I am concerned my family have not transferred the title of the property for 30 years

My family own a flat in Calpe, Alicante. The original owners have died and had no children so the flat according to my mother the ownership should pass to my mum and her sister. My mother has taken over the responsibility of the flat and for the last 30 years my parents have continued to use the same lettings agent. The agent rents the flat to tourists. My mum wants to transfer the title straight into me and my 2 sisters names.
I am so concerened because i believe the lettings agent is taking advantage of my parents, the flat seems to be making no profit in fact a loss, and the letting agent continually request my family to pay the bills. I want to over take the management of the flat, but firstly i am concerened about the ownership. My parents have lost all control over the flat and have no idea of the management.
We need to transfer the title to the property. Is there a fine? Can anyone tell me what might happen?

The first step is to establish who has registered title. For that you will want a nota simple from the Registro de Propiedad. You can get that online. Once you have that, you will need to know whether the registed owners left a will. Is your mother related to the people who owned the property? If not, it is very unlikely that she would have any claim on the property.

What title does your mother own that apartment through? Was there a private agreement of sale?
