My wife recently broke her hip whilst holidaying at our appartment in Punta Prima Toorevieja. Basically she tripped on badly kept road crossing.

Is anybody aware of a no win no fee legal approach in Spain?

Carl

Hi, not as I know off  there is no win no fee in Spain and even if there were you might have to wait years for a judgement or a payout.

I am not sure but you may have been able to denounce the local authority?

Sorry not much help.

I've never come across any no win no fee lawyers in Spain.

I have often wondered about this though.  Our street has so many hazards that it's amazing I make it to my house unharmed most of the time.  I often wonder if someone did injure themselves here, would they be able to sue the local town hall?  In fact, if this started happening it would be great, it may motivate them to sort out everything which isn't right.

I have never heard of anyone sueing the town hall for something like this.  One can therefore only dream....

Justin

Try Irwin Mitchell Solicitor but these type of claims in Spain are almost impossible

You end up being told unless you anticipated the fall and brougt a notary along to witness then you have not got a hope - basically the burden of proof on you is too high!!

But be careful as there are lawyer who will tell you you have a good case and ask for money on account of costs etc.

If you have travel insurance then you should have cover there .....

Of course, Local Councils and every administration in Spain has liabilities regarding the effects of a poor management. You need to prove the damage and a cause-effect relationship between the facts that produced the injuries and injuries themselves.

Best regards,

Maria
