribly to our Agent about the loss of Commision to her at that price , to which our Agent told her that at 5% split she would be getting 2,500 Euros , surely better than nothing in the present market and if the hole in the roof is not dealt with the house will never sell but deteriate further with another winter on the way and be worth a damned sight less , its not mortgagable as it is !!
Now , we have no way of knowing that the owners have in fact been informed of our offer as this Agent will not allow our Agent contact with the owners , we can only take her word for it, which we don`t believe for a minute , why has she asked another Agent to help sell the house but not allow them any access to the owners or in fact any details as to who has Power of Attorney etc even the owners bloody name and adress , no contact details at all,, she offers no information at all , only that the owners insist that they will not sell for less than 150,000 which is bloody stupid , now we are told the `son` has Power of Attorney in UK but our Agent can`t talk to him to explain the reasons as to the offer and point out the rapidly deteriating state of the house!
This woman Agent seems very reluctant to allow any viewings with out her being ther , although she does sweet F A when it comes to selling the place, she won`t give other Agent a key , she will not divulge to other Agent any details of ownership , not even a copy of the Nota Simplar , she seems to want to keep everything under her total control yet the poor owners and the house are suffering as owners son cant afford to repair the roof even!
Our Agent has done all they could to try to get her to allow them to pass on their details, she now says that her `clients` do not want other Agents calling them , so she has NoT INFORMED HER CLIENTS THAT IN FACT SHE HAS ENLISTED THEIR HELP and that the other Agent has at least had an offer which in todays market is something , and a cash buyer to boot !!
So , we have an Agent who is tryiong their best but dealing with the original Agent whom no one can check up as to wether she has infact passed on the offer to the owners , one of which is very ill , the son by the way has no money to repair the roof so one would assume that approx £90,000 would come in very handy in UK right now!
We need to find out who the owners are , where they are in UK and confirm they have actually been contacted by their `Agent` with our offer , general belief is that they niether know the state of the house or of the offer as its not going to generate enough `Commission `as far as she is concerned for her , so we think that she may well trouser the sums over the 1000,000 we have offered and tell the owners thats the best price she could get!! Why else would an Agent be so obstructive and now we can`t move forward because we niether trust this woman or believe her when she tells our Agent that she has spoken to the owners in UK .
We have contacted a Spanish Lawyer here in UK but her charges are a bloody joke, this before we have even had an offer accepted !
All we need to know is how do we find out who the owners are and where we can contact them to make sure they are aware of our offer , which our Agent admitted is very fair and realistic given condition of the property , they are so dismayed at the intransience and obstructive stance taken by this Agent ` that we are all now of the same opinion that she is trying to con both potential buyers and the Vendor , the former by stating a higher price, the latter by not informing them of either an offer, state of property and her asking a lot more than possibly the owner had agreed to some years ago !
We would offer more but feel that it would not be in our intersts to deal with this greedy bitch , as another who knows of her described her !
Can anyone out there please offer sound advice as we love this house and just our luck we come across the last of the dying breed of greedy women Agents who are still bloody evil parasites in Spain and just gets a vile reputation for all those decent hard working Agents , this bitch has taken all the fun and excitment out of finding , after 12 years looking ` the house we really would love to buy , but its simply NOT worth what this greedy Agent is asking and everyone else agrees too , its not us offering silly money, its a very fair price as there is a roof to be completley removed etc , new plumbing , electrics etc etc , abou t£ 40,000 worth of work we think !!
Please someone tell us how we can get around this impasse , people like this greedy Agent should not be allowed to work in the Property Industry and I would love so much to get her exposed and shamed , why else is she so keen that no one talks the the owners , goes to show that she is out for herself and NOT having her clients best interestsa at heart at all , meanwhile they are probably in UK wondering why their lovely house won`t sell and probably no idea its roof is beginning to fall in !!!
Look forward to any help , have tried online to get Spanish House registration , even the Castral (minimum price via Town Hall ) but seems impossible , besides may have owners name but may not have UK contact details etc !
Exhuasted and only been back a week !! Hope some one can help , any Bona Fide Lawyers out there?!!!
We do have the address in Spain of the property but not the names of the owner/ owners who are now living in UK .
Keeping our fingers crossed that help is out there , and we can all help to put a stop to this breed of greed and contempt that still some Brit `Agents` seem to offer to the unwary !!
Its only that we have been coming to Spain so many year and met so many assholes that we know a shit when we see one and boy is this woman one hell of one , and we aren`t the only ones either, help us get our house and expose this bitch at last !!
