We have an owner who has never paid any Community Fees in the 7 years he has owned his place but rents it out full time.
Yes we are taking him through the Spanish Courts & also in the UK but he is slippery as a bucket of eels.
His latest renters are causing lots of problems and seem intent on breaking every Community Rule.
The question I have is could we deny the tenants use of the Community Pool (and their numerous guests) because the owner is a debtor.?

Quick answer....................according to HPL..................NO, you cannot deny debtors any community facility, the only thing a debtor cannot do is vote ( they can attend meetings and have a voice but not vote )
Your Community may even make a 'rule' that debtors cannot do whatever but then your Community would be breaking the Law.
Annoying but true.

ITS so unfair the LAW seems to favour BAD OUTCOMES in SPAIN it is so frustrating when YOUR NEIGHBOUR dosent PAY it seems you just have to GRIN and BEAR IT most of the TIME
this IS THE WORSE POSSIBLE case AS YOU KNOW THE guys GETTING SOME money in TOTAL BAS---D

I wouldn' have thought so.. we have asked our Administrator and UK debt collector to notify those agencies.

Persevere with the UK debt collection and if necessary demand they go down the court route.... this shyster will then have a CCJ against his name and credit will be a thing of the past for him, including the next time he wants a mortgage to move home !!
